NORTH CAROLINA 401 WATER QUALITY CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401
Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division
of Water Quality (DWQ) Regulations in 15 NCAC 2H, Section .0500 and 15A NCAC 2B .0233.
It is issued to Gary Singleton resulting wetland impact in Wake County pursuant to an
application filed on the 15`° day of September, 1999 to stabilize the shoreline of Crabtree Creek
at 121 Drewry Lane Raleigh.
The application provides adequate assurance that the discharge of fill material into the
waters of Crebtree Creek in conjunction with the proposed development will not result in a
violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State
of North Carolina certifies that this activity will not violate the applicable portions of Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the
application and conditions hereinafter set forth.
This approval is only valid for the purpose and design that you submitted in your
application, as described in the Public Notice. If you change your project, you must notify us
and send us a new application for a new certification. If the property is sold, the new owner must
be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre
or total perennial stream impact exceeds 150 feet, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow
the conditions listed below. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion
control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations.
Condition(s) of Certification:
1. Appropriate sediment and erosion control practices which equal or exceed those
outlined in the most recent version of two manuals, either the "North Carolina Sediment
and Erosion Control Planning and Design Manual" or the "North Carolina Surface
Mining Manual" (available from the Division of Land Resources in the DEHNR
Regional or Central Offices). The control practices shall be utilized to prevent
exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh
water streams and rivers not designated as trout waters; 25 NTUs in all lakes and
reservoirs, and all saltwater classes; and 10 NTUs in trout waters);
2. All sediment and erosion control measures placed in wetlands or waters shall be
removed and the natural grade restored after the Division of Land Resources has
released the project;
3. Measures shall be taken to prevent live or fresh concrete from coming into contact with
waters of the state until the concrete has hardened;
4. Should waste or borrow sites be located in wetlands or other waters, compensatory
mitigation will be required since it is a direct impact from road construction activities;
Violations of any condition herein set forth shall result in revocation of this Certification
and may result in criminal and/or civil penalties. This Certification shall become null and void
unless the above conditions are made conditions of the Federal 404 and/or coastal Area
Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA
permit.
If this Certification is unacceptable to you have the right to an adjudicatory hearing upon
written request within sixty (60) days following receipt of this Certification. This request must
be in the form of a written petition conforming to Chapter 150B of the North Carolina General
Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C.
27611-7447. If modifications are made to an original Certification, you have the right to an
adjudicatory hearing on the modifications upon written request within sixty (60) days following
receipt of the Certification. Unless such demands are made, this Certification shall be final and
binding.

THIS CERTIFICATION is issued in conformity with the requirements of Section 401

Corps of Engineers dated March 12, 1999 to stabilize the shoreline of Crabtree Creek at 121
Drewry Lane Raleigh.
The application provides adequate assurance that the discharge of fill material into the

Please find the attached submittal for the subject project. The current structure of
hardened concrete bags will be removed and replaced with the hard stabilization
techniques in the attached plans dated September 14, 1999. The cross section will have
approximately the same area between the pre-impact conditions and the proposed
conditions. Also, the transition from the hard armoring to natural bank will be smooth (to
avoid eddy currents). Rock vanes are proposed to help force the thalweg away from Mr.
Singleton's property. It is not clear if these structures will be effective at moving the
thalweg as desired , but the engineer believes that their presence will do little damage to
the stream banks. In any event, the proposed bank-hardening plans seem reasonable
considering all of the circumstances discussed by the engineer in his letter dated
September 15, 1999.

We know that the Crabtree, Creek watershed is a dynamic one that is still. seeing development
pressures and that has not yet reached a stable :condition. In,response, the stream channel
continues to change because of this dynamic hydrologic regime and we_anticipate that many
years will tie required for.the stream to become stable. Historical records on other streams
indicate that 20 to 50 or more years may be required for a stream to stabilize in response to an
altered hydrologic regime. A comparison of historical dimensions ;from the FEMA cross section
to dimensions from the current existing cross section indicates that one way the channel is
responding to the hydrologic changes is by becoming more incised. The banks are higher and
the maximum depth isdeeper. The overall flow area as measured at top of the right bank has
increased by over 6 percent from 990 SF to 1054 SF. Stream incision is atypical reaction to
watershed development and loss of historical floodplain. Incision is generally followed by a
period of bank erosion so that the channel may reestablish a floodplain at a lower, level.

'Stream 's'root problems result from.-the many individual home4nd property owners` upstream who
insist on sealing the land surface, eliminating floodplain storage and altering the natural drainage
system, Unfortunately; Mr. Singleton is forced to spend large sums of money to mitigate the
continuing damage that he did not cause:

You raise the question about the proposed project's impact on upstream and downstream erosion.
As described above, the entire stream system is in, a continual state of flux and erosion is quite
evident all along the stream, especially at the outside of meander bends such as at this project ,
site. We can be quite sure that if nothing is done here, there will be continued erosion of the
bank. The proposedprojectwill mitigate erosive effects. along Mr. Singleton's property and we
are incorporating features to minimize impacts up and downstream These features iinclude
smooth blending of'tl ,, s wing terial into the, natural;bapks;o,the?up..and,downstream
endpoints. Smooth transitions will minimize_ddy, currents a.Feadtui?ttlence. Also,. we are
using deflector weirs to direct the dominant erosive. currenrts` mto?;rthe center of the channel where...
these-currents wi11-do little damage to streambanks: and .wherethe y create and maintain

sections show, the flow area after the project will be slightly' larger than the existing flow area.
We recognize that the deflector weirs may be, viewed. by some as restricting flow, however
experience and researd) show that the resulting;improvements toIhe thalvveg conditions from
introduction of the weirs will offset, their, minor; restnetions to the. flow area,;.
We cannot, guarantee that no erosion will result from this,work, however I am quite confident of,
the following: 1), erosion will continue up- and downstream, and 2) erosion will continue in the
project site if nothing is done. I do, not anticipate that this work will significantly improve the
conditions up and.downstream of the project and we are taking appropriate actions to avoid
making matters worse: You stated that ewe have not provided calculations.on the possible
upstream and downstream channel impacts. I am aware of only one approach to analyzing such
conditions and that is using finite element analysis procedures to model two and three
dimensional flows. These analyses require copious amounts of data, cost thousands of dollars to
perform, and are of questionable value since so many boundary, conditions must be estimated or
assumed. Itis inappropriate to take this approach for a project of such limited scope.
This project provides the following benefits:
1. Erosion of the bank in the project area will be significantly reduced.
2. Sediment production from the project area will be'significantly reduced.
3. Existing trees in the project area will be preserved and protected as much as, possible.
4. New vegetation (trees ;-shrubs and.:other plantings) will be'introduced alongthe bank
within the'proiect area:
5. Thalweg flow conditions will be improved by the development of scour pools.
6. Aquatic, environment conditions will be improved through` increased habitat diversity.
The negative aspects of the project are relatively short-lived. The stream will be temporarily
disrupted during construction, but this will quickly pass once construction is complete. Some
people consider the stark nature of the, riprap and gabions to be aesthetically offensive. Our
experience is that in a relatively short time, the riprap will silt in and plants will begin to grow
between the rocks. Trees, shrubs and vines will be planted among the, gabions to provide ,
additional habitat and, screen the "engineered" look.
In'summary, we feel the benefits of doing this work in the manner proposed far outweigh the
real, potential or imagined negatives. We are committed to an effective project that stabilizes

This Office is in receipt of your plans dated June 16, 1999. Your submission did not
contain information to show that the proposed placement of rip rap and/or gabions in the "pre-
impact limits of the stream channel will not cause accelerated erosion upstream or downstream
of the proposed project. This Office is concerned that the constriction and redirection of the steam
channel may exacerbate upstream and down stream bank instability. Please provide any plans,
showing entire channel cross-section(s), and calculations to provide information on the possible
upstream and downstream channel impacts. Also, it is not clear what effect the proposed
placement of the rock weir deflectors will have on the current conditions in the stream. Please
provide a copy of Section view "B-B" describing weir deflector detail and an explanation of the
anticipated effects of the deflectors.

Enclosed is the modified application of Gary F. Singleton,
for a Department of the Army permit and a State Water Quality
Certification for the proposed discharge of fill material (clean
earth backfill, and riprap) in waters of the United States, at
his residence at 121 W. Drewry Lane, on the north side of
Crabtree Creek, in Raleigh, Wake County, North Carolina. The
work involves bank stabilization and the replacement of bank
material lost during hurricane Fran in September, 1996, and will
involve total impacts to approximately 1,390 square feet (0.03
acre) of creek bottom below ordinary high water.
Your receipt of this letter verifies your acceptance of a valid
request for certification in accordance with Section 325.2(b)(ii) of
our administrative regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification may be required under the provisions of Section
401 of the same law. A Department of the Army permit will not be
granted until the certification has been obtained or waived.
Please note that, because of the relatively small change in the
impacted resource between the original and the modified application,
we will not be issuing a public notice for the modification.
In accordance with our administrative regulations, 60 days after
receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request by May 10,
1999, the+ District Engineer will deem that waiver has occurred.

Nature of Activity:
This project is intended to stabilize the outside of a meander bend on Crabtree Creek at
121 W. Drewry Lane, which eroded significantly during Hurricane Fran in September
1996. A previous attempt to stabilize the bank with concrete bags has been stopped.
Over many years, this outside bend has experienced erosion that is typical of most bends
in creeks having this size and geomorphology. A review of historical records (HEC-2
analysis from FEMA study in 1989) shows that the bank near the point of interest had a
slope of 2.7H to IV.
The proposed stabilization plan calls for a 2H:1 V slope from the top of the existing bank
to the creek bed. A trench 2 ft deep and 2 ft wide will extend along the toe of the
proposed slope for a length of approximately 142 ft (not to exceed 150 ft). Geotextile
filter fabric will line the trench and the 2H:1 V earthen bank slope. Class 2 riprap will be
placed from the bottom of the trench to 8 ft above the existing elevation of the stream
channel. Class 1 riprap will be placed from the top edge of the class 2 riprap to the top of
the existing bank at a maximum thickness of 1.5 ft. Native woody species will be planted
through the class 1 riprap and filter fabric to further stabilize the bank. Previously placed
concrete bags will be removed. Two rock deflector weirs will be constructed from class
2 riprap. These devices will also be trenched below the invert of the stream channel.
They will be flush with the channel invert at the centerline of the stream channel and will
rise to a height of 4 ft by the time they intersect the riprap-faced embankment. The
deflector weirs will be pointed upstream in order to deflect the flow in the outside of the
meander back to the center of the stream. The weirs will be placed at an angle between
30 and 45 degrees from the bank (angle to be determined in the field depending on
direction of flow toward bank.)

r The upstream end of the riprap section will be tapered smoothly into the existing bank at
the outlet of a corrugated metal pipe (CMP) which discharges into Crabtree Creek. The
CMP carries tributary streamflow under an existing sanitary sewer outfall and is owned
by the Raleigh water and sewer system. Severe corrosion of this CMP will ultimately
lead to its failure unless remediation of the pipe is implemented. The downstream end of
the riprap section will be tapered smoothly into the existing bank to form a hydraulically
efficient transition to natural bank material and to minimize erosive eddy currents in that
area.
Project work will require the use of heavy equipment and hand labor to construct. Heavy
equipment will be required to dig trenches and shape the bank and to lift and place the
riprap. We envision that the project will be constructed during the summer months when
flows are typically lower and access can be gained to the channel bed. Care will be taken
to minimize disruption of the channel and aquatic flora and fauna.
The proposed project will have the following beneficial effects:
• Woody vegetation planted in the riprap will provide shade and habitat for aquatic and
terrestrial animals.
• The rock deflector weirs will provide aquatic habitat diversity and will minimize
erosive flows against the downstream outside of the stream meander.
• The riprap will attract and accrete sediment which will provide soil substrate for plant
growth.
• The protected bank will produce less sediment.
Existing trees and vegetation at the top of the slope will be preserved.
