Box 400 Harkers Island N.C. 28531 Dear Mr. Pasfield: You have our approval, in accordance with the attached conditions, to place fill material in 3,235 square feet Island of waters for the purpose of stabilizing a shore line at 1002 Island Road in Markers as you described in your application dated 28 January, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This certification replaces me issued to you on 12 April, 1999. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to place riprap material on both sides of an existing breakwater in Back Sound at Harkers Island Fishing Center. FIELD INVESTIGATION REPORT: Harkers Island Fishing Center/Carteret County PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting: The applicant's property consists of an approximately 2.31 acre tract of land located adjacent to Back Sound and NCSR 1335 or 'Island Road', on Harkers Island, in Carteret County. The property was developed into a motel and marina facility in the 1970's and today approx. 22 motel units and 70 boat slips are available to rent to the public. A ship's store, a boat ramp and a dry stack facility are also located on the property. The marina is located in the open waters of Back Sound and is protected by a concrete breakwater on the west side and a wood breakwater on the east side. The basin area has been bulkheaded. Major CAMA Permit # 111-81 was issued to the property owners to allow the placement of a concrete breakwater on the west side of the property. Although no permit could be found authorizing the breakwater on the east side, this breakwater appears in several of the older plats for the project. The breakwater on the east side extends perpendicular to the existing bulkhead out for a distance of approximately 210' then hooks slightly to the west and goes another 75'. The permit was later modified authorizing the construction of a dry stack facility. The wood breakwater on the east side has been repaired several times in the past years and is presently in need of repair. The facility is served by a community water system while sewage disposal is by individual septic tanks located on the property. There is no pump out facility available at the marina facility. Back Sound is classified as SA ORW waters and the immediate area around the marina is closed to the harvesting of shellfish. Back Sound is noted for its extensive areas of submerged aquatic vegetation (SAV) and shellfish resources including clams and scallops. Project Description: The applicant is proposing to place rock riprap along both sides of the breakwater located on the east side of the property. The rock riprap would begin at the hook in the breakwater and extend on either side of the breakwater for a distance of 7.5' or a total of 15' x 75 long. The placement of the rock 7.5' on both sides of the breakwater would create a slope of approx. 2:1. Calico Jack's Inn & Marina which is located very near the project was issued Major Permit # 138-96 to place rock riprap waterward of an existing breakwater to help protect their marina basin. ANTICIPATED IMPACTS: The project as proposed will result in the filling of approx. 1,125 sq. ft. of shallow water bottom area with 167 cubic yards of riprap material being placed below the mean high water: line. The finish grade of the riprap would be 2' above the NWL. The material used for riprap must be of a sufficient size to prevent its easy movement offsite since it will be directly exposed to southwest winds. It is not anticipated that the project would impact any SAV since there should be a "scour zone" immediately waterward of the existing breakwater. This high energy zone would normally not be a conducive area for SAV or shellfish resources. The proposed rock riprap should not pose any greater a problem to navigation than the existing breakwater that has been in place for several years. PROJECT SUMMARY: The applicant proposes to place riprap material on both sides of an existing breakwater in Back Sound at Harkers Island Fishing Center. FIELD INVESTIGATION REPORT: Harkers Island Fishing Center/Carteret County PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting: The applicant's property consists of an approximately 2.31 acre tract of land located adjacent to Back Sound and NCSR 1335 or 'Island Road', on Harkers Island, in Carteret County. The property was developed into a motel and marina facility in the 1970's and today approx. 22 motel units and 70 boat slips are available to rent to the public. A ship's store, a boat ramp and a dry stack facility are also located on the property. The marina is located in the open waters of Back Sound and is protected by a concrete breakwater on the west side and a wood breakwater on the east side. The basin area has been bulkheaded. Major CAMA Permit # 111-81 was issued to the property owners to allow the placement of a concrete breakwater on the west side of the property. Although no permit could be found authorizing the breakwater on the east side, this breakwater appears in several of the older plats for the project. The breakwater on the east side extends perpendicular to the existing bulkhead out for a distance of approximately 210' then hooks slightly to the west and goes another 75'. The permit was later modified authorizing the construction of a dry stack facility. The wood breakwater on the east side has been repaired several times in the past years and is presently in need of repair. The facility is served by a community water system while sewage disposal is by individual septic tanks located on the property. There is no pump out facility available at the marina facility. Back Sound is classified as SA ORW waters and the immediate area around the marina is closed to the harvesting of shellfish. Back Sound is noted for its extensive areas of submerged aquatic vegetation (SAV) and shellfish resources including clams and scallops. Project Description: The applicant is proposing to place rock riprap along both sides of the breakwater located on the east side of the property. The rock riprap would begin at the hook in the breakwater and extend on either side of the breakwater for a distance of 7.5' or a total of 15' x 75 long. The placement of the rock 7.5' on both sides of the breakwater would create a slope of approx. 2:1. Calico Jack's Inn & Marina which is located very near the project was issued Major Permit # 138-96 to place rock riprap waterward of an existing breakwater to help protect their marina basin. ANTICIPATED IMPACTS: The project as proposed will result in the filling of approx. 1,125 sq. ft. of shallow water bottom area with 167 cubic yards of riprap material being placed below the mean high water line. The finish grade of the riprap would be 2' above the NWL. The material used for riprap must be of a sufficient size to prevent its easy movement offsite since it will be directly exposed to southwest winds. It is not anticipated that the project would impact any SAV since there should be a "scour zone" immediately waterward of the existing breakwater. This high energy zone would normally not be a conducive area for SAV or shellfish resources. The proposed rock riprap should not pose any greater a problem to navigation than the existing breakwater that has been in place for several years.
