You requested additional information about future development planned for this project. Enclosed you will find a map and summary,sheet showing the additional information. To summarize the history of the project thus far, we have applied for and received a Nationwide 39 Permit from the U.S. Army Corps of Engineers to disturb less than 150 linear feet of jurisdictional waters. This requires us to meet water quality certification No. 3705. Since we are below the threshold limits, we provided a complimentary copy of the pre-construction notification to your office. Upon review of the complimentary PCN form, Ms. Sue Homewood advised my clients that stormwater outfalls on this site exceed 24% impervious cover and therefore they would be required to provide a stormwater management plan for approval. On May 4, I replied to her letter dated April 1 advising that our impervious cover is less than 24%. The only response to my letter was an email that refers me to the regulation, a telephone conversation with Ms. Homewood and one with you. Ms. Homewood stated in the telephone conversation that if my clients begin the project without a stormwater management plan, she would stop the project and issue a fine. Based on these discussions it seems that you refer to conditions of certification 412-A-ii of Water Quality Certification #3705 which states: "Contains one or more drainage areas that are anticipated to have impervious surface cover of equal to or greater than 24 percent. When drainage areas are difficult to delineate or when a pocket of high density exists within a drainage area, the division shall use best professional judgment to apply the SMP as appropriate."
