APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Neuse River Buffer
Protection Rules (15A NCAC 2B .0233) with Additional Conditions
Dear Mr. Cutler:
You have our approval, in accordance with the attached conditions, to usurp and/or shade 0.02 acre of vegetated
and non-vegetated wetlands in order to construct a dock with floating platform at a public launching pier in Oriental, Pamlico
County, as described in your application received by the Division of Water Quality on December 15, 2003. After reviewing
your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can
be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA
Permit when issued by the NC Division of Coastal Management. This letter shall also act as your approved Authorization
Certificate for protected riparian buffers per 15A NCAC 2B .0233. In addition, you should get any other federal, state or
local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-
Discharge, Water Supply Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire
when the accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application-for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed;
2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.

3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be
performed so that no violations of state water quality standards, statutes, or rules occur;
4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the date that the Division of Land
Resources has released the project;
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

9. NARRATIVE DESCRIPTION:
Project Setting
The site is located in the Town of Oriental at the end of Midyette Street adjacent to and
immediately south of the North Carolina Wildlife Resources boat ramp on Smith Creek, in
Pamlico County, North Carolina. The project is at the foot of the high-rise bridge and
immediately adjacent to Midyette Development Company, Inc., an entity involved in the
120-slip Oriental Harbor Marina complex on the other side of the bridge. The site is the
end of the Midyette Street which is a 40' public right of way going down to the water.
There is a 25' to 50' border of marsh along the natural shoreline that is vegetated with
S ap rtina cynosuroides, S. patens, Distichlis s ip cata, and Baccharis halimifolia among
others. The adjacent waters are fairly shallow with water depths 50' out averaging 2' to
3'. The bottom sediments are sandy with no submerged aquatic vegetation at the project
site noted during the site visit. The waters of Smith Creek are SC NSW and are closed to
shellfishing. The area is a designated secondary nursery area.
Project Proposal
The applicants propose to construct an 8' wide fixed pier/dock extending out from high
ground over the marsh into Smith Creek some 54'. The fixed portion of the pier would be
elevated a minimum of 3' above the marsh substrate. There would be a 10' X 16' floating
platform at the end to the structure to facilitate the launching and retrieval of small craft.
The total length of the structure including the floating platform would be 156'. There is no
formal parking area proposed in the application.
Anticipated Impacts
As proposed the structure would shade 360 ft2 of Coastal Wetlands, usurp and shade
another 464 ft2 of Public Trust Areas and Estuarine Waters of Smith Creek and another 464
ft- of pier structure would be constructed on high ground. Total area directly impacted by
the project would be 1,288 ft2. Construction of the pier/dock would cause a temporary
increase in turbidity in the immediate vicinity of the construction. The project would
facilitate small boat launching in the area and create conditions safer for the small craft then
those that currently exist at the NC Wildlife Resources boat ramp. The unaddressed issue
of parking for the trucks, cars, boat trailers, and dollies used for launching the small craft
is a concern. Finally, since the pier/dock is not designed for use by motor boats, prop
kicking would probably not be an issue.

SMALL BOAT LAUNCHING PIER
The Town of Oriental is applying for a CAMA permit for construction of a pier to launch
small sailboats, kayaks, and canoes. The launch facility is for non-motorized boats only.
The pier will be open to the public and is specifically for public access to Smith Creek
(which flows into the Neuse River). This launch facility is the only development
proposed inside of the 50-foot riparian buffer. To my knowledge, this project complies
with the North Carolina State Environmental Policy Act.
The need for a launch pier for small boats is genuine and immediate. In the past year,
Oriental has lost two (2) sailing regattas due to the lack of adequate launch facilities.
Other small boaters may have avoided Oriental for the same reason. The property where
the new Oriental Harbor Marina is being constructed was used for years to launch the
small boats (the property was privately owned but the owners allowed boats to be
launched). This property is no longer suitable or available for launching.
Some boaters have attempted to use the Town dinghy dock but it is too narrow for the
sailboats and not designed to accommodate kayaks and canoes. The State Wildlife Ramp
is often very crowded with large powerboats. It is dangerous to mix the small non-
motorized boats with the powerboats. As we have been informed several times, the
Wildlife Ramp is "designated" for powerboats.
Many people come from Raleigh, other NC towns, and other States to take advantage of
some of the best sailing on the east coast. The lack of basic launching facilities is not
good advertising for the "Sailing Capital of North Carolina."
Our economy is heavily depended on tourism tied to water activities. The Oriental Dingy
Club (ODC), to name just one of many local sailing associations, sponsors a number of
small sail boat regattas (25 to 50 boats each) with racers coming from all over North
Carolina, plus FL, SC, TX, VA, MD, and GA. The economic health of many of the
businesses in Town is directly tied to the number of boaters that come to Oriental. In
addition, water sports involving small boats, is the kind of environmentally friendly
tourism that we encourage.
The Town met with different individuals and groups representing sailboaters, kayakers,
and, canoers. We want to construct the best all-purpose launch facility that safely serves
the public. Many of the small sailboats are typically launched from a 6-foot wide rolling
dolly. Some of the canoes and kayaks are 20 feet or more in length. We are requesting
an eight-foot wide pier for public safety reasons and to have the capability to dolly launch
non-motorized sailboats.

We realize a 6-foot wide pier would meet the square footage rule, as the size of the
floating platform (160 sf) would be the same with either size pier. However, a six-foot
wide pier simply cannot accommodate certain boats and cannot safely handle the number
of boats, the type of boats, and the number people that will be using this facility. Also,
an eight-foot wide pier will better accommodate the handicap and provide safer
movement along the pier - especially where the pier turns.
The fixed portion of the pier will be constructed by driving 10" marine grade pilings a
minimum of eight feet deep which will support the framework for concrete reinforced
panels (each panel is 4' x 10'). The concrete panels will be maintenance free, much more
resistant to damage from hurricanes, and last longer than conventional wood decking.
