Project Summary: The applicants wish to construct a 47-lot subdivision with infrastructure, paved roads, clubhouse, parking lot, 47-slip marina, boat ramp, & a golf cart bridge for private use and are applying for a permit to do so. Field Investigation Report: Port Vandemere Page 2 9. Narrative Description: The NC Division of Coastal Management staff has reviewed this proposal under the NC State Environmental Policy Act and issued a Finding of No Significant Impact on August 31, 2009. The property is located near Vandemere at the end of Vandemere Creek Drive, off of NC 306 in Pamlico County. The tract is a 71-acre tract adjacent to Vandemere Creek. This site is developed with gravel access roads, three docking facilities, and a single family residence under construction. The adjacent tract to the north is undeveloped and the adjacent tract to the south is a proposed subdivision. The elevation of the high ground of the parcel is about +5' above the normal water level. Vegetation on this lot mainly consists of Coastal Wetlands, mixed trees and shrubs, and Section 404 Wetlands. This tract has approximately 9,849' of continuous shoreline along Vandemere Creek. Immediate offshore water depths adjacent to the lot range from about -2' to -6.9' nwl. The subaqueous substrate is firm without shell. This waterbody is about 480 feet across at this location. These waters are not classified as a Primary Nursery Area and there is no submerged aquatic vegetation present. This area is closed to shellfish harvest and is classified as SC; Sw, Nutrient Sensitive Waters. There is not a defined Federal Channel in this area. This project area is subject to the Neuse River Riparian Buffer Rules. 10. Proposed Development: The applicant wishes to construct a new 47-lot subdivision with infrastructure, paved roads, clubhouse, parking lot, 47-slip marina, boat ramp, and a golf cart bridge adjacent to Vandemere Creek near Vandemere. The proposed development will take place near the end of Vandemere Creek Drive, off of NC 306. The upland development consists of the construction of a 47-lot subdivision with infrastructure, parking lot, golf cart path, golf cart bridge, two ponds, asphalt roads, and a community clubhouse with a pool. The utilities will be sited within the roadway network right-of-ways. The access roads will connect to the end of Vandemere Creek Road. At the end of Vandemere Creek Drive, the road will fork north and south. The road heading south will mainly serve the adjacent proposed subdivision, not a part of this project. The road ("Shell Castle Lane") heading north/northeast will be 1,470' long and have a 60' wide right-of-way (20' paved traveling width) and end as a cul-de- sac. There will be another road and cul-de-sac ("Royal Shoal Lane") 160' north of the fork heading due east that will be 550' long with a 60' right-of-way (20' paved traveling width). Approximately half way up "Shell Castle Lane" will be another road ("Frying Pan Road") that connects to the adjacent tract to the northwest. "Frying Pan Road" will be 220' long with a 60' wide right-of-way (20' paved traveling width). The remainder of the road will be off site and will not be a part of this project. Brad Connell November 6, 2009 Morehead City Field Investigation Report: Port Vandemere Page 3 Just north of the Vandemere Creek Drive adjacent to the entrance to the proposed subdivision, the first pond will be 260' long and 140' wide. The second pond will be 700' east of this pond and will be 70' wide and 200' long. At the end of "Shell Castle Road," there will be 320' long by 12' wide asphalt golf cart path heading south into the subdivision's common area. The cart path forks and has a parking lot in the fork approximately 100' from "Shell Castle Road." The parking lot will support four vehicle parking spaces. This parking lot will be 24' long and 40' wide. The other roadway at the fork will head easterly towards Vandemere Creek. This road will be 300' long and 12' wide. At its terminus will be a boat launch that is 15' wide and 60' long. On the south side of the boat ramp, will be a 6' wide and 50' long staging dock. This boat ramp will extend 25' waterward of the normal water level. At the terminus of the golf cart path, there will be another parking lot. This parking lot will support parking for twelve golf carts. This parking lot will be 72' long and 22' wide. The parking lot will be 100' from the normal water level and 75' from the Coastal Wetlands. Immediately adjacent to this golf cart parking lot, will be a 5,000 square foot clubhouse and pool. The clubhouse and pool will be approximately 75' landward of the normal water level and 50' from the Coastal Wetlands. At the southwest corner of the golf cart parking lot, will be another cart path, bridge and cul-de- sac. This wooden cart path and bridge will be 470' long and 6' wide. This elevated path and bridge will traverse 100' of Coastal Wetlands and an unnamed tributary (UT) of Vandemere Creek. The UT is 80' wide at this crossing. The golf cart bridge will be elevated at least 3' above the Coastal Wetland substrate and 10' high above the navigable slough accessing the UT. The UT is - 3.0' nwl deep at this location. This path and bridge will connect to a cul-de-sac on a common high ground area. This bridge will shade 630 square feet of Coastal Wetlands and 480 square feet of open water. From the clubhouse pool, there will be two mulch walkways to access two sections of the residential marina. The southern most walkway is 6' wide and 150' long. The walkway just north of it is 6' wide and 190' long. The southern most section of the marina, "D Dock," will support eleven boat slips. The main pier is 6' wide and 230' long. There will be seven finger piers and twelve tie pilings. Four of the finger piers are 30' long, two are 35' long, and one is 40' long. All of the marina's finger piers are four feet wide. This southern most section of docking is 375' from the adjacent riparian property line. This section of dockage will shade approximately 60 square feet of Coastal Wetlands and will extend 150' waterward into the 335' wide UT. The next section of proposed dock, "C Dock," will lie 84' to the north and will support eight boat slips. The main access pier will be 6' wide and 130' long. There will be four finger piers, eight tie pilings, and one "T" platform. Two of the finger piers are 30' long and the other two are 35' long. The "T" platform is 105' long and 6' wide. The next section of proposed dock, "B Dock," will be 84' to the north and will support eleven boat slips. The main access pier will be 6' wide and 190' long. Where will be six finger piers, ten tie pilings, and a "T" platform. Each of the finger piers will be 30' long. The "T" platform at the end of the pier will be 6' wide and 85' long. "B Dock" will extend 153' waterward into Vandemere Creek. On the north side of the boat ramp, will be the final section of dockage. This section of dock, "A Dock," will support seventeen boat slips. The main access pier will be 6' wide and 350' long. There will be ten finger piers and eighteen tie pilings. Six of the finger piers will be 30' long, three of the finger piers will be 35' long, and one will be 40' long. "A Dock" will extend 120' waterward into Vandemere Creek. This marina will be able to support vessels up to 60' long. This marina will have a total of 47 slips and will serve the Port Vandemere subdivision. Three of the wet slips will be 20' by 60,' nine of the slips will be 18' by 50,' four of the slips will be 17' by 45,' thirty of the slips will be 16' by 40,' and one catamaran wet slip will be 32' wide by 40' long. The average depth in the marina slips is approximately -5' NWL. "D Dock" will be approximately 375' from the adjacent riparian property corridor to the south and "A Dock" will encroach into Lots #25 & 26's riparian property corridors to the north. Both of these lots are currently owned by the applicant. The closest existing adjacent docking facility is 195' north of "A Dock." 10. Anticipated Impacts: The northern most section of dockage and boat ramp will encroach into Lot #25 & Lot #26's riparian property areas. This marina will extend 153' waterward into a 650' wide waterbody. The 47-slip marina will usurp 122,500 ft2 of public trust waters and have 4,580 ft2 of platform area along 1,800' of shoreline adjacent to Vandemere Creek. The lot grading, ponds, roads, parking lots, and clubhouse will disturb approximately 24 acres of high ground. Approximately 2% of the tract within the coastal shoreline AEC will be covered by impervious surface, and 6% of the entire tract will be covered by built-upon surfaces. A section of the paved cart path and the paved drive that accesses the boat ramp are impervious impacts within the 50' Neuse River Riparian Buffer. The marina and golf cart bridge will shade 960 ft2 of Coastal Wetlands and 9,680 ft2 of open water. There is no submerged aquatic vegetation (SAV) in the project area. These waters of Vandemere Creek are classified as SC; Sw, NSW waters. These waters are not Primary Nursery Area and are closed to the harvest of shellfish. The golf cart bridge pilings will restrict the navigable opening of the 80' wide UT down to a 20' wide access. The boat ramp will fill 450 square feet of shallow bottom habitat. "D Dock" will extend 150' waterward into the 335' wide UT. This encroachment, coupled with the bridge, will significantly reduce the amount of navigable waters at the mouth of the UT. Gregson, Director Dee Freeman, Secretary MEMORANDUM DATE: November 6, 2009 TO: Doug Huggett THRU: Tere Barrett FROM: Brad Connell Z), SUBJECT: Comments and Recommendations - CAMA Major Permit - Port Vandemere Marina, Pamlico County The following is my assessment and consequent recommendations of the above referenced proposal: This proposal involves the grading and filling of 1,045,440 square feet of high ground. This proposal shades 960 square feet of Coastal Wetlands. The proposed residential marina incorporates 122,500 square feet of public trust waters. The boat ramp will fill 450 square feet of shallow bottom habitat. These waters of Vandemere Creek are closed to shellfish harvest. This waterbody is not a Primary Nursery Area. "D Dock" will extend 150' waterward into a 335' wide tributary. This proposal will pose a hazard to navigation. The Morehead City District staff would recommend that this dock's encroachment into the mouth of the UT be reduced in order to meet the specific use standards listed in 15A NCAC 07H .0208(b)(5). The golf cart path and associated bridge crossing do not appear to minimize impacts to navigation nor demonstrate a need for this development as set forth in the general use standards of 15A NCAC 07H .0208(a). The applicant has not justified the need for the impacts to navigation of the UT, since there is no other associated development on that portion of the tract. Users can access this community lot by boat. The Morehead City District staff would recommend the denial of this portion of the proposed development. The Morehead City District staff disagrees with the riparian corridor lines to the north, and believes that the "A Dock" will usurp the riparian area of Lot #26 and encroach into the riparian corridor of Lot #25. The Morehead City District staff would recommend that Lot #26 be dedicated as a community lot and that Lot #25 has deed restrictions prohibiting the installation of its own docking facility. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) Any mitigative measures or environmental commitments specifically made by the applicant in the Environmental Assessment for this project should be 400 Commerce Avenue, Morehead City, North Carolina 28557 Phone: 252-808-2808 \ FAX: 252-247-3330 \ Internet: www.nccoastaimanagement.net An Equal Opportunity \ Affirmative Action Employer - 50% Recycled \ 10% Post Consumer Paper Port Vandemere Marina November 6, 2009 Page 2 of 3 implemented, regardless of whether or not such commitments are addressed by individual conditions of this permit; 2) Any development or land disturbing activity that is considered non-water dependent is not authorized within 50 feet of the normal water level or coastal wetlands unless specifically exempted by Environmental Management Commission (EMC) Neuse River buffer regulations in place at the time of such development; 3) Any building constructed shall comply with the North Carolina Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program; 4) Prior to construction of any new boat slips or other docking facilities under this permit, the permittee must apply for and receive an Easement from the Department of Administration's State Property Office as required under N.C.G.S. 146-12(e); 5) Any portion of the permitted access pier and docking facilities built over coastal wetlands must not exceed six feet in width and must be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking; 6) This permit authorizes a maximum of 47 boat slips. At no time shall more than 47 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft; 7) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this public boating access facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification; 8) The piers and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge; 9) In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters; 10)Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent Port Vandemere Marina November 6, 2009 Page 3 of 3 wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.); 11)An "as-built" survey depicting the docking structures' proximity to the adjacent riparian property lines and waterward extent of the marina must be submitted to the Division within 60 days of completion of the project; 12)No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: This permit does not convey any rights, either in real estate or material. NOTE: Should either adjacent property be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. NOTE: Permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. Schecter Applic ame Ap scant ign ur Project Narrative: Port Vandemere Yacht Club September 7, 2009 The proposed Port Vandemere Yacht Club and associated 47-lot subdivision is located in the northern portion of the Town of Vandemere on the shores of Vandemere Creek. The tract consists of a total of 70.76 acres, of which 9.7 are coastal wetlands and 7.44 are 404 wetlands. Overall development includes single family lots, access roads, water/sewer infrastructure, dedicated passive recreation/open space area, two small ponds, a marina club house with pool, one boat ramp, and a 47-slip open-water marina. A 6-foot wide walkway with 10-foot high bridge over the southern slough will connect to an open space area. The height is sufficient to allow small boat navigation in the -3 foot or less depths of the slough. Individual lots will be sold and residences will be constructed by the owners. The marina footprint is composed of four docks and encompasses 42,189 square feet of public trust waters. Creeks widths at the marina vary from 600 to 800 feet. Slip totals and dimensions are: three 60-foot slips; nine 50-foot slips; four 45 foot slips; and thirty-one 40-foot slips. All finger piers will be 4 feet wide and will be 3/4's of the length of the slip. Depths associated with the marina slips range from -4 feet to over -6 feet NWL. A concrete boat ramp will be located between Docks "A" and "B" with ramps end depths of -3.5 NWL. No coastal marsh or 404 wetlands will be impacted by the construction or operation of the ramp. Pump out will be available but no fuel or haul out services will be provided. An Emergency Contingency and Response Plan will be on record (Attachment 1). Water will be supplied by the Town of Vandemere and wastewater collection and treatment will be provided by the Bayboro Metropolitan Sewer District. Stormwater Management (SW- 7070624) and Erosion/Sedimentation Control (PAMLI-2008-0002) plans have been approved by the respective agencies. Additionally, Deed Restrictions will be filed to protect the Neuse River Water Quality Buffer Zones in accordance with the Division of Water Quality (Attachment 2). As reported in the Final Environmental Assessment, an in-the-water survey for Submerged Aquatic Vegetation and shellfish was conducted on June 4, 2007 over the entire area of the marina footprint. The bottom substrate was generally firm to hard and there were no indications of SAV in any transacted area. No live shellfish were observed although widely scattered shell fragments were observed. This finding corroborates DMF substrate mapping data.
