Dear Ms. Chapman:
We are in receipt of the letter dated October 23, 2009 from Cyndi Karoly, supervisor of your
department, which indicates that our Minor Variance Application is unpermittable.
Enclosed is a revised siteplan and revised nitrogen calculations for a proposed project revision
which would include the removal of 341 square feet of impervious area from Zone 1 and 417
square feet of impervious removal from Zone 2 by the removal of a concrete basketball court.
Taken into consideration with the net increase of impervious area from the proposed Sunroom
addition which is 256 square feet in zone 2, the net effect of the revised project is a decrease of
341 square feet of impervious in Zone 1 and a decrease of 161 square feet of impervious in Zone
2. The revised nitrate calculations show a decrease of 0.44 pounds per acre per year from the
revised project. The basketball court area would be seeded with Tall Fescue grass seed at
completion of the project with a onetime fertilization at the allowable rates in April of 2010.
We respectfully request your approval of our Minor Variance Application with these proposed
revisions, as the project now would have a net benefit to the creek and to the watershed.

On October 19, 2009, the Division of Water Quality (DWQ) received your minor variance application
dated October 16, 2009, to fill or otherwise impact 256 square feet of Zone 2 protected riparian buffers to
construct the sunroom at the subject property.
By guidance from the Attorney General's Office on the interpretation of the Neuse Buffer Rule, you must
meet the hardships outlined in 15A NCAC 02B .0233(9)(a) in order to qualify for a variance from the
Neuse Buffer Rules. You have not met the hardship described in 15A NCAC 02B .0233(9)(a)(i)(E), in
that you purchased the property after the effective date of the rule. Therefore this office can not process
your application.
Individuals that dispute a permitting determination from a riparian buffer rule by the DWQ may ask for
an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a
hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes
to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This
determination is final and binding unless you ask for a hearing within 60 days.
