While the area that is designated as the project contains portions of the 100 year floodplain,the only development that will occur in the floodplain is the

Avoidance and Minimization Narrative and Explanation of PCN Revisions
Due to modifications to the greenway, additions to the sewer easement and a requirement by the Town of Apex to have
a second crossing in order to access the northwestern corner of the property, slight changes have been made to the
impact maps for Phases 2-4 of the Smith Farms project. The majority of the changes only impact buffers; however, some
stream impacts have varied as well. The purpose of this memo is to highlight all changes that have been made to the
designs and to provide an understanding of why each of these was necessary for the project. Additionally, it is important
to mention that total permanent stream impacts have not increased, and have actually decreased from 283 linear feet
to 261 LF. Similarly, the wetland impacts have been reduced from 0.223 acres of impacts to 0.06 acres.
The first major change is the addition of the second crossing. Originally, a crossing was proposed on Watering Can lane,
which would extend into the NW corner of the property. However, during the Town of Apex’s review of the construction
drawings, they determined that based on UDO section 7.5.4E a second access was necessary to alleviate traffic issues
during peak hours since more than 50 lots were proposed. Because this section of the property can only be accessed by
crossing the stream, another crossing has been added on Rise and Shine Road. Both crossings have been designed with
minimization in mind. The crossing at Watering Can lane is positioned at the location of an existing dirt road and 40 ft
piped crossing underneath. By choosing this location, the total new impacts are reduced by 40 ft, since this area has
been impacted previously. Additionally, the crossing on Rise and Shine Road was situated on a relatively straight stretch
of stream in order to minimize impacts to buffers, and headwalls on both crossings are planned to decrease the width of
the crossings and therefore limit stream impact.
The other major change is the extension of the sewer easement into phases 2-4. On the previous submission there were
no stream impacts related to sewer easements or outfalls, but due to a request from the Town of Apex utility
department, the easements are now extended through this phase to allow for connection to adjacent properties. This
additional section of sewer easement has greatly increased the amount of buffer that will be impacted, and will cause
temporary impacts to streams. No permanent stream impacts will be caused by this extension.
Lastly, the greenway has been adapted since the initial submission, in order to comply with the ADA requirements. This
included adding several switchbacks, which were not included in the original straight shot design. There are no stream
impacts related to the greenway; however, there are slight changes to the buffer impacts.
There have also been a few changes that have reduced stream impacts, which include reducing the listed impacts for
crossings with pre-existing impacts, eliminating impacts from the greenway and eliminating 25 ft. of fill impact to
unnamed stream (stream Q).

On June 27, 2019, Mr. James Misciagno went to the subject site to evaluate one {1) drainage feature and
determine if it was subject to the Town of Apex (Town) riparian buffer rules. Based on the information
obtained during the site visit and per the requirements set forth in Section 6.1.11 of the Town Unified
Development Ordinance {UDO), I concur with the stream classification as shown on the attached sketch
dated June 2019 and summarized below.

This on-site determination shall expire five (5) years from the date of this letter. Landowners or affected
parties that dispute a determination made by the Division of Water Resources {DWR) or Delegated Local

An appeal request must be made within sixty {60) days of date of this letter or from the date the affected
party (including downstream and/or adjacent owners) is notified of this letter. A request for a
determination by the Director shall be referred to the Director in writing c/o Karen Higgins, DWR -401 &
Buffer Permitting Unit; 1617 Mail Service Center, Raleigh, NC 27699-1617. Otherwise the appeal
procedure will be in accordance with UDO Section 6.1.11.
If you dispute the Director's determination, you may file a petition for an administrative hearing. You
must file the petition with the Office of Administrative Hearings within sixty (60) days of receipt of this
notice of decision. A petition is considered filed when it is received in the Office of Administrative Hearings
during normal office hours. The Office of Administrative Hearings accepts filings Monday through Friday
between the hours of 8:00am and 5:00pm, except for official State holidays.
