Dear Mr. and Mrs. McElheney:
You have our approval, in accordance with the attached conditions, to place fill in 0.00367 acre of vegetated
wetlands in order to construct a bulkhead on your property at 33 Sailfish Point in Dare County, as described in your
application received by the Division of Water Quality on November 12, 2003 with the final design described in additional
correspondence received March 4, 2004. After reviewing your application, we have determined that this fill is covered by
General Water Quality Certification Number 3400, which can be downloaded from our web site at
http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC
Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed,
Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application.for-a new certification-; If the
property is sold, the new owner must be given a copy of the Certification and approval lettertand is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one:acre;'cornpensatory
mitigation maybe required as described in 15A NCAC 2H .0506 (h). Forth is approval to be valid, youimust follow the.
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all twork,included,in
the 401 Certification has been completed;
2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the CAMA Application. All construction activities, including the design, installation,
operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so
that no violations of state water quality standards, statutes, or rules occur;

4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the date that the Division of Land
Resources has released the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.

Reference your application for a Department of the Army (DA) permit to construct
a bulkhead landward of coastal wetlands, on property located at 33 Sailfish Point, in the
Pirates Cove Subdivision, adjacent to the Roanoke Sound, in Manteo, Dare County, North
Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of general permit No. 198000291. Therefore, you may commence construction
activity in strict accordance with applicable State authorization and the approved plan. Failure
to comply with the State authorization or conditions of the general permit could result in civil
and/or administrative penalties.

wetlands on his property located at 33 Sailfish Point, Manteo, Dare County, and adjacent to the
Roanoke Sound.

Project Setting
The project site is located at Lot 33, Sailfish Point, Pirates Cove subdivision, adjacent to US
64/264, Manteo Causeway, Manteo, Dare County, and adjacent to the Roanoke Sound. The lot
has an area of approximately 7,500 square feet, has sandy soils, and has an elevation of
approximately 5 feet above normal water level (NWL). A single family dwelling exists on the
property with a yard area that has been landscaped with turf grass and shrubs.
Adjacent to the water line, the lot has a wetland area vegetated with Juncus roemerianus,
goldenrod, and marsh elder. At the water line, the wetland area is vegetated with Spartina
alterniflora and Juncus roemerianus. The wetland area size is approximately 1,100 square feet.
Approximately 15 feet of the shoreline on the north side has riprap that was installed by the
developer prior to the applicant purchasing the property. The property has an elevated walkway
that connects the house with an existing waterside dock that was constructed by the developer of
the subdivision.
The adjacent property to the south has a single family dwelling and a bulkhead with a small sandy
beach area waterward of the bulkhead. The adjacent property to the north has a single family
dwelling with shoreline riprap, and a vinyl bulkhead is currently under construction on this lot to
replace the existing riprap.
The property faces northeast on the Roanoke Sound and experiences significant erosion. The
application indicates that the erosion rate is approximately 3 feet per year. A CAMA General
Permit #34475A has been issued to the applicant to construct a short bulkhead with a return on the
north side of the property. The permit does not authorize any wetland fill.
The waters of Roanoke Sound in this area are classified as SA and are closed to shellfish taking.
Development Proposal
In order to protect his property from flooding and to prevent further erosion, the applicant
proposes to construct an approximately 35-feet long bulkhead that will start at the corner of the
bulkhead on the south side and connect with the portion of the bulkhead under construction. The
proposed bulkhead alignment is landward of the NWL and above all Spartina alterniflora. The
applicant proposes to backfill the bulkhead and yard, which will result in the filling of
approximately 750 square feet of Coastal Wetlands. The applicant will cover the area with turf
grass after completion.

Anticipated Impact
The construction of the bulkhead and the associated backfill and adjacent fill activities will result
in 750 square feet of Coastal Wetlands vegetated with black needle rush, goldenrod, and marsh
elder being filled. The fill area is also located within the Estuarine Shoreline Area of
Environmental Concern. Approximately 1,350 square feet of Estuarine Shoreline will be
landscaped and covered by turf grass.
There may be localized water turbidity during construction of the bulkhead.

On November 12, 2003, the NC Division of Water Quality (DWQ) received your application for a 401 Water Quality
Certification for 0.0482 acre of wetland and estuarine shoreline impacts associated with the construction of a proposed
bulkhead adjacent to Roanoke Sound in Dare County. In accordance with 15A NCAC 2H .0506, a site evaluation has
been conducted by Mr. Stephen Lane of the DWQ Washington Regional Office. Based on this review, we have
determined that significant uses could be removed or degraded by this project. Insufficient evidence is provided in your
application to conclude that your project must be built as planned. Therefore, unless modifications of the proposal are
made, we will move toward denial of the 401 Certification as required in 15A NCAC 2H .0507(e). Specifically, please
investigate the following so that we may further review your application for avoidance and minimization of impacts as
required in 15A NCAC 2H .0506(b) and 15A NCAC 213 .0233:
1) Your proposed design does not meet the qualifications to issue a certification as stated in 15A NCAC 02H .0506(d)
which specifically states "that significant existing uses are not removed or degraded by a discharge to class SWL
wetlands as defined at 15A NCAC 213.0101 (d)(4)". Please contact Mr. Lane at 252-946-6481 to discuss site-
specific design alternatives which would minimize the proposed impacts to bring the work into compliance with 15A
NCAC 02H.0506(d).
Until the information requested in this letter is provided, I will request (by copy of this letter) that the Corps of Engineers
place this project on hold. Also, this project will be placed on hold for our processing due to incomplete information (15A
NCAC 2H .0507(h)).

Stephen - re your staff report recommending issuance based on a revised site proposal
discussed in the field. We'd sent the applicant a hold letter on 2/7/04 based on your
avoid/min recommendation. To date, we have no written response from the applicant or
documentation of a revised plan in this office. Did the applicant provide you
ANYTHING in the field in writing? I really can't issue a 401 when we don't have a
current site plan with specific written details of impacts and mitigation. Verbal
commitments are not enough.
We also need specifics on your mitigation recommendation: Does the final plan now
involve 160 feet of coastal wetlands impacts? Where would the suggested 2:1
mitigation occur? Did the applicant provide any planting or monitoring details?
Please call me if necessary. If the applicant hasn't provided anything in writing, do
you need me to call him? As far as we're concerned this file will remain on hold
until we get a written response coinciding with your recommendations, at which time we
