Ross Jr., Secretary MEMORANDUM TO: Local, State and Federal Review Agencies FROM: Jason D DCM - gton THRU: Jim Gregson -Lpf - DCM - Wilmington RE: William Robert Cherry, Jr. CAMA Major Permit Application Amendment DATE: December 3, 2003 On December 2, 2003, the Division of Coastal Management's Wilmington Regional Office amended the Field Investigation Report prepared for the William Robert Cherry, Jr., property located at 427 Beach Road South, on Figure Eight Island, in Wilmington, New Hanover County. The original Field Investigation Report (FIR) was prepared and routed to the applicable review agencies on October 28, 2003. The appropriate changes to the FIR have been documented and are included in the new Field Investigation Report dated December 3, 2003. The following list identifies the appropriate modifications: Section (A) under number 7 (Habitat Description) on the Field Investigation Report references approximately 7,200 sq. ft. (0.165 acres) of impacted/filled vegetated wetlands/type "404". The new FIR indicates that the actual impacted/filled area of "404" type wetlands is approximately 255 sq. ft. (0.005 acres). Section (C) under number 7 (Habitat Description) on the Field Investigation Report refers to approximately 11,125 sq. ft. of other uplands disturbance. The actual area of other uplands disturbance is approximately_ 10,191 sq. ft. The total area disturbed, as indicated in Section (D), of the Field Investigation Report, is approximately 20,660 sq. ft. PROJECT DESCRIPTION The applicant's property is located 427 Beach Road North, on Figure Eight Island, in Wilmington, New Hanover County. The property is located adjacent to Banks Channel, which is located on the eastern side of Middle Sound. Directions to the site are as follows: Going north from Wilmington along US Hwy J 7, take a Right at the Intersection of Hwy 17 and Porters Neck Road. Travel approximately 1.0 mile and bear off to the Right on Edgewater Club Road. Continue on Edgewater Club road and cross over the Figure Eight Island bridge: Take Beach Road North and the property will be located on the left hand side approximately 2.0 miles. The property located at 427 Beach Road North is zoned for residential development. The property survey shows a single-family-residential lot measuring approximately 226' deep and approximately 94' wide with two small wetland fingers ("404" type) encroaching into the high ground areas on both sides of the lot, along the mid section of the property. The applicant has already received a Corps of Engineers Nationwide 18 for the project (ID # 200300273). A DWQ Stormwater application has been requested at this time (SW030712). A survey of the property shows the elevation to be approximately 7' above normal high water on the upland side. The upland section of the lot is relatively flat with a gentle upward slope towards the east, or towards Beach Road North. The upland vegetation primarily consists of Wax Myrtles, Red Cedars and Live Oaks. The northern and southern central sections of the lot consists of 404 wetlands ranging in width from approximately 10' on the southern portion of the lot to approximately 20' in width on the northern portion. The vegetation within the 404 wetlands consists of marsh elder (Iva frutescens), wax myrtle (Myrica cerifera), marsh pennywort (Hydrocotyle umbellata), poison ivy (Toxicodendron radicans), willow (Alopercurus carolinianus) and groundsel (Baccharis hamilifolia) The remainder of the lot is coastal marsh consisting mostly of smooth cordgrass (Spartina altenzflora) transitioning to black needle rush (Juncus roemerianus) then to salt meadow grass (Spartina patens) along the upland section of the coastal marsh. The coastal marsh delineation on the survey plat was not done by a Division of Coastal Management field representative and therefore is not a valid line. The Division of Water Quality has designated a Stormwater Permit # (SW8030712), however, a permit has not yet been issued. The waters adjacent to the project site are classified as SA-ORW by the Division of Water Quality. The area is a designated Primary Nursery Area by the Division of Marine Fisheries and is open to the taking of shellfish as a conditional shellfish harvesting area. PROPOSED PROJECT: The applicant is proposing to fill 255 sq. ft. of Section "404 type" wetlands for upland development. The applicant is also proposing the construction of a retaining wall around the house (approximately 377') to retain the fill used to grade and level the lot. The project is located within the Estuarine Shoreline, which is one of the Division of Coastal Management's Areas of Environmental Concern (AEC). The proposed work requires a CAMA major permit due to the filling of "404 type" wetlands within this AEC. All work proposed is located outside of the 30' buffer, but within the 575' Estuarine Shoreline ORW AEC. The applicant is proposing to construct a private two-story residence with a footprint of approximately 62' X 59' in size. The proposed driveway for the residence is to be 24' at its widest point and approximately 110' in length. -_ The proposed retaining wall bulkhead would have 8' sections of 6" X 6" posts with 4' above the ground surface. The total built upon area of the lot within the AEC equal 24% or 5,665 square feet. 10. ANTICIPATED EVIPACTS The proposed project will result in the filling of 255 sq ft (0.005 acres) of Section "404 type" wetlands and the entire disturbed area would be approximately 10,446 sq ft including the retaining wall, wetlands fill, house construction, driveway and subsequent landscaping.
