Approval of 401 Water Quality Certification and Authorization Certificate per the Neuse River
Buffer Protection Rules (15A NCAC 2B .0233) with Additional Conditions
You have our approval, in accordance with the attached conditions and those listed below, to place fill
within or otherwise impact 0.498 acres of wetlands, 108 feet of,streams and 10,696 square feet (ft) of
protected riparian buffers for the purpose of constructing a road crossing at the subject property, as
described within your application dated October 29, 2003 and received by the N.C. Division of Water
Quality (DWQ) on October 29, 2003 and receipt of additional information on July 29, 2004. After
reviewing your application, we have decided that the impacts are covered by General Water Quality
Certification Number(s) 3402 (GC3402). The Certification(s) allows you to use Nationwide Permit(s) 39
when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved
Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233. In
addition, you should obtain or otherwise comply with any other required federal, state or local permits
before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-
and discharge regulations. Also, this approval to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA
Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H.0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

The Additional Conditions of the Certification are:
1. Impacts Approved
The following impacts are hereby approved as long as all of the other specific and general
conditions of this Certification (or Isolated Wetland Permit) are met. No other impacts are
approved including incidental impacts:

2. Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the,project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and DesignManual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor-owned or leased borrow pits associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond
the footprint of the impacts depicted in the Pre-Construction Notification. All construction
activities, including the design, installation, operation, and maintenance of sediment and erosion
control Best Management Practices, shall be performed so that no violations of state water quality
standards, statutes, or rules occur.
4. No Sediment & Erosion Control Measures w/n Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum
extent practicable. If placement of sediment and erosion control devices in wetlands and waters
is unavoidable, they shall be removed and the natural grade restored within six months of the date
that the Division of Land Resources has released the project.

5. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality,
1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or
stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of
the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved
buffer impacts) shall be referred in writing to the Director for &, decision. The Director's decision is
subject to review as provided in Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act and the Neuse riparian buffer protection rule as described within 15A NCAC 2B .0233. If you have

This letter is in response to your letter dated January 20, 2004 (copy attached), which requested additional
information for the proposed Battleridge Subdivision. The following restates your request as shown on
your letter and then provides our response.
1. Please show all stream impacts inchiding all fill slopes, dissipaters, and bank stabilization on the
site plan. Provide information concerning the stream feature depicted at the Northeast corner of
the site plan tit•ith respect to where the Raleigh Regional office has determined the stream begins
("NBR Flag 01').
The attached impact maps depict all proposed impacts within the proposed road crossing. The edge of
the proposed fill has been labeled and the edge of pavement is shown with darkened lines. Please find
the attached copy of the Neuse Buffer letter written by Mr. Steve Mitchell (DWQ-Raleigh Regional
Office) on February 28, 2002. On the backside of Mr. Mitchell's letter is a copy of the delineation
map, which depicts the location of the starting point for the buffered feature. This "start point" is
approximately 60-70' inside the delineated USACE approved wetland line. No impacts are proposed
in this area or with the buffers on this feature.
2. Please provide cross section details showing the provisions for aquatic life passage for the road
crossing.
Please find the attached cross sectional sketch of the proposed crossing provided by the project
engineer. The drawing shows the 42" culvert buried as per regulations "equal to or greater than 20%,"
which in this case is 9 inches to allow for aquatic life passage.
3. Please locate any planned setrer lines on the site.
All proposed sewer lines are shown on the attached map. An existing previously permitted sewer
crossing occurs downstream of the proposed road crossing and is labeled "Existing Sewer Line."
Another utility line is present upstream of the proposed road crossing and has been in place prior to the
Clean Water Act. There are no new proposed sewer line impacts to wetlands, streams, or buffers.

4. Please indicate all stormwater outfalls on the site plan.
All stormwater outfalls are shown on the attached impact map. Level spreaders are planned and shown
at the outlets.
5. Please indicate the disseflow provision measures on the site plait.
Please see the attached site plan which depicts the location of the planned level spreaders. The level
spreader devices will insure that the diffuse flow requirements are met.

your plan to fill wetlands or waters for the purpose of constructing a subdivision in Wake County. Approval from DWQ is
required to disturb these areas. Please provide 7 copies of the following information and refer to the DWQ # listed above in
your reply. Please show these on maps of suitable scale (for instance 1" = 100 feet) so we can begin to determine your
projects' compliance with 15A NCAC 2H .0500.

1. Permittee shall locate all wetland boundaries and identify them on site with the
installation of temporary fencing (e.g., orange webbed tree-protection fencing).
Markings on the boundary fencing (or attached flags) shall identify the demarcated area
as a wetland. Demarcation of wetland areas shall be accomplished prior to initiation of
any impacts to jurisdictional areas (fill, mechanized landclearing, culvert installation,
etc.) authorized by this permit. The fencing shall remain in place throughout the duration
of all construction activities associated with the project. The Corps of Engineers
regulatory project manager shall be contacted at least two weeks prior to removal of
wetland boundary fencing.
2. Permittee shall cause to be recorded in the Register of Deeds for Wake County a plat,
showing the subdivision plan for the property, and a survey of the boundary of the
jurisdictional waters of the United States, as approved by the Corps of Engineers, within

Dear Mr. Clark:
I have reviewed the maps that you have submitted for the project referenced by the Raleigh Regional Office
as NBRRO-02-041. An evaluation of the stream features was performed on February 5, 2002 to determine
whether the site would require compliance with the Neuse Buffer Rule.
The features represented on the Wake County Soils and the USGS topographic maps were evaluated
to determine their subjectivity to the Neuse Buffer Rule. It was determined that there are two features
represented that are is subject to the Neuse River Basin-Nutrient Sensitive Waters Management Strategy:
Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC
0233). Feature A is subject from NBR Flag 01 and feature B is subject through the property.
This letter addresses only those issues involving the riparian area. For information relative to the Wetlands
401/404 issues, please contact Mr. John Dorney at 919-733-1786. Thank you for your attention to this matter

This letter is in response to your letter dated December 17, 2003 (copy attached), which requested
additional information for the proposed Battleridge Subdivision. The following restates your request as
shown on your letter and then provides our response.
1. Have the USArnry Corps of Engineers determined this project to be a .separate and complete
project from Chastain Subdivision (D IVQ Projcct AV 02-1049)? If not and Ihe'v hate determined
it to be part of Chastain Subcliti•ision, them the amount of lcetland impacts it-ill exceed the
mitigation threshold of one (1) acre and the Dli'Q still require mitigation: for all past and
proposal sretlancl impacts (if approved).
The US Anny Corps of Engineers (USACE) has detenmined the proposed Battleridge Subdivision to be
a separate and complete project from the Chastain Subdivision because the two subdivisions are
currently under separate ownership; the two subdivisions will not share road access, etc. The USACE
has issued the 404 permit for this project (see attached) as separate from the Chastain Subdivision. I do
not have a written determination from the USACE that states that the two projects are separate so if you
need to verify this with the USACE please call Ms. Jennifer Burdette at 876-8441 (ext 22). Because
the two projects are separate and because the proposed impacts for Battleridge are less than those
requiring mitigation, no mitigation is proposed.

To Whom It May Concern:
On October 29, 2003, the Division of Water Quality (DWQ) received your application dated October 29, 2003
to impact 0.4977 acres of wetlands, 108 feet of stream and 10,696 square feet (ft2) of protected riparian buffers
to construct the proposed residential subdivision. The DWQ has determined that your application was
incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional

On behalf of Mr. Jerry Gower, (property owner), we hereby request authorization from
the US Army Corps of Engineers to utilize Nationwide Permit 39 for proposed permanent
impacts to a perennial stream channel and an adjacent wetland resulting from the
construction of a proposed road crossing to service the Battleridge North Subdivision.
We also request written concurrence from the NC Division of Water Quality (NCDWQ)
that the project meets the 401 Water Quality Certification for the requested NWPs and
complies with the Neuse River Basin (NRB) Buffer Rules. A Pre-construction
Notification Application (PCN) is attached and an Agent Authorization Form.
The wetland delineation for the site was approved on January 31, 2001 (Action ID
#200120236). S&EC did not do the associated fieldwork for this project. A previous
permit was issued on March 13, 2002 for the construction of a sewer lisle to service the
Chastain Subdivision adjacent to the property. According to a file search of the USACE
records no other 404 permits exist on the Battleridge North Subdivision site.
The proposed road crossing is required to access the southern portion of the property. A
stream channel that flows east to west bisects the property. Due to the shape and
orientation of wetlands along the stream channel, access to the southern portion of the
property will result in wetland/stream impacts. However, to minimize these impacts, the
proposed road corridor will cross the wetland at a perpendicular angle and at one of the
narrowest points of the wetland area. The flow of the channel does not run perfectly

parallel with the wetland boundary lines and therefore the stream channel impact angle is
not perpendicular. If the channel were crossed at a perpendicular angle in an effort to
decrease' impacts to the channel length and the buffers, a greater amount of wetland
impact would be required because the wetlands would not be crossed at a perpendicular
angle. Permanent impacts to wetlands will total 0.4977 acres and permanent impacts to
stream channels will total 108 linear feet. Proposed buffer impacts due to the road
crossing total 10,696 ftZ (0.2456 acre). The proposed road crossing will comply with the
general conditions of Nationwide Permit 39.
The NC DWQ does not require stream mitigation for permanent perennial stream impacts
that total less than 150 linear feet per project. DWQ also does not require mitigation for
wetland impacts that total less than 1 acre per project or for buffer impacts that are less
than 1/3 acre per road crossing. The USACE may require stream mitigation for impacts
to important streams or for impacts to wetlands that exceed 1/10 acre, however because
impacts have been avoided to the maximum extent practicable and because the majority
of the jurisdictional areas onsite are not being disturbed, no mitigation is proposed.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

at the time of this application: The site is has been timbered within the last 3 years and the
surrounding area in the vicinity of the project consists of mixed land use primarily
residential developments.

overall proiect consists of the construction of houses and town homes and their required
utilities (i.e. access roads etc.), which will tie into existing roads to the north. Heavy
equipment associated with road construction will be utilized on the site.
11. Explain the purpose of the proposed work: The purpose of the proposed work is to provide
residential housing for the area. The purpose of the road crossing is to connect the two
portions of the proiect otherwise bisected by the buffered stream and adjacent wetland.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules.
The wetlands on site were approved in 2000 (Action ID 4200021450). The original delineation
was done on a larger tract which was divided into two smaller tracts. The other portion of the
original tract was sold to Colony Homes and is part of the Chastain Subdivision. Action ID #
20022320 and Action ID #20022321 refer to Nationwide Permits 39 and 14 respectively that
were issued for the Chastain Subdivision. Action ID #200120236 refers to a Nationwide Permit
12 issued for a sewer crossing on the Battleridge North property that allowed the temporary
impact of 0.1446 acre of wetland.
Mr. Steve Mitchell of the NC-DWQ confirmed buffered channels on the property, which are
reflected on the attached site plan. A copy of Mr. Mitchell's letter is attached (NBRRO# 02-
041).
V. Future Project Plans

VI. Proposed Impacts to Waters of the United States/Waters of the State

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The proposed townhome site is approximately 96.5 acres in size. Due to the size and shape
of the property, some impacts were unavoidable Lot fill has been avoided in the stream and
adjacent wetlands that bisect the remaining property. In order to access the area south of the
wetland the applicant must tie into an existing road located at the northern property boundary.
Given the location of the existing road north of the site and the east-west orientation of the
stream/wetland area, the impacts could not be avoided entirely. In addition, currently approved
BMP's will be used during construction
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of

aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http:/ih2o.enr.state.nc.us/ncwetlands/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.

payment to NCWRP.
NC-DWG's current policy does not require wetland mitigation for impacts below 1.0 acre
and perennial stream channel impacts less than 150 linear feet per project Because wetland
impacts are less than 1.0 acre and stream channel impacts are less than 150 linear feet we do
not believe that compensatory mitigation should be required by the NC-DWQ

I have reviewed the maps that you have submitted for the project referenced by the Raleigh Regional Office
as NBRRO-02-041. An evaluation of the stream features was performed on February 5, 2002 to determine
whether the site would require compliance with the Neuse Buffer Rule.
The features represented on the Wake County Soils and the USGS topographic maps were evaluated
to determine their subjectivity to the Neuse Buffer Rule. It was determined that there are two features
represented that are is subject to the Neuse River Basin-Nutrient Sensitive Waters Management Strategy:
Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC
0233). Feature A is subject from NBR Flag 01 and feature B is subject through the property.
This letter addresses only those issues involving the riparian area. For information relative to the Wetlands
