After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number(s) 3402 and 3374 (GC3402 and GC3374). The Certification(s) allows you to use Nationwide Permit(s) 39 and 12 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts-to the protected riparian buffers per 15A NCAC 213 .0233. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and Non-discharge regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. Impacts Approved - The following impacts are hereby approved as long as all of the other specific and general conditions of this Certification are met. Buffer Mitigation (El EP) - You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to compensate for impacts to the protected riparian buffers is 21,714 square feet as required under this Authorization Certificate and 15A NCAC 2B .0242(buffer mitigation rule). We understand that Ou wish to make a payment into the Riparian Buffer Restoration Fund administered by the R6 Ecosystem Enhancement Program (EEP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. In accordance with 15A NCAC 2B .0242(7)(buffer mitigation rule), this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0233 (10) (buffer protection rule). Until the EEP receives and clears your check (made payable to: DENR - Ecosystem Enhancement Program Office), no impacts specified in this Authorization Certificate shall occur. The EEP should be contacted at (919) 733-5208 if you have any questions concerning payment into the Riparian Buffer Restoration Fund. You have one month from the date of this approval to make this payment. For accounting purposes, this Authorization Certificate authorizes payment into the Riparian Buffer Restoration Fund to compensate for 21,714 ft2 of required riparian buffer mitigation for impacts to 8,874 ft2 of protected riparian buffers; 03-04-02 river and subbasin, 27-35 stream index number." 3. Diffuse Flow (Review) - All constructed stormwater conveyance outlets shall be directed and maintained to flow in a diffuse manner at non-erosive velocities through the entire protected stream buffers without re-concentrating. If this is not possible it may be necessary to provide stormwater facilities that are considered to remove nitrogen. Additionally, a stormwater management plan for this project shall be provided to this Office before any of the impacts approved herein are conducted. The plan shall specify all stormwater discharge points, plan details, and calculations to indicate that diffuse flow through the protected buffers or nitrogen removal as described above will be achieved. 4. Deed Notifications - Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification R & D Development, LLC / Rutledge Landing Subdivision / DWQ Project No. 03-1338 Page 3 of 4 August 17, 2004 Approval and Authorization Certificate. A sample deed notification can be downloaded from the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands. The text of the sample deed notification may be modified as appropriate to suit to this project. - 5. Erosion & Sediment Control Practices - Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. 6. No Waste, Spoil, Solids, or Fill of Any Kind - No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond, the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 7. No Sediment & Erosion Control Measures w/n Wetlands or Waters - Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 8. Certificate of Completion - Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon expiration of the 404 Permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative R & D Development, LLC / Rutledge Landing Subdivision / DWQ Project No. 03-1338 Page 4 of 4 August 17, 2004 Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The impacts to the tributary previously not shown are according to the project engineer, required in order to meet the local municipality requirements IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. A Neuse Buffer determination was made by Mr. Steve Mitchell from the NC-DWQ on March 18, 2000 pertaining to features occurring on the property. The determination concluded that one pond an intermittent channel located below the pond, Poplar Creek, and an unnamed tributary to Poplar Creek are subiect to the Neuse Basin Buffers (NBRRO 00-049). A copy Mr. Mitchell's letter is attached Based on information provided by McIntyre & Associates, S&EC submitted a permit application for a road crossing and sewer line crossingL(NWP 12 & 14) on February 13, 2003 On July 17 2003, 401-certification was received (DWQ Project #03-0165) for the above referenced impacts but a 404 permit was not received. Ms. Andrea Wade of the USACE requested a site visit to evaluate the proposed impact area During this site meeting it was determined that a tributary existed that had not previously been shown draining into the perennial Page 3 of 9 stream with proposed impacts. This tributary has since been delineated and surveyed by another consultant and is now shown on the attached impact maps. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. Based on the information provided to S&EC, no future permits should be required for this VI. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Impacts 1 and 2 result from the installation of a required road that currently stubs south of the perennial tributary to Poplar Creek. This road's location is fixed due to the existing stub and can not be moved closer to the property line because regulations will not allow flood waters during extreme conditions to be backed up on adjacent properties. The impacts that result from Impacts 3 and 4 are due to perpendicular road crossings. The latest revision of this area has moved the proposed road corridor as much as possible to prevent additional stream and buffer impacts. In doing this the developer has lost eleven previously planned lots and as a result has suffered a significant financial lose. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. The May 5, 2004 letter from MEC, Inc. was sent to the RRO for their review. As stated in the original submittal, S&EC did not conduct the original field work associated with the wetlands and stream delineation on-site and likewise did not conduct the site meeting with RRO staff to determine the buffer locations. We were however provided with a letter from Mr. Steve Mitchell of the RRO that discussed the buffer determination on the site (see attached copy) and was attached to a site map. Mr. Mitchell's March 28, 2000 letter states that " It was determined that there is a named creek (Poplar Creek), an unnamed tributary and a pond represented on the maps that are present on the ground and therefore subject to the Neuse River Basin ..." It also states that "It was determined that the feature that emanates from the pond becomes an intermittent stream and therefore subject to the Neuse River Basin..." This letter in combination with the map that it refers to indicates that the feature in question was in fact reviewed by the RRO and was determined to be lacking characteristics required of buffered streams. The site plan was developed to avoid and minimize impacts to the buffered features outlined in the March 28, 2000 buffer letter. The previous consultant did not determine the feature with proposed impacts exceeding 400 linear feet to be jurisdictional. At the time of the March 8, 2000 site meeting this feature may not have had the characteristics required of a buffered stream and may have become more defined due to offsite stormwater from the adjacent residential neighborhood. According to 15A NCAC 213.0233 section 3a, "Upon request, the Division or delegated local authority shall make on-site determinations. Any disputes over on-site determinations shall be referred to the Director in writing." According to the March 28, 2000 letter the on-site determination was made. S&EC is not aware of any written disputes requesting that the feature be reevaluated for subjectivity to the Neuse Buffers. The revised permit submittal showing the drainage feature as jurisdictional was submitted on October 29, 2004 and was reviewed by DWQ staff. A letter dated January 22, 2004 was received from DWQ, which requested additional information. This previous letter made no reference to the feature being determined subject to the buffers. In a meeting with Mr. Mitchell after receiving the January 22, 2004 it was determined that if lots were reconfigured so as to show avoidance of impacts during home construction, the 401-permit could be obtained. The site planner made the necessary revisions, which resulted in the loss of lots in good faith that the permit could be obtained. Given the existing road stub and constraints with curving the road crossing over the perennial stream, redesigning the road so as to entirely avoid the previously determined unbuffered stream is not feasible. We feel that the determination that an additional feature now be buffered four years after a letter from the RRO says that it is not is arbitrary and contrary to the regulations. We respectfully request that the permit be granted as per the revised lot layouts previously provided to your office. After discussing the project with Mr. Steve Mitchell (DWQ- Raleigh Regional Office) and Mr. Mac McIntyre (Project Engineer) the proposed impacts to an intermittent unbuffered stream channel have been reduced. Mr. McIntyre agreed to reconfigure his lot layout within the vicinity of the stream channel in an effort to avoid any unnecessary impacts to the channel. The lot line separating lots 298 and 299 was redrawn to follow the drainage of the stream channel in order to avoid any impacts to the stream channel. Also, the lots along Road "A" were reconfigured to decrease impacts to the stream channel by avoiding driveway crossings. The lot reconfiguration resulted in the loss of two previously planned lots. The resulting revised plans show a more realistic depiction of a lot layout that can avoid impacts where impacts are not planned. The impacts to the tributary previously not shown are according to the protect engineer, required in order to meet the local municipality reauirements. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. S&EC personnel did not conduct the fieldwork for the project and was not provided with a USACE approved delineation map therefore no Action ID #'s are known for this property. A Neuse Buffer determination was made by Mr. Steve Mitchell from the NC-DWQ on March 18, 2000 pertaining to features occurring on the property. The detennination concluded that one pond, an intermittent channel located below the pond Poplar Creek and an unnamed tributary to Poplar Creek are subject to the Neuse Basin Buffers (NBRRO 00-049). A copy Mr. Mitchell's letter is attached Based on information provided by McIntyre & Associates, S&EC submitted a permit application for a road crossing and sewer line crossing; (NWP 12 & 14) on February 13, 2003 On July 17 2003, 401-certification was received (DWQ Project #03-0165) for the above referenced impacts but a 404 pen-nit was not received. Ms. Andrea Wade of the USACE requested a site visit to evaluate the proposed impact area. During this site meeting it was determined that a tributary existed that had not previously been shown draining into the perennial Page 3 of 9 stream with proposed impacts. This tributary has since been delineated and surveyed by another consultant and is now shown on the attached impact maps. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. Based on the information provided to S&EC, no future permits should be required for this project. VI. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. S&EC personnel did not conduct the fieldwork for the project and was not provided with a USACE approved delineation map, therefore, no Action ID #'s are known for this property. A Neuse Basin Riparian Buffer determination was made by Mr. Steve Mitchell from the NC-DWQ on March 18, 2000 pertaining to features occurring .on the property. The determination concluded that one pond, an intermittent channel located below the pond, Poplar Creek, and an unnamed tributary to Poplar Creek are subject to the Neuse Basin Buffers (NBRRO 00-049). A copy Mr. Mitchell's letter is attached. Based on information provided by McIntyre & Associates, S&EC submitted a permit application for a road crossing and sewer line crossing (NWP 12 & 14) on February 13, 2003. On July 17, 2003, 401-certification was received (DWQ Project #03-0165) for the above referenced impacts, but a 404 permit was not received. Ms. Andrea Wade of the USACE requested a site visit to evaluate the proposed impact area. During this site meeting it was determined that a tributary existed that had not previously been shown draining into the perennial stream with proposed impacts. This tributary has since been delineated and surveyed by another consultant and is now shown on the attached impact maps. We understand that the 401-certification is not valid without the 404 permit and that the 401 was not valid for the previously undelineated tributary and wetland. This application attempts to quantify all of the known impact areas and request permits :for those areas. The previous permit application requested approval for 65 linear feet of perennial stream impacts related to a road crossing and 22 linear feet of perennial stream impacts related to a sewer line crossing. Buffer impacts for these impacts were approved. The information included in this permit application was provided to our office by McIntyre and Associates for the purpose of submitting a permit application. The proposed project is a single-family residential development that consists of the construction of roads required to provide access to the northern portion of the property from the existing southern section of the property (Impacts 1, IA, and 4) and an adjoining property to the north of the property (Impact 5). Lot fill is required in order to maximize buildable space (impact6). Two residential driveway crossings are required in order to access two lots that do not otherwise have access (Impacts 2 and 3). The proposed road crossings will impact 65.1 linear feet of perennial channel and 351.8 linear feet of unimportant/intermittent channel. Wetland impacts resulting from road construction will total 0.059 asp. Wetland impacts due to proposed lot fill will total 0. 2 cre. Describe the overall project in detail, including the type of equipment to be used: The project is a single-family residential development with associated utilities (i.e. roads, water lines sewer lines etc) Equipment used for the construction of the property will consist of heavy machinery typically utilized for such work 11. Explain the purpose of the proposed work: The proposed subdivision will provide additional housing for the area The proposed roads are needed to provide access to the property and to connect all portions of the site The impacts to the tributary previously not shown are according to the project engineer, required in order to meet the local municipality requirements IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. S&EC personnel did not conduct the fieldwork for the project and was not provided with a USACE approved delineation map therefore no Action ID #'s are known for this property. A Neuse Buffer determination was made by Mr. Steve Mitchell from the NC-DWQ on March 18, 2000 pertaining to features occurring on the property. The detennination concluded that one pond an intermittent channel located below the pond Poplar Creek and an unnamed tributary to Poplar Creek are subject to the Neuse Basin Buffers (NBRRO 00-049). A copy Mr. Mitchell's letter is attached Based on information provided by McIntyre & Associates S&EC submitted a permit application for a road crossing and sewer line crossing (NWP 12 & 14) on February 13, 2003 On July 17 2003, 401-certification was received (DWQ Project #03-0165) for the above referenced impacts but a 404 permit was not received. Ms. Andrea Wade of the USACE requested a site visit to evaluate the proposed impact area During this site meeting it was determined that a tributary existed that had not previously been shown draining into the perennial Page 3 of 9 stream with proposed impacts. This tributary has since been delineated and surveyed by another consultant and is now shown on the attached impact maps V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. Based on the information provided to S&EC no future permits should be required for this project. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. Wetland impacts total less than 1/10 of an acre The proposed impacts are required in order to connect the northern portion of the property to the southern portion and to an existing development to the north. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete.
