The site contains wooded land, timbered land, and fields. Residential development is located within the vicinity of the site.

The purpose of the proposed project is to construct a single-family residential subdivision (Carraway Subdivision).
3e. Describe the overall project in detail, including the type of equipment to be used:
The Carraway Subdivision includes the construction of 30 residential lots, associated access roads, landscaped areas,
on -site septic, and appropriate stormwater devices. In order to provide access from the west, it is necessary to grade and
fill the most up -gradient portion of a stream and two small wetland pockets. Additionally, in order to install a septic -
system supply line, a segment of stream on the northern portion of the site will be temporarily impacted. To facilitate the
construction of the access road, septic supply line, and development of the site, clearing and grading the -site is
necessary. Graders, haulers, excavators, and other heavy equipment will be used during the grading and construction of
the site.

The access road (designated as Wolfshiem Place) will permanently impact 42.8'linear feet of stream from fill and grading
activities. Additionally, 21.8 linear feet of stream channel will be temporarily impacted by excavating the stream in order to
install a septic supply line beneath. A cofferdam will be installed immediately upstream of the crossing and then removed
following septic line installation. The stream will be restored to similar pre -construction conditions following installation of the
sewer line.

D. Impact Justification and Mitigation
1. Avoidance and Minimization

The applicant has redesigned the proposed access road (designated as.Wolfshiem Place) and shifted it further to the
south to minimize stream and wetland impacts. The applicant has further demonstrated avoidance and minimization of
stream impacts by designing the access road to only impact the upper most reaches of the stream and wetlands. The
remainder of the streams and wetlands are being avoided, with the exception of 21.8 linear feet of temporary stream
impact further downstream.
b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The clearing limits of the proposed development will be staked and silt fences will be used. Appropriate stream bank
protection will be provided in the channel during construction and all excess excavated material will be immediately
removed from crossing areas. The septic supply line will be backfilled with native stream bed material and graded to
similar pre -construction conditions. A temporary cofferdam will be installed upgradient of the septic supply line crossing
and then will be removed following construction activities. Following construction, all disturbed banks will be restored to
similar pre -construction conditions, matted and seeded/live staked.

We consulted the USFWS Website to determine if federally protected endangered or threatened species inhabit Guilford
County, NC. The cape fear shiner (Notropis mekistocholas) and Roanoke logperch (Percinia rex) are listed as federally
protected endangered species. The streams on the site are small and .do not provide suitable fish habitat. Fish will not
be directly impacted by the proposed project. Additionally, Schweinitz's sunflower (Helianthus schweinitzi►) is listed as
federally endangered and small whorled pogonia (lsotria medeoloides) is listed as federally threatened. The site does not
contain suitable habitat for either of these species, so therefore the proposed project will not directly impact these
species. Based on our observations, it is our opinion that the proposed project will have no effect on federally listed
species.

the project area. The map does not identify any other eligible for listing properties at the site or on nearby properties. A
copy of the map is included as an attachment (Drawing 6).

On -Site Determination for Applicability to the Mitigation Rules (15A NCAC 2H .0500)
Dear Mr. Brame:
On July 6, 2016, at your request and in your attendance, Sue Homewood conducted an on -site
determination to review features located on the subject project for stream determinations with
regards to the above noted state regulations.
The Division acknowledges the areas and boundaries identified as jurisdictional wetlands by the
USACE. The attached map accurately depicts all stream determinations conducted during the
site visit.
Please note that at the time of this letter, all perennial stream channels and jurisdictional
wetlands found on the property are subject to the mitigation rules cited above. These
regulations are subject to change in the future.
The owner (or future owners) should notify the Division (and other relevant agencies) of this
decision in any future correspondences concerning this property. This on -site determination
shall expire five (5) years from the date of this letter.

Landowners or affected parties that dispute a determination made by the Division or Delegated
Local Authority that a surface water exists and that it is subject to the buffer rule may request a
determination by the Director. A request for a determination by the Director shall be referred to
the Director in writing c/o Wetlands and Buffers Permitting and Compliance Unit, 1650 Mail
Service Center, Raleigh, NC 27699-1650. Individuals that dispute a determination by the Division
or Delegated Local Authority that "exempts" surface water from the buffer rule may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter.
Applicants are hereby notified that the 60-day statutory appeal time does not start until the
affected party (including downstream and adjacent landowners) is notified of this decision. The
Division recommends that the applicant conduct this notification in order to be certain that third
party appeals are made in a timely manner. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This determination is final and
binding unless you ask for a hearing within 60 days.
This letter only addresses the applicability to the mitigation rules and the buffer rules and does
not approve any activity within Waters of the United States or Waters of the State or their
