After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3376, which may be viewed on our website at http://h2o.enr.state.nc.us/ncwetlands. This certification allows you to use Nationwide Permit Number 3 when the Corps of Engineers issues it. This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 02B .0233. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. ?ciaEr?:?t N. C. (b) The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. 2) No waste, spoil, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notice application. All construction activities, including the design, installation, operation'," and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur; 3) Sediment and erosion control devices shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, compliance with Water Quality Certification regulations must be achieved prior to their installation and they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project; 4) Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required. to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. Explain the purpose of the proposed work: The purpose of the proposed work is to rehabilitate the existing dam to assure the safety and welfare of citizens and property downstream of the pond. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. This is the first application applied for by the Town of Holly Springs for this project. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. The Applicant does not anticipate any additional permit request for this site. V. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. All proposed impacts, permanent and temporary, must be listed herein, and must be clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a delineation map, whether or not impacts are proposed to these systems. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The impacts that are proposed in this application are being dictated by Dam Safety requirements. Furthermore, the rehabilitation will be done to assure the safety and welfare of citizens and property downstream of the pond. VII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration Page 9 of 12 in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. The Owner does not propose mitigation for the proposed impacts. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. In addition, the permittee and subsequent property owners shall take no action, whether on or off the mitigation property, which will adversely impact the stream habitat on the mitigation property. 4. Condition 5, above, runs with the land. The permittee shall not sell, lease, or otherwise convey any interesting the wetland mitigation property without subjecting the property to legally enforceable restrictions on the use of the property, to ensure its preservation in perpetuity, approved in writing by the Wilmington District Corps of Engineers. Permittee shall also execute and cause to be recorded in the Wake County Register of Deeds restrictive covenants on the wetland mitigation property, as depicted on an approved mitigation plat, which is to be recorded prior to the restrictive covenants in their natural state in perpetuity, acceptable to the Corps of Engineers, prior to the sale or conveyance of any lots or other property within the subdivision. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions: 1. Stormwater Management An additional condition is that a final, written stormwater management plan shall be approved in writing by this Office before the impacts specified in this Certification occur per Condition No. 3 in GC No. 3362. Future Clubhouse Area - The stormwater management plan for the "Future Clubhouse Area" depicted on "Drawing Sheet EX-1, Project Number 304-01" must include plans and specifications for stormwater management facilities that are appropriate for surface waters classified as "C NSW" and designed to remove 85% TSS according to the most recent version of the NC DENR Stormwater Best Management Practices Manual. These facilities must be designed to treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water Quality. Also, before any permanent building is occupied at the subject site, the facilities (as approved by this Office) shall be constructed and operational, and the stormwater management plan (as approved by this Office) shall be implemented. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. Remainder of Windcrest Farms PUD - An additional condition is that stormwater shall be directed to flow in a diffuse manner at non-erosive velocities through the entire protected stream buffers without re-concentrating. Additionally, a stormwater management plan for this project shall be provided to this Office before any of the impacts approved herein are conducted. Deed Notifications Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate. 4. Stream Mitigation You are required to mitigate for permanent impacts to the streams. The required length of stream mitigation to compensate for impacts to the streams is 259 feet as required under GC3362 and 15A NCAC 02H .0506. We understand that you wish to make a payment into the Wetland Restoration Fund administered by the NC Wetlands Restoration Program (WRP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. This stream is carrying a significant sediment load. In general, there is good bank stability, and there is a significant natural wooded buffer along both banks. Most of the stream surface area is protected by tree canopy (>60% cover). Bank height ranges from 0.5 - 1.0 m tall, and undercutting is present in some locations. Windthrow of trees into this stream is high. Beaver activity, including dams, is present. Much of the surveyed reach has depths greater than 0.7 m. Survey Area 2. Stream F Area on map. Stream area associated with proposed sanitary sewer easement (within tributary to Middle Creek (Segment 1) and down Middle Creek (Segment 2) with a total surveyed reach of approximately 400 m). Start latitude and longitude: 35.66659 N, 78.81978 W (at beaver dam within Middle Creek - site approximately 300 m below El0 on map). Stop latitude and longitude: 35.66811 N, 78.82231 W (E8 on map - at confluence of 2 tributaries of Middle Creek tributary). The Middle Creek tributary to be crossed by the proposed sanitary sewer line is a small perennial stream with a width ranging from 0.3 - 2 m. Banks are well rooted, and substrates include a mix of consolidated and unconsolidated clay, silt, sand, gravel, and cobble. This stream is carrying a significant sediment load. In general, there is good bank stability, and there is a significant natural wooded buffer along both banks. Most of the stream surface area is protected by tree canopy (>90% cover). Bank height ranges from 0.3 - 1.0 m tall, and undercutting is present in some locations. Windthrow of trees into this stream is low. Beaver activity, including dams, is present. Most of the surveyed reach has depths less than 0.7 m. Middle Creek (below the confluence with the above tributary) is a perennial stream with a width approximately 5 m. Banks range from being well rooted to being undercut. Substrates were dominated by silt, sand, and gravel; however, some cobble is present. The riparian corridor is woodland (significant recent harvesting) except for the sewer line corridor, which is grassed. Banks range from 1 to 2+ m tall. There is a very heavy sediment load within Middle Creek, and bars are common. Beaver activity is present. Methods Where necessary, visual (often with viewscope) and tactile survey methods were employed to complete timed surveys. Mussels were identified, counted, and returned to appropriate substrates. 2 Results After walking the identified stream reaches, no in-stream surveys were necessary in survey areas 2, 3, and 4. These streams are too small to support a unionid fauna. We are close to plan approval from Dam Safety and this Application package represents the impacts necessary for the rehabilitation of the existing dam on the site. This Application illustrates the remainder of impacts proposed for the project. However, the Town of Holly Springs may apply for a permit to place a fishing pier and a greenway / hiking trail in the vicinity of the pond at some future date. Again, the Owner does not intend to build these items but wishes to show that a future permit request may be submitted by the Town. This future plan (EX-2 "Welland Creation and Future Greenway, Boardwalk and Fishing Pier') was included for your reference in the second PCN Application dated November 12, 2002. The first Application for this project addressed impacts required for the installation of the off-site sanitary sewer, on-site sanitary sewer required to serve Phase 1 of the project and a temporary access road to allow construction traffic ingress and egress from the site to install the sanitary sewer. The second Application for this project represented permanent and temporary impacts to wetlands, streams and Neuse Buffers resulting from lot and road grading and sanitary sewer installation. These applications represented the necessary infrastructure to support the residential portions of the subdivision. Attached are copies of all approved permits from the USACE and NCDWQ for the first and second applications and acceptance of payment for mitigation purposes from NC WRP. Additionally you will find a signed Operations and Maintenance Agreement for the bio-retention area and level spreaders on the site. The attached plan labeled sheet EX-5 "Site Plan " shows the different phases of the project along with the location of the existing pond in the southeast corner of the property. Please refer to attached sheet labeled EX-6 "ietlands, Neuse Buffer and Open Dater Impact Map " that identifies impacts required for rehabilitating the existing dam. Other permitted impacts for this project are not graphically indicated on this sheet but are accounted for in tabular form on a separate sheet attached to this letter. The proposed impacts for dam rehabilitation are a direct result of Dam Safety requirements. As stated in the second application, this pond and much of its surrounding land will be donated to the Town of Holly Springs for use as a park. A wetland mitigation site is included in the area that will be donated to the Town. This mitigation site was also included in the second application on the sheet labeled EX-2 "Wetland Creation and Future Greenway, Boardwalk and Fishing Pier ". As such, at some future date the Town of Holly Springs Parks and Recreation Department may wish to install a greenway and a boardwalk / fishing pier to the pond. We feel that by locating the boardwalk / fishing pier through the wetland mitigation site, Town residents that use this park can be educated about wetland functions and regulations governing their use. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
