PROJECT SUMMARY: The applicants propose to fill 3,220 square feet of "404 type" wetlands to create a building pad for the construction of a single-family residence. David and Judy Wiles Page 2 9. PROJECT DESCRIPTION The project site is located at Lot 8, S.E. 67`h Street, in Turtle Creek subdivision, adjacent to the Atlantic Ocean, in the Town of Oak Island, in Brunswick County. The tract is approximately .96 acres in size, measuring 62.5 feet in width and approximately 670 feet in depth from the oceanfront. Lot 8 is located immediately adjacent to the east side of S.E. 67`h Street. The majority of the lot exists as a freshwater pond and associated "404 type" wetlands. Historically, this area was part of the upper drainage basin of Montgomery Slough and Davis Creek, extending eastward, to almost S.E. 70`h Street. This is further evidenced by the piped interconnection of several brackish waters ponds, between S.E. 59th Street and S.E. 70th Street. Currently, the drainage outlet for these ponds is a water control structure (riser drop inlet) located on the east side of S. E. 59th Street. The outlet is piped between S. E. 59th St. and S. E. 58th St., and converts to an open ditch, with culverts at each street crossing, from S.E. 58th St. to S.E. 40th St., where it empties into Davis Creek. The wetlands on the project site (Lot 8) have been delineated, and the delineation has been approved by the US Army Corps of Engineers. Vegetation on the pond banks consists of Giant Reed (Phra gmm'tes, spp) and Cat-tail (Typha spp) with shrubs; Marsh-Elder (Iva frutescens , Groundsel-Bush (Baccharis halimifolia), and Wax Myrtle (Myrica cerifera) on the adjacent wetlands and transition to highground. There is a small highground area in the northeast corner of the lot, approximately 20 feet wide, which quickly tapers to 8 feet wide along the western edge of the pond. This narrow band of highground between the pond and the road right-of-way expands to the entire width of the lot (65.5 ft.) as the property nears the ocean. This upland dune area occupies the southern forth of the lot, approximately 160 feet long and 62.5 feet wide. Vegetation in this area consists of Sea Oats, Yucca, and other dune grasses. The freshwater ponds habitat supports a varied wildlife population, including the American Alligator. There are several signs on the roadway posted by the Town, warning people not to feed the alligators. The waters of the Atlantic Ocean are classified SB, by the N.C. Division of Water Quality. The lot is within the Ocean Erodible and High Hazard Flood areas of the Ocean Hazard Area of Environmental Concern, as designated by the North Carolina Coastal Resources Commission. The Long Term Average Annual Erosion Rate is 3 ft./yr. in this area of the Town of Oak Island. The applicant is proposing to construct a single family residence on this lot. In order to do so, he is proposing to construct retaining walls into the wetland and pond areas to establish three sides of a building pad and enclose an area 70 feet long by an average of 46 feet wide (3,220 sqft.). The application proposes vertical, wooden bulkhead retaining walls constructed using 8" pilings, 8" whalers and 3" V- groove sheathing boards. The walls would be tied-back with galvanized rods to concrete anchors located inside the proposed fill area. Approximately 800 cubic yards of fill material would be imported to fill behind the new retaining walls. The applicant proposes to construct a single-family residence within the new building pad area, with a footprint of 46 feet long and 40 feet wide (1,840 sqft.). The house would be accessed from the street by a paved driveway 20 feet wide and 8.5 feet long. 10. ANTICIPATED IMPACTS The proposal would cause the loss of approximately 1,400 square feet of Section 404 wetlands (Clean Water Act) and an additional 1,820 square feet of the freshwater pond (jurisdictional Waters of the US). The application states that 180 square feet of high ground would also be graded and filled during the site preparation for construction. There would be approximately 2,010 square feet of impervious surface created by the proposed construction. Submitted by: E. F. Brooks Date: 9/10/03 Office: Wilmington Narrative CAMA Major Permit application Lot 8, Block 1-B, Turtle Creek S/D The applicant requests "404" wetland fill to construct a single-family residenlial home on Lot 8, Block 1-B of the Turtle Creek subdivision, Oak Island, NC. The-4zg =acre -`T 6 property is an ocean-front lot situated between Yaupon Drive and the Atlantic Ocean and accessed from S.E. 67'' Street. The lot is only 62.5'-wide but extends along 671' Street for nearly 670' until reaching the ocean. The lot has been platted.for more than ten years, and the majority of the lot is jurisdictional "Waters of the US". The jurisdictional area includes part of an isolated freshwater pond which is located behind the dune system of the beach. This pond is apparently a geologic relic of an estuarine area that was disconnected from the estuarine source as the island migrated. The pond spans approximately two blocks, and the very western edge of the pond is situated on this lot. The only known hydrologic outlet for the pond are suspected to be the culverts located under existing adjacent streets. There is a small upland area at the northern end of the lot, where access from 67th Street is available. A roughly 20'-width of upland at the northern property line tapers quickly-to an 8'-width along 674h Street (becoming essentially the shoulder of the road). The majority of the center of the lot is the open water of the pond. Near the ocean, at the very southern limit of the lot, some upland is present where the dune system exists. Approximately half of this upland is within CAMA's 90'-small structure setback and precludes home construction in this location. The remaining upland not in the within the structure setback is part of the natural dune/swale system. To avoid the dune system and to place development as far from the oceanfront as possible, a homesite at the northern end of the lot was preferred. In order to create a homesite at the northern end of the lot, 0.08-acres of fill within "Waters of the US" is necessary. Proposed impacts would affect the vegetated wetland fringe around the existing pond and a small area of shallow open water. Impacts have been minimized to the greatest extent practical, utilizing all available upland outside the local building setbacks.
