You have our approval, in accordance with the attached conditions and those listed below, to place fill within or
otherwise impact 0.095 acres of wetlands for the purpose of constructing the proposed Independence Drive Extension
at the subject property, as described within your application dated June 20, 2003 including additional information
received by the N.C. Division of Water Quality (DWQ) on February 20, 2004 and March 31, 2004. After reviewing your
application, we have decided that the impacts are covered by General Water Quality Certification Number(s) 3404
(GC3404). The Certification(s) allows you to use Nationwide Permit(s) 14 when issued by the US Army Corps of
Engineers (USACE). In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and Non-
discharge regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must
be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If
total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and any additional conditions listed below.
Conditions:
Erosion & Sediment Control Practices - Erosion and sediment control practices must be in full compliance with all
specifications governing the proper design, installation and operation and maintenance of such Best Management
Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must
be such that they equal, or exceed, the requirements specified in the most recent version of the North
Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites,
borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated
with the project.
2. No Waste, Spoil, Solids, or Fill of Any Kind - No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters,
or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. All

construction activities, including the design, installation, operation, and maintenance of sediment and erosion control
Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or
rules occur.
3. No Sediment & Erosion Control Measures w/n Wetlands or Waters - Sediment and erosion control measures shall
not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion
control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within
six months of the date that the Division of Land Resources has released the project.
4. Certificate of Completion - Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service
Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or
civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or
CAMA permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts),
you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for
a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

Mike did a site visit for this project, wetland seems to be a linear "ditched" area
and he has no problem with issuing the cert. I emailed the engineer and consultant
with some questions (mainly details about the culvert and proposed "plunge pools"),
with Mikes site visit evaluation and the low flows of stormwater, I and Cynthia
believe the plunge pools that they are proposing are adequate. We recommend to ISSUE

Debbie,
This email is in response to your email for additional information on
the Independence Drive Ext. Project in Rocky Mount. The culvert
crossing will involve a 42" Reinforced Concrete Pipe (RCP) with a
22-foot rip rap apron. The apron has been included in the calculation
of impacts for the project (0.095 acre). Due to the limited space
between the road and the adjacent wetlands the engineer was unable to
design a level spreader that was capable of dissipating storm water and
not impacting additional wetland areas. Therefore, a plunge pool design
was chosen to minimize impacts to wetland areas to fulfill our avoidance
and minimization requirements under Nationwide Permit No. 14. These
pools are being designed to pond water at the outlets which in turn will
act to diffuse flows. Please see the attached detail of the plunge pool
in pdf for your reference. Storm water will enter the pool slow down
and be released over the downstream side of the constructed pool and
spread (much like a level spreader). Please note the elliptical shape
of the pools to maximize spreading and that these pipes are only 15-18
inches in size and will not generate a significant amount of flow. We
believe that based on the surrounding flat topography and high ground
water this design will be the best alternative to accomplishing diffuse
flow and will likely provide aquatic habitat for amphibians.

The DWQ is in the process of reviewing this project. In trying to
prevent this project from going "on hold", I am contacting you directly
for some additional information. I assume you are planning to place a
culvert within the wetland for the road crossing, what size pipe are you
planning to use? What type of energy dissipater will be used at the
outlet of this pipe? Is this energy dissipater calculated into the
impact area? Typically, level spreaders are used for diffuse flow and
plunge pools are used at outlet structures where high flows exists (to
minimize an apron length), how will these plunge pools provide diffuse
flow at the wetlands?
If you could provide a response to this email by friday, 4/2/04, we
could speed up the review process of this project.

regarding your plan to fill waters for the purpose of constructing Independence Drive extension at Airport Park in
Nash County. Approval from DWQ is required to disturb these areas. Please provide 7 copies of the following
information and refer to the DWQ # listed above in your reply. Please show these on maps of suitable scale (for
instance 1" = 100 feet) so we can begin to determine your projects' compliance with 15A NCAC 21-1.0500.
1. Please indicate all buffer impacts on the site plan. The feature shown may appear on the Soil Survey
and as such is subject to the Tar-Pamlico Buffer Rules.
2. Please indicate the location of the protected buffers as overlays on the site plan.
3. Please indicate all stormwater outfalls on the site plan.
4. Please indicate the diffuse flow provision measures on the site plan.
Please telephone Todd St. John at 919-733-9584 if you have any questions or would require copies of our
rules or procedural materials. This project will remain on hold as incomplete in accordance with ISA NCAC 2H
.0505(c). The processing time for this application will begin when this information is received. If we do not

On behalf of our client, City of Rocky Mount - Parks and Recreation Department,
Carolina Wetland Services, Inc. (CWS) is pleased to provide this letter in response to your
request for additional information regarding the Independence Drive Extension Project in
Rocky Mount, North Carolina (DWQ Project No. 03-0768). Please find seven copies of
the requested information for your review. Based on phone conversations with Mr. Todd
St. John of your office, CWS is including a revised USGS Site Location Map and NRCS
Soil Survey Map for the project as requested (Figures 1 and 2). An "x" indicating where
the proposed crossing is located has been labeled on both of these maps. Based on these
maps, and the absence of a blue or brown line, it appears that Tar-Pamlico Riparian
Buffers will not be impacted by this project. Based on the proximity of storm water
outfalls to the adjacent wetland area the construction of level spreaders will require
additional impacts to on-site jurisdictional wetland areas. To allow for avoid and
minimization to jurisdictional wetland areas, we are proposing to design the outfalls as
plunge pools to dissipate storm water discharge velocities prior to entering the wetlands.
Seven full size copies of these plans are be submitted to your office and have been attached
to this letter. Please note that we have received a Section 404 Nationwide Permit No. 14
from the U.S. Army Corps of Engineers for this project, dated July 28, 2003. This permit
has also been attached for your review.
