The Division of Water Quality (DWQ) is required to prepare a "preliminary finding" /"finding of fact" as to whether the variance request meets the requirements of 15A NCAC 02B .0233(9)(a). The DWQ may attach conditions to a variance approval that support the purpose, spirit and intent of the riparian buffer protection program. Conditions usually include stormwater management and buffer mitigation. Additional information will be required before we can proceed with the review of your variance request. Therefore, unless additional information is provided as described below, we will have to move toward denial of your request per 15A NCAC 213 .0233 and will place this project on hold as incomplete until we receive this additional information. Additional Information Requested: 1. History of Lots & Subdivision Please provide additional information on the history of the lots and subdivision. Specifically, were the lots platted prior to July 22, 1997 (effective date of the Neuse Buffer Rule)? 2. Minor vs. Major Variances The portion of the "Map of Village Cedars" provided with your March 21, 2003 letter depicts structures and other impervious surfaces within Zone 1 (30 feet closest to the stream). The Minor Variance is only eligible for impacts to Zone 2 only. Prohibited uses within Zone 1 require a Major Variance approval from the Water Quality Committee (WQC) of the N.C. Environmental Management Commission (EMC) as per 15A NCAC 02B.0233(9)(c). You must redesign your proposed project to avoid the Zone 1 impacts if you choose to proceed with the Minor Variance. If you choose to proceed with a Major Variance then please complete the attached request form and submit the original and two copies to this office. 3. Zone 1 Impacts Please provide additional information justifying the need for the proposed impacts to Zone 1 of the protected buffers. Site Plans If you decide to proceed with either the Minor or Major Variance, then you will need to provide detailed site development plans depicting the location of Zone 1 and 2 of the protected buffers and the area of impact to the buffers in square feet. 5. Buffer Mitigation Buffer mitigation will most likely be required as a condition if you choose to proceed with either the Minor or Major Variance. If you choose to proceed with a variance, then please provide a buffer mitigation plan pursuant to 15A NCAC 02B .0242. 6. Stormwater Management Stormwater management will be required as a condition if you choose to proceed with either the Minor or Major Variance. Please provide a detailed stormwater management plan depicting how you intend to treat the stormwater running off the proposed impervious surfaces. Please respond in writing within three weeks of the date of this letter by sending a copy of this information to me and to Mr. Tom Steffens of the DWQ Washington Regional Office ((252) 946-6481). If we do not hear from you in writing within three weeks, we will assume that you no longer want to pursue your variance request and we will consider the request as withdrawn. It is may understanding that the following information is correct. CAMA Major and Minor. Since the property is located in Lenoir County these permits do not apply. 401 Certification/ 404 Permit. Scott Jones, with the US Corps of Engineers, Washington, NC Office has visited the site and advised me on 3/21 that since the culverts located on site will not be replaced a 404 Permit will not be required. He will be sending written documentation to this effect which I will forward to you. On-site Wastewater Permit, NPDES Permit, Non-discharge permit, and Water Supply Watershed Variance The site is currently served by Kinston sewer and water. The new construction will be tapped into the existing infrastructure. It is my understanding that these permits would not apply to this development.
