Your consultant, Mike Harvey of Recreation Engineering and Planning, Al Kopf from the City of Asheville Parks and Recreation Department, and Mike Parker of the North Carolina Division of Water Quality participated in the discussions. The purpose of the meeting was to discuss the status of your pending application, and to clearly identify required additional information that is necessary for us to adequately analyze the impacts of the proposed facilities. As discussed, we have unresolved concerns regarding potential physical and biological impacts that may result from construction of the proposed structures in the French Broad River. Plans received with the application do not provide sufficient information to allow us to conclude that adverse effects on the river and adjacent riparian zone will be minimal. We must insist that scaled detailed drawings for each project component, based upon actual surveyed site conditions, be provided. Water surface elevations including ordinary high water and bankfull width and depth should be clearly indicated on all cross sectional views. Substrate investigations should be conducted to determine the presence of absence of bedrock within the proposed construction zone. Finally, any hydraulic calculations used in the design of the facility must be provided. It has been our experience that recreational whitewater facilities can be created and/or enhanced with much less intrusive methods. An essential component of any DA application is a comprehensive discussion of less-damaging alternatives that have been considered, and specific reasons why the various alternatives do not satisfy your basic purpose and need for the project. 2 Finally, the North Carolina Department of Transportation, has verbally expressed concern over the proximity of the Jean Webb Park structure to their bridge piers. We will forward their written comments to you when they are received. Pursuant to 33 CFR Section 325.2(d)(5), unless the information we have requested is provided to this office within thirty (30) days of your receipt of this letter or you provide justification for additional time to respond to our request, we will consider your application withdrawn and our administrative review of your proposal will conclude. A site visit was made on October 7, 2002 to further assess the potential impact to fish and wildlife resources. comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The applicant proposes to use 1700 cubic yards of three to five-foot diameter boulders to create two V-dams that will span the entire channel of the French Broad River. The V-dams will be grouted and anchored to the riverbed and banks to prevent movement or shifting during flood events. Cofferdams will be utilized while the structures are constructed to insure that no wet concrete contacts surface waters. The top of each structure is to be placed flush with the existing channel bottom. A four-foot deep pool, gradually tapering downstream, is to be excavated below each structure. The pools are to provide a plunge pool effect and will be scoured of sediment during high flows. Thirteen four to six foot diameter boulders will be strategically placed below the pools to enhance the quality of the riffles. Two angled current deflectors will be constructed opposite each other at the French Broad River Park location. The deflectors are intended to create a scour pool, dissipate stream energy and provide aeration. These structures will require the discharge of approximately 1000 cubic yards of rock below the plane of ordinary high water. The stated purpose of the work is to improve whitewater boating and in-stream habitat at these publicly accessible settings. Due to the magnitude of the project, we are concerned about the potential for adverse impacts to the French Broad River from the concrete and excavation. The alteration of the channel and flow characteristics could cause destabilization of streambanks downstream of the project site. However, a primary concern is that the structures as currently designed will effectively block the river for navigation by other boaters and will have an adverse impact on non-whitewater recreational opportunities. We recommend that the Corps of Engineers deny the permit for this project as currently designed. If the project is redesigned to insure that boats can move freely through this area, we would anticipate providing a more favorable review provided the design did not adversely impact aquatic habitat. Additionally, the work should be in conjunction with restoration or enhancement in the vicinity to improved aquatic and riparian habitat. WATER QUALITY SECTION February 14, 2003 Dear Mr. Parker, This letter is in response to your letter dated February 3, 2003, and is in reference to Riverlink's request for 404 permit authorization on the French Broad Rivet' in Asheville. In advance of a face to face meeting between representatives from our company and Riverlink with the Army Corp of Engineers and the Division of Water Quality; we thought we might attempt to answer, in more detail, some of the issues raised in your letter dated November 15, 2002. The following will address the items numbered 5-8 in your letter. Our hope is that a meeting between the key agencies can keep this important project on course for permitting and answer any of your concerns. I would again reiterate that our company has built a good number of similar projects (we will be under construction of up to six projects of a similar nature by this spring) and we look forward to providing examples of these types of structures, in operation, around the Country. In reference to items 5-8 listed in your letter: t" erV04- All of our designs go through rigorous hydrological and stress analysis. As shown in our detail drawings the structures are lateral arches that are largely submerged in the streambed. This design was chosen for several reasons. First, the fluid forces that act on our structures can be divided into two classes, static fluid forces and dynamic fluid forces. The static forces are the result of water pressure that may occur on one side of the structure that is not matched by water on the other side of the structure. These forces are independent of the volume of water present on one side versus the other and are solely a function of the density of the water and the difference in water level on one side versus the other. However, since our structures in Asheville are designed to match flush with the riverbed on the upstream side of the structure this force is not a factor. The water pressure on the downstream side of the structure; though also not a significant factor. pushes upstream and acts in a direction that reinforces the structure. The dynamic fluid forces are the result of the momentum of the current pushing against the upstream side of the structure. Since these forces impact the structure at an obtuse angle on the leading edge of the structure they must be decomposed into the fraction which presses down on the structure and the fraction which laterally, in the downstream direction, against the structure. Prov Given the flat angle on the leading edge of the structure these forces are a small fraction of the overall momentum of the water in the river, even at extreme flood levels. It is clear, however, that there are stresses on the structure. All of these stresses can be divided into three categories, tensile/compressive, or mode I stresses, shear, or mode II stresses, and tearing, or mode III stresses. Unfortunately, materials that are strong in tension pose a serious risk in a river channel. Materials like wood (especially logs) and rebar (reinforced concrete) often lead to entrapment of people and craft in the waterway and can result in injury or death. Our structures, therefore, are built with rock and un-reinforced concrete. Since our base materials are only strong in compression we must put them into structures that support the applied stresses without applying tension, torsion, shear or tearing to these materials. Interestingly enough, material constraints were the same reason that the Romans relied so heavily on this same type of structure. Our designs specify granite or equivalent rock and concrete grout capable of sustaining 3000 psi of compressive stress. Detailed analysis shows that this represents a safety margin far in excess of twenty times the expected load. Also noted in this point is thN very important issue of sediment transport and scour analysis The primary risk here is that the structure will interfere with the rivers natural mechanisms for sediment transport and this will eventually, result in'the build up of sediment that can be both damaging to fish habitat and cause the river tQ overflow its banks. As is noted later in this discussion, our structures are designed with several interlaid channels. The smallest of these is the low flow channel, which is laid at the existing riverbed. The low flow channel is the primary --> mechanism for year round unobstructed sediment transport. Our designs also serve to increase the L, w channelization of the river and therefore enhance the scour characteristics of this channel. Designs rj n U a 4h4 also create scour pools, which use the inertia of the water pouring over our structures to scour sediment away and provide enhanced fish habitat. a/ .1 6. The hydrology of the river itself is perhaps the most important part of each new design. Careful WAO- J flow analysis must be made of low flows, high flows, average flows and extreme flood conditions. Our primary concern here is that poorly designed in-stream improvements may pose a safety JV1W vow ??u ryl/? hazard and that they may lead to flooding or other damage to the banks of the stream. However, since these historical flows are well documented on this stretch of river we were able to design the structures with three distinct conditions in mind. The smallest of our interlaid channels is the low- flow channel. This channel is designed so that the river is navigable at the lowest projected flows _? I and such that it provides ample depth for in-stream wildlife. The high flow channel is designed, also using free surface fluid dynamics, to accommodate all flows including higher than normal flooding. This channel allows for safe boating and passage throughout this gamut of normal flow levels. The structures are also designed to contain the flow of a so-called "twenty-year flood"; a situation where most of the structure would sit at the bottom of the river but in which the river will fit between the banks of the existing channel. Lov ??6)ur structures do not significantly change the amount of water that the streambed can carry and therefore do not contribute to flooding. The arch design assures that no particular cross-section of river channel is decreased in area by a significant percentage. The continuity equation proves, therefore, that the river is as capable of withstanding higher flows as it was when the project was begun. -40' lkAJ-1 7. ur improvements have been shown to actually enhance in stream aquatic life habitat. 'In / particular we provide a deep, center stream, navigable channel that allows for aquatic life movement both up and down the river. No single structure represents more than an 18" drop between the crest of the structure and the exit. The exact amount of vertical loss in each structure, up to 18", is determined by the existing conditions in the field. This amount of drop, combined with an appropriate slope of between 7:1 & 10:1, does not impede the movement of aquatic life more than the existing channel does. ? T7*+?•s 8. Native vegetation appropriate for stream corridors will be used for any re-vegetation. The terracing consists of seated and interlocked rock structures. These shield and enhance bank stability and are used to impede bank erosion. Eddy currents and fast flows can undermine riverbanks and erode away their foundations. In areas where this is a possibility we have specified that the G? terracing extend low enough to prevent this erosion and stabilize the bank. This extension has the benefit of enhancing access and egress to boaters and represents a safety improvement to the existing riverbanks. CAUW + Thank you for your continued efforts on this request. Based on the response from Recreation, Engineering & Planning the Division of Water Quality additional information is needed before we can proceed with review of the 401 Certification application. On January 31, 2003, 1 contacted Mr. Michael Harvey, Recreation, Engineering & Planning and requested that a meeting be held with representatives of Riverlink, U. S. Army Corps of Engineers, Wildlife Resources Commission and the Division of Water Quality, to discuss this project. Mr. Harvey is to get back to me sometime this week to schedule the meeting. You are requesting to construct two whitewater training courses by constructing and placing rock structures in the French Broad River downstream of Amboy Road adjacent to the French Broad River Park and underneath the 1- 240 bridges at Jean Webb Park. The purpose of this letter is to provide comments and request additional information listed below: The sketches indicate that structures will be constructed across the width of the river at both locations and the wording indicates that these structures will be grouted. Since concrete (due to its pH) is toxic to fish and other aquatic organisms, how will these structures be grouted and not affect fish and wildlife? 2. There are main MSD of Buncombe County sewer lines and pump station in the vicinity of the structures at the French Broad River Park. How will these utilities be protected from damage during construction and from future flooding events? Recommend you contact the MSD of Buncombe County regarding the location of their sewer lines at both sites. 3. Do you have a certification from the City of Asheville that these structures will not result in a no rise situation during flooding events? Please provide a copy of the certification to this office. 4. The plans and typical details submitted with the application do not include distances, depths, areas, specifications or scale of the structures relative to the French Broad River. Specifically, improvements requiring fill include: i 1) Construction of one boulder V-Dam to create self-scouring plunge pools and to dissipate stream energy. Plunge pools excavated below each V-Dam will improve the pool to riffle ratio, provide winter holding water, and be scoured of sediment during high flows; 2) Addition of large riffle boulders below,and within pools. 3) Boulder edge and riparian terraces to provide for erosion protection and planting areas. 4) Construction of one double current deflector intended to create a scour pool, dissipate stream energy, and provide seratinn A variety of improvements have been selected to improve the condition of the French Broad River. Figure 2 illustrates the locations of structures that ire planned for implementation. A description of each of the techniques subject to Section 404 regulation follows. A. Boulder V-Dams One boulder V-Dams will be constructed using three to five foot diameter boulders at each location. The V- Dam will generally extend across the entirelchannel and be anchored to each stream bank (Figure 2a). Boulders will be anchored to the bed and banks to insure they will withstand flood flows. All boulders will be placed such that their top surfaces matchi flush to the existing channel invert. The approximate quantity of this structure is 1700 c. y. I? A four foot deep pool will be excavated belbw each structure (figure 3), with pool depth gradually decreasing in the downstream direction to form the pool tail-out. The resulting pool will provide plunge pool habitat and will be scoured of sedimeni during high flows. The drop associated with the V-Dam will dissipate stream energy and aerate the watel. B. Riffle Rouehness Boulders Thirteen-four to, six foot diameter riffle roughness boulders will be placed at various locations below plunge pools to enhance the quality of the riffle. C. Stream bank Stabilization j i Portions of both stream banks will be stabilized. (See figure 4.) A rpw of three-foot diameter boulders will be placed at the toe of the new stream bank below the ordinary high water line. This boulder toe amounts to one-third of a cubic yard of material plac d per lineal foot of stream bank. D. Double Current Deflectors 1 i One Double Current Deflector will be installed. These are constructed by placing two angled current deflectors opposite to each other. Boulders will be anchored into the bank and bed of the river to insure they withstand flood flows. This structure will require approximately 1000 c.y. (see figure 5) Block 19: Proposed Project Purpose The purpose o''the proposed project is to improve the whitewater boating characteristics and in-stream habitat within the reach of the French Broad River located adjacent to the Jean Webb Park in Asheville, North Carolina. The project will provide whitewater boating opportunities as well as other recreational river activities in an accessible and public setting for the residents of Asheville. Project construction is anticipated to begin in September 2003 and extend as necessary through December 2003, during low flow periods. Block 20: Reasons for Discharge, Natural boulders will be placed within the stream to create whitewater boating features as well as improve in-stream, aquatic habitat. The specific natures of these structures are discussed above. Bedrock outcroppings are common throughout this reach of the French Broad River. How will the occurrence or absence of bedrock at the project sites effect construction methods? Have test borings been conducted? 4. How are the vane structures, deflectors, and random boulders to be anchored to the river bottom and banks? What stone event have they been designed to withstand? 5. The left and right deflectors will likely cause eddies against the downstream banks resulting in instability and erosion. This must be adequately addressed prior to any permit decision. The terraced bank area at the French Broad River Park structure appears to be pri-manly for seating and viewing. Alternative vle;ving arrangements could be made on the adjacent upland which would not impact the bank and channel. What alternatives have been considered? Both vane structures appear to have the potential to impact aquatic life movement through the project areas. The Jean Web Park structure could have a damming effect during low flow periods. Please address these issues. 8. The proposed structures could accumulate sediment outside of the thalweg on the upstream sides. Have bar formation and future sediment removal been considered? 9. Navigability through the project reaches, by other than whitewater participants, is a concern. How will the structures impact other recreational river users such as rafts, canoes, and tubes ? A site visit was made on October 7, 2002 to further assess the potential impact to fish and wildlife resources. comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 1.6 U.S.C. 661-667d). The applicant proposes to use 1700 cubic yards of three to five-foot diameter boulders to create two V-dams that will span the entire channel of the French Broad River. The V-dams will be grouted and anchored to the riverbed and banks to prevent movement or shifting during flood events. Cofferdams will be utilized while the structures are constructed to insure that no wet concrete contacts surface waters. The top of each structure is to be placed flush with the existing channel bottom. A four-foot deep pool, gradually tapering downstream, is to be excavated below each structure. The pools are to provide a plunge pool effect and will be scoured of sediment during high flows. Thirteen four to six foot diameter boulders will be strategically placed below the pools to enhance the quality of the riffles. Two angled current deflectors will be constructed opposite each other at the French Broad River Park location. The deflectors are intended to create a scour pool, dissipate stream energy and provide aeration. N/A `z Block 18: Nature of Activity The overall goal of the project is to improve whitewater boating characteristics by: (1) the creation of self- scouring pools; (2) stabilizing stream banks; and (3) planting and preserving riparian vegetation to enhance overhead cover and shadine. Specifically, improvements requiring fill include: 1) Construction of one boulder V-Darn to create self-scouring plume pools and to dissipate stream energy. Plunge pools excavated below each V-Dam will improve the pool to riffle ratio, provide winter holding water, and be scoured of sediment during high flows; 2) Addition of large riffle boulders below and within pools. 3) Boulder edge and riparian terraces to provide for erosion protection and planting areas. 4) Construction of one double current deflector intended to create a scour pool, dissipate stream energy, and ^rnvide aer=ation. A variety of improvements have been selected to improve the condition of the French Broad River. Figure 2 illustrates the locations of structures that are planned for implementation. A description of each of the techniques subject to Section 404 regulation} follows. A. Boulder V-Dams One boulder V-Dams will be constructed using three to five foot diameter boulders at each location. The V- Dam will generally extend across the entire channel and be anchored to each stream bank (Figure 2a). Boulders will be anchored to the bed and banks to insure they will withstand flood flows. All boulders will be placed such that their top surfaces match flush to the existing channel invert. The approximate quantity of this structure is 1700 c. v. A four foot deep pool will be excavated below each structure (figure 3), with pool depth gradually decreasing in the downstream direction to form the pool tail-out. The resulting pool will provide plunge pool habitat and will be scoured of sediment during high flows. The drop associated with the V-Dam will dissipate stream energy and aerate the water. B. Riffle Roughness Boulders Thirteen-four to six foot diameter riffle roughness boulders will be placed at various locations below plunge pools to enhance the quality of the riffle. C. Stream bank Stabilization Portions of both stream banks will be stabilized. (See figure 4.) A row of three-foot diameter boulders will be placed at the toe of the new stream bank below the ordinary high water line. This boulder toe amounts to one-third of a cubic yard of material placed per lineal foot of stream bank. D. Double Current Deflectors One Double Current Deflector will be installed. These are constructed by placing two angled current deflectors opposite to each other. Boulders will be anchored into the bank and bed of the river to insure they withstand flood flows. This structure will require approximately 1000 c.y. (see figure 5) Block 19: Proposed Project Purpose The purpose orthe proposed project is to improve the whitewater boating characteristics and in-stream habitat within the reach of the French Broad River located adjacent to the Jean Webb Park in Asheville, North Carolina. The project will provide whitewater boating opportunities as well as other recreational river activities in an accessible and public setting for the residents of Asheville. Project construction is anticipated to begin in September 2003 and extend as necessary through December 2003, during low flow periods. Block 20: Reasons for Discharge Natural boulders will be placed within the stream to create whitewater boating features as well as improve in-stream, aquatic habitat. 'The specific natures of these structures are discussed above. Block 21: Types of Materials Being Discharged and the Amount of Each Type in Cubic Yards The material being used for construction of the proposed structures is two to six foot diameters, natural boulders. The total cubic yardage of rock planned for this project is 2805cy. Block 22: Surface Areas of Wetlands or Other Waters Filled Fill will he placed along 800 liner feet of stream in the structures described above. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted, with.- the., application show. the. construction, of whitewater boating training..... . facilities adjacent to both Jean Webb Park and the French Broad River Park. Approximately 1,700 cubic yards of three to five foot diameter boulders will be used to create each of two V- Dams, 'which will span the entire channel. The V-Dams will be grouted, and anchored to the riverbed and banks to prevent movement or shifting during flood events. Cofferdams will be - utilized '_while the` structures are constructed to insure that no" wet -concrefe contacts . surface` waters. The top of each structure is to be placed flush with the existing channel bottom. A four- foot deep pool, gradually japering downstream, is to be excavated below" each 'structure. The pools are to provide a plunge-pool effect and will be scoured of sediment during high flows. Thirteen- four to six foot diameter boulders will be strategically placed below the pools to enhance the quality of the riffles. Two angled current deflectors will be constructed opposite each other at the French Broad River Park location. The deflectors are intended to create a scour pool, dissipate stream energy, and provide aeration. These structures will require the discharge of approximately,,. cubic yards of rock below the plane of ordinary high water. Approximately 300 linear feet of the west bank at the French Broad River Park is to be stabilized with boulders,. terracing,.. and vegetation. The purpose of the work is to improve whitewater '. boating characteristics and in-stream habitat at publicly accessible settings. Plans showing the. work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Water Quality (NCDWQ) has determined the applicability of a Water Quality Certificate as required by PL 92-500. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. Evaluation of the probable impacts, which the proposed activity may have on the public interest, requires a careful weighing of all those factors which become relevant in each particular case. The benefits, which reasonably may be expected to accrue from the proposal, must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal; and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors, which may be relevant to the proposal, must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines.
