Dear Mr. Dean:
On August 13, 2002, Mr. Bob Zarzecki and Mr. Larry Eaton of the Division of Water Quality (DWQ)
Wetlands/401 Unit met with your consultant, Mr. Ward Elis of EcoScience, Inc., on the property to review the
streams proposed to be impacted. As a result of this meeting it was determined that all of the streams are
"perennial' and support aquatic life at the proposed impact areas. DWQ staff observed flowing water, fish,
salamanders, clams and crayfish within the streams.
You have proposed to cross four streams with a total of 420 feet of stream impact under Nationwide Permit No.
14 and General Water Quality Certification No. 3375 (GC3375). The DWQ has determined that stream
mitigation will be required for these impacts because they exceed 150 feet as per Condition No. 7 of GC3375.
The 401 Certification approval will be conditioned such that a final compensatory stream mitigation plan must
• be approved in writing by this office before any of the impacts approved are conducted. The required amount
of stream mitigation for the current proposed plan if approved will be 420 feet. If stream mitigation is not an
option, then you may propose payment into the Wetlands Restoration Program to compensate for these
impacts. Please contact this office if you have any questions concerning this compensatory stream mitigation
condition.
Please be aware that we still require a response to our last letter dated July 24, 2002 before we can process your
application. Unless we receive the additional information requested below, we will have to move toward denial of
your Certification and Authorization Certificate as required by 15A NCAC 2B .0259(8) and 15A NCAC 2H .02500
and will place this project on hold as incomplete until we receive this additional information. Please provide the
following information so that we may continue to review your project. A meeting to discuss the subdivision plan
may be beneficial. Please contact Mr. Bob Zarzecki of this office at (919) 733-9726 if you would like to schedule
such a meeting. We are requesting (by copy of this letter) that the U.S. Army Corps of Engineers (USACE) place
your project on administrative hold.
• Please provide additional information as to how Lots 11, 15 and 34-37 near Tobacco Lane can have
homes built on them without additional buffer impacts. Will Lot 129 require a driveway crossing? Are all
other lots buildable without requiring additional impacts to buffers, streams and/or wetlands?
Please respond within three weeks of the date of this letter by sending this information to me and to Mr. Steve
Mitchell of the DWQ Raleigh Regional Office. If we do not hear from you in three weeks, we will assume that

placed on hold, I recommend that you submit a new PCN and fee for this project regardless of the

on-hold letter.

Bob, it's been awhile, hope you are doing well and not to overworked already in 2004. 1 know it has been
awhile since this 401 application was submitted and you did the site visit but I would like to bring it back up and
hopefully get the permit. Any chance on getting together to refresh the needs/concerns regarding this site?
Also, going back to the permit application, if we only crossed WA3 and did not develop the remainder of the site
would we have to submit a new PCN regarding those changes. I have also moved over to Buck Engineering, I
am not sure who will finish the application, do any changes have to be made if the initial part was done by
Ecoscience. Thanks for any help.

Dear Bob:
The purpose of this letter is to address questions brought up by DWQ in a letter received by RidgeCo
August 15`h and address questions brought up during a meeting on September 6`h between
representatives of RidgeCo and DWQ.
1) Buffer impacts to Lots 11, 15, and 34-37 near Tobacco Lane. Figure 8 is a depiction of where lot
lines are anticipated. Lot sizes and lot lines have not been finalized and can be adjusted to avoid
additional buffer impacts.
2) Lot 129. A driveway crossing is anticipated for this lot. Ridgeco anticipates an arched bottomless
culvert to be used for the crossing. No stream impacts are expected to occur.
3) Additional impacts to buffers, streams and/or wetlands. No additional impacts are anticipated to
any jurisdictional areas. Similar to (1), RidgeCo is willing to adjust lot lines to avoid additional
impacts.
From our meeting on September 6`h, RidgeCo is investigating options for stream crossings including
spanning all waterways with arched bottomless structures. Mitigation possibilities are also being
considered and RidgeCo anticipates contacting DWQ with such options.

We still do not have a written response to our letter dated August 13th. This
on hold letter had a 3 week time frame to respond. However, we met on Sept. 6th
and discussed potential changes to the site plan and mitigation options. We
will need to close out the file if we don't receive something in writing.
Please send a written letter detailing how your client intends to proceed with
the project and when you intend to submit a response to our August 13th letter
and potential revisions to your original application. We'll put it in the file
and will hold off on withdrawing the project dependent on your client's plans.

Dear Mr. Dean:
On May 29, 2002, the Division of Water Quality (DWQ) received the additional information regarding your request to
impact wetlands, streams and protected riparian buffers to construct the proposed residential subdivision. The DWQ has
determined that the proposed project will require written authorization for impacts to streams and riparian buffers
protected under the Tar-Pamlico Buffer Rules (15A NCAC 2B .0259) and 15A NCAC 2H .0500. In order to issue this
authorization the DWQ must ensure that your project meets the no practical alternatives determination required under
these rules. Insufficient evidence is present in our files to conclude that your proposed must be built as planned.
Therefore, unless we receive the additional information requested below, we will have to move toward denial of your
authorization certificate as required by 15A NCAC 2B.0259(8) and 15A NCAC 2H .02500 and will place this project on
hold as incomplete until we receive this additional information. Please provide the following information so that we may
continue to review your project.
1. Please provide additional information as to how you determined that the 420 feet of streams proposed to be
impacted in your request are "intermittent" streams and not "perennial" streams. If a field determination has not
yet been conducted by DWQ staff for the purpose of determining whether the stream are "intermittent" or
"perennial", then please call Mr. Dave Penrose or Mr. Larry Eaton of the Wetlands / 401 Unit to set up a site visit
to make this determination. You can reach them at (919) 733-1786.
2. Please provide additional information as to how Lots 11, 15 and 34-37 near Tobacco Lane can have a home built
on them without additional buffer impacts. Will Lot 129 require a driveway crossing? Are all other lots buildable

Re: Corrections to the Section 401 Permitting for Impacts Associated with Stream Crossings,
Wetland Impacts and Tar-Pamlico Riparian Buffer Rules at Ridgehaven Residential
Development in Franklin County NC. DWQ # 02-0686
To Whom It May Concern:
The purpose of this letter is to address three additions requested by DWQ and a correction to a permit
application submitted and returned to RidgeCo LLC on May 9`', 2002 requesting a Nationwide Permit
(NWP) 14 (Linear Transportation Crossings) for a new residential development located in Franklin County
NC named Ridgehaven.
Please find the following items attached to this letter:
• Figure 9,9A, 9B and 9C - plan view of Tar-Pamlico riparian buffer locating all streams onsite and
areas of impacts to the buffer. No ponds exist within the site,
• Addressing, XI Stormwater - request for a stormwater site plan for the proposed residential
community,
• Correction to XII Sewage Disposal - water to the site is provided by Franklin County and septic
tanks will be used by individual lots to dispose of generated waste, and
• Seven (7) copies of a signed and dated page 11, applicants signature.
As stated with the previous submitted application proposed impacts at this development site include
crossing four separate streams (total of 420 linear feet) and four separate wetlands (total of 0.085 acre)
1) fill in 106 linear feet of an intermittent stream that is part of an unmatned tributary to the Tar
River (Figure 5 - #3 WA), incorrectly labeled as Figure 5 - #1WA in previous cover letter.
2) fill in 98 linear feet of an intermittent stream that is part of an unmarred tributary to the Tar River
(Figure 5 - #2 AA),
3) fill in 90linear feet of an intermittent stream that is part of an unnamed tributary to the Tar River
(Figure 5 - #1 WH), incorrectly labeled as Figure 5 -#3WA in previous cover letter.
4) fill in 126 linear feet of an intermittent stream that is part of an unnamed tributary to the Tar
River (Figure 5 - #4 WL), and
5) fill of approxunatley 0.085 acre of wetland associated with road crossing WA (Figure 5).
The property continues to be under development by a Louisburg-based company called RidgeCo LLC.

specific stormwater management plan is not required for projects with final impervious cover of
less than 30%. RidgeCo LLC will follow best management ment procedures regarding Tar-Pamlico
Riparian Area Protection Rules to minimize any impacts on water quality during construction
and upon project completion. Appropriate stormwater controls methods including stone check
dams, sediment retention ponds and level spreaders will be implemented on-site during
construction to protect surface waters and wetlands both onsite and downstream of the property.

Proposed impacts at this development site include crossing four separate streams (total of 420 linear feet)
and four separate wetlands (total of 0.085 acre)
1) fill in 106 linear feet of an intermittent stream that is part of an unnamed tributary to the Tar
River (Figure 5 - #1 WA),
2) fill in 98 linear feet of an intermittent stream that is part of an unnamed tributary to the Tar River
(Figure 5 - #2 AA),
3) fill in 90linear feet of an intenmittent stream that is part of anunnamed tributaryto the Tar River
(Figure 5 - #3 WA),
4) fill in 126 linear feet of an intermittent stream that is part of an unnamed tributary to the Tar
River (Figure 5 - #4 WL), and
5) fill of approximatley 0.085 acre of wetland associated with road crossing WA (Figure 5).
The site is located inn jurisdictional areas subject to the Tar-Pamlico River Riparian Buffer Rules. Stream
impacts are less than 150 linear feet in length for each stream crossing.

For Section 404 and/or Section 10 Nationwide, Regional and General Permits, Section 401
General Water Quality Certifications, and Riparian Buffer and Watershed Buffer Rules
This form is to be used for projects qualifying for any of the U.S. Army Corps of Engineers' (US ACE)
Nationwide, Regional or General Permits as required by Section 404 of the Clean Water Act and/or
Section 10 of the Rivers and Harbors Act, and for the North Carolina Division of Water Quality's
(DWQ) associated General 401 Water Quality Certifications. This form is also to be used for any
project requiring approval under any Riparian Buffer Rules implemented by the N.C. Division of Water
Quality. This form should not be used if you are requesting an Individual 404 Permit or Individual 401
Water Quality Certification. The USACE Individual Permit application form is available online at
http://www.saw.usace.army.miI/wetiands/Perm app.htm.
The USACE is the lead regulatory agency. To review the requirements for the use of Nationwide,
Regional or General permits, and to determine which permit applies to your project, please go to the
USACE website at http://www.saw.usace.army.mi]/wetlands/regtour.htm, or contact one of the field
offices listed at the end of this application. The website also lists the responsible project manager for
each county in North Carolina and provides additional information regarding the identification and
regulation of wetlands and waters of the U.S.
The DWQ issues a corresponding Certification (General or Individual), and cannot tell the applicant
which 401 Certification will apply until the 404 Permit type has been determined by the USACE.
Applicants are encouraged to visit DWQ's 401/Wetlands Unit website at
http://h2o.enr.state.nc.us/ncwetlands to read about current requirements for the 401 Water Quality
Certification Program and to determine whether or not Riparian Buffer Rules are applicable. The
applicant is also advised to read the full text of the General Certification (GC) matching the specific 404
Permit requested. In some cases, written approval for some General Certifications is not required,
provided that the applicant adheres to all conditions of the GC. Applicants lacking access to the internet
should contact DWQ's Central Office in Raleigh at (919) 733-1786.
Trout Waters Coordination - Special coordination with the North Carolina Wildlife Resources
' Commission (NCWRC) is also required for projects occurring in any of North Carolina's twenty-five
counties that contain trout waters. In such cases, the applicant should contact the appropriate NCWRC
regional coordinator (listed by county on the last page of this application).

CAMA Coordination - If the project occurs in any of North Carolina's twenty coastal counties (listed on
the last page of this application) the applicant should also contact the North Carolina Division of Coastal
Management (DCM) at (919) 733-2293. DCM will determine whether or not the project involves a
designated Area of Environmental Concern, in which case DCM will act as the lead permitting agency.
In such cases, DCM will require a Coastal Area Management Act (LAMA) Permit and will coordinate
the 404/401 Permits.
USACE Permits - Submit one copy of this form, along with supporting narratives, maps, data forms,
photos, etc. to the applicable USACE Regulatory Field Office (addresses are listed at the end of this
application). Upon receipt of an application, the USACE will determine if the application is complete as
soon as possible, not to exceed 30 days. This PCN form is designed for the convenience of the applicant
to address information needs for all USACE Nationwide, Regional or General permits, as well as
information required for State authorizations, certifications, and coordination. Fully providing the
information requested on this form will result in a complete application for any of the USACE
Nationwide, Regional or General permits. To review the minimum amount of information that must be
provided for a complete PCN for each USACE Nationwide permit, see Condition 13, 65 Fed.Reg. 12893
(March 9, 2000), available at http://www.saw.usace.army.mil/wetlands/nwpfinalFedReiz.pdf.
Processing times vary by permit and begin once the application has been determined to be complete.
Please contact the appropriate regulatory field office for specific answers to permit processing periods.
401 Water Quality Certification or Buffer Rules - All information is required unless otherwise stated
as optional. Incomplete applications will be returned. Submit seven collated copies of all USACE
Permit materials to the Division of Water Quality, 401/Wetlands Unit, 1650 Mail Service Center,
Raleigh, NC, 27699-1650. If written approval is required or specifically requested for a 401
Certification, then a non-refundable application fee is required. In brief, if project impacts include less
than one acre of cumulative wetland/water impacts and less than 150 feet cumulative impacts to
streams, then a fee of $200 is required. If either of these thresholds is exceeded, then a fee of $475 is
required. A check made out to the North Carolina Division of Water Quality, with the specific name of
the project or applicant identified, should be stapled to the front of the application package. For more
information, see the DWQ website at http//h2o.ehnr.state.nc.us/ncwetlands/fees.html. The fee must be
attached with the application unless the applicant is a federal agency in which case the check may be
issued from a separate office. In such cases, the project must be identifiable on the U.S. Treasury check
so that it can be credited to the appropriate project. If written approval is sought solely for Buffer Rules,
the application fee does not apply, and the applicant should clearly state (in a cover letter) that only
Buffer Rule approval is sought in writing. Wetlands or waters of the U.S. may not be impacted prior to
issuance or waiver of a Section 401 Water Quality Certification. Upon receipt of a complete application

was performed by Ecoscience Corporation (Raleigh NC) fall 2000 (see attached - Exhibit 4).
Delineation was approved by U.S. Army Corp Representative Mr. Todd Tugwell October 6`n
2000, Action ID # 200021933 (see attached - Exhibit 5). Site was visited by DWO
representative Mr. Matt Flynn April 3, 2001, for an on-site determination of Tar River Riparian
Buffer Rules applicability based on appropriate NRCS soil survey maps and NC topographic
quarter quads (see attached - Exhibit 6 & Fig. 8).

I VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts
I Minimization - Unavoidable impacts have been minimized through lot and road layout plannin
and cost/benefit analyses. Crossings are situated to minimize impacts to onsite streams and
wetlands while considering land topography and allowing access to all points within the site. In
order to minimize overall development impacts the developer has positioned road crossing I (the
only crossing to impact vegetated wetlands) to avoid larger vegetated wetlands located

immediately upstream and downstream of the crossing (see Fig 6). Crossings 2 3 and 4 were
positioned as perpendicular to each stream as feasible to minimize linear impacts to streams. The
x-section and pipe length designed for each stream crossing minimizes the width necessary to
fulfill the projects purpose and need (see attached - Exhibit 7). Best management practices will
be utilized during _construction to minimize construction impacts.
Avoidance - A section 404 jurisdictional area delineation has been conducted within the site and
site planning for lots and roads has taken results of the delineation into account. Access roads
have been sited to minimize stream crossings and wetland impacts and allow access to all points
within the site (see Exhibits 5 & 6). After discussions with DWQ representative Mr. Matt Flynn,
Cotton Drive was repositioned from original plans to come north off of Twin Creek Drive
instead of coming off westerly from Harley Court to avoid areas within jurisdiction of the Tar
River Riparian Buffer Rules (see Figure 7 & 8).

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.htmi.

1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Project planning and road design was performed for avoidance of jurisdictional areas
wherever possible Proposed impacts include 0.005 acre of vegetated wetland and a total of
420 linear feet from four separate streams. Mitigation onsite includes preservation of
approximately 3.1 acres of undisturbed wetlands through preservation b the applicant or by
deed restrictions on individual landowners as development progresses. Deed restrictions will
be registered with Franklin County and provided to the USACE as needed. As per
discussions with Army Corps Representative Mr. Todd TugLwell and DWO Representative
Mr. Matt Flynn for onsite streams and Tar River Riparian Buffer rules applicability, a
provision regarding compliance to follow Tar River Riparian Buffer rules associated with
appropriate streams will be inserted into Home Owner covenants for individual landowners.
1 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that
you would like to pay into the NCWRP. Please note that payment into the NCWRP must be
reviewed and approved before it can be used to satisfy mitigation requirements. Applicants

Basically, to be eligible for NW 14, the impacts have to fall under two separate thresholds - the total area (surface
acreage) of combined impact to jurisdictional waters (stream, wetland, and open water) needs to be less than 1/3 acre,
and the total width of all jurisdictional crossing (stream, wetland or otherwise) combined (measured from bank-to-
bank) needs to be less than 200 linear feet. With only four stream crossings and one wetland crossing of less than
1/10 acre, I would expect the project to be eligible for the permit. Hope this helps.

Acceptance and approval of this plan is conditioned upon your compliance with applicable
federal and state water quality laws, regulations and rules. This could include the Division of
Water Quality under stormwater or other specific water quality standards, and the U.S. Army
Corps of Engineers under Article 404 jurisdiction. Our approval does not supersede any other
required permit or approval.
Due to the location of this project, it should be noted that a rule to protect and maintain
existing buffers along watercourses in theTar-Pamlico River Basin became effective on January 1,
2000. The Tar-Pamlico River Riparian Area Protection and Maintenance Rule (15A NCAC 2B
0259) applies to all perennial and intermittent streams, lakes, ponds and estuaries in the Neuse
River Basin with existing vegetation on the adjacent land or "riparian area". In riparian areas with
existing vegetation in the first 30 feet directly adjacent to the stream, the rule prohibits land
disturbance or new development within the first 30 feet of land next to the water (the remaining 20
feet of the total buffer must be revegetated upon completion of any proposed land-disturbing
activity). In riparian areas with existing vegetation that is less than 30 feet wide, the rule prohibits
land disturbance or new development within the area that contains the existing vegetation (but not
the entire 50 foot riparian area). For more information about this riparian area rule, please contact
the Division of Water Quality's Wetland/401 Unit at 919-733-1786, or a Division of Water Quality
representative at this regional office.
Please note that this approval is based in part on the accuracy of the information provided
concerning financial responsibility. You are requested to file an amended Financial Responsibility
Form if any changes become necessary. In addition, it would be helpful if you would notify this
office when the proposed land-disturbing activity covered by this plan is initiated.

The site 'Location map and other information that was provided, allowed a determination to be made
as to whether or not the site would require compliance with the Tar-Pamlico Buffer Rule. This
specific project is referenced by the Raleigh Regional Office as NBRRO 01-118.
Stream feature A is indicated on the Franklin County Soil Survey. On April 3, 20011 completed a
site visit and determined that feature A (below the Pt. NBR -1) is subject to protection under the
Tar-Pamlico River Basin: Nutrient Sensitive Waters :Management Strategy; Protection and
Maintenance of Existing Riparian Areas, Administrative Code 15A:02B.0259 (NCAC 0259). This
letter addresses only the applicability of the Tar-Pamlico Buffer Rule at Phase 1 for this project.

GENERAL CERTIFICATION FOR PROJECTS ELIGIBLE FOR CORPS OF ENGINEERS
NATIONWIDE PERMIT NUMBER 14 (ROAD CROSSINGS) AND REGIONAL GENERAL
PERMIT 198200031 (WORK ASSOCIATED WITH BRIDGE CONSTRUCTION, MAINTENANCE
OR REPAIR CONDUCTED BY NCDOT OR OTHER GOVERNMENT AGENCIES)
AND RIPARIAN AREA PROTECTION RULES (BUFFER RULES)
This General Certification is issued in conformity with the requirements of Section 401,
Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of
Water Quality (DWQ) Regulations in 15A NCAC 2H, Section .0500 and 15A NCAC 2B .0200 for
the discharge of fill material to waters and adjacent wetland areas which are above headwaters or
to wetland areas that are not a part of the surface tributary system to interstate waters or
navigable waters of the United States (i.e., isolated wetlands) as described in 33 CFR 330
Appendix A (B) (14) of the Corps of Engineers regulations (Nationwide Permit No. 14 and
Regional General Permit 198200031) and for the Riparian Area Protection Rules (Buffer Rules) in
15A NCAC 2B .0200. The category of activities shall include any fill activity for road crossings
and is limited to fill less than one-third acre in tidal waters and less than one-half acre in non-tidal
waters. This Certification replaces Water Quality Certification Number 2177 issued on November
5, 1987, Water Quality Certification Number 2666 issued on January 21, 1992, Water Quality
Certification Number 2732 issued on May 1, 1992, Water Quality Certification Number 3103
issued on February 11, 1997, and Water Quality Certification Number 3289 issued on June 1,
2000. This WQC is rescinded when the Corps of Engineers re-authorizes Nationwide Permit 14
or Regional General Permit 198200031or when deemed appropriate by the Director of DWQ.
The State of North Carolina certifies that the specified category of activity will not violate
applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217
if conducted in accordance with the conditions hereinafter set forth.
Conditions of Certification:
1. Enumerating and Reporting of Impacts:
Streams - Impacts to streams as determined by the Division of Water Quality shall be
measured as length of the centerline of the normal flow channel. Permanent and/or
temporary stream impacts shall be enumerated on the entire project for all impacts
regardless of which 404 Nationwide Permits are used. Stream relocations and stream
bed and/or bank hardening are considered to be permanent stream impacts. Any
activity that results in a loss of use of stream functions including but not limited to
filling, relocating, flooding, dredging and complete shading shall be considered
stream impacts. Enumeration of impacts to streams shall include streams enclosed
by bottomless culverts, bottomless arches or other spanning structures when a 404
Permit is used anywhere in a project unless the entire structure (including
construction impacts) spans the entire bed and both banks of the stream, is only
used for a road, driveway or path crossing, and is not mitered to follow the stream
pattern. Impacts for dam footprints and flooding will count toward the threshold for
stream impacts, but flooding upstream of the dam will not (as long as no filling,
excavation, relocation or other modification of the existing stream dimension, pattern
or profile occurs) count towards mitigation.
Wetlands - Impacts to wetlands as determined by the Division of Water Quality shall
be measured as area. Permanent and/or temporary wetland impacts shall be
enumerated on the entire project for all impacts regardless of which 404 Nationwide
Permits are used. Any activity that results in a loss of use of wetland functions
including but not limited to filling, draining, and flooding shall be considered wetland
impacts. Enumeration of impacts to wetlands shall include activities that change the
hydrology of a wetland when a 404 Permit is used anywhere in a project.

• The structural stormwater practices as approved by the Wetlands Unit as well as
drainage patterns must be maintained in perpetuity.
• No changes to the structural stormwater practices shall be made without written
authorization from the Division of Water Quality.
5. Compensatory stream mitigation shall be required at a 1:1 ratio for all perennial and
intermittent stream impacts equal to or exceeding 150 feet and that require application to
DWQ in watersheds classified as ORW, HQW, Tr, WS-1 and WS-11;
6. In accordance with North Carolina General Statute Section 143-215.3D(e), any
application for a 401 Water Quality Certification must include the appropriate fee.
If a project also requires a CAMA Permit, one payment to both agencies shall be
submitted and will be the higher of the two fees;
7. In accordance with 15A NCAC 2H .0506 (h) compensatory mitigation may be required for
impact to 150 linear _feet.or more of streams and/or one acre or more of wetlands. For
linea lic transportationproject% impacts equal to or exceeding 150 feet per stream
may require mitigation. In addition, buffer mitigation may be required for any project with
v Buffer Rules in effect at the time of application for buffer impacts resulting from activities
' classified as "allowable with mitigation" within the "Table of Uses" section of the Buffer
Rules or require a variance under the Buffer Rules. A determination of buffer, wetland
and stream mitigation requirements shall be made for any Certification for this Nationwide
Permit. The most current design and monitoring protocols from DWQ shall be followed
and written plans submitted for DWQ approval as required in those protocols. When
compensatory mitigation is required for a project, the mitigation plans must be approved
by DWQ in writing before the impacts approved by the Certification occur, unless
otherwise specified in the approval letter. The mitigation plan must be implemented and/or
constructed before any permanent building or structure on site is occupied. In the case
of public road projects, the mitigation plan must be implemented before the road is
opened to the travelling public. Projects may also be implemented once payment is made
to a private mitigation bank or other in-lieu fee program, as specified in the written
concurrence of 401 Certification for a project. Please note that if a stream relocation is
conducted as a stream restoration as defined in The Internal Technical Guide for Stream
Work in North Carolina, April 2001, the restored length can be used as compensatory
mitigation for the impacts resulting from the relocation;
For any project involving re-alignment of streams, a stream relocation plan must be
included with the 401 application for written DWQ approval. Relocated stream designs
should include the same dimensions, patterns and profiles as the existing channel, to the
maximum extent practical. The new channel should be constructed in the dry and water
shall not be turned into the new channel until the banks are stabilized. Vegetation used for
bank stabilization shall be limited to native woody species, and should include
establishment of a 30 foot wide wooded and an adjacent 20 foot wide vegetated buffer on
both sides of the relocated channel to the maximum extent practical. A transitional phase
incorporating coir fiber and seedling establishment is allowable. Also, rip-rap may be
allowed if it is necessary to maintain the physical integrity of the stream, but the applicant
must provide written justification and any calculations used to determine the extent of rip-
rap coverage requested. If suitable stream mitigation is not practical on-site, then stream
impact will need to be mitigated elsewhere;
9. Placement of culverts and other structures in waters, streams, and wetlands must be
placed below the elevation of the streambed to allow low flow passage of water and
aquatic life unless it can be shown to DWQ that providing passage would be impractical.
Design and placement of culverts including open bottom or bottomless arch culverts and
other structures including temporary erosion control measures shall not be conducted in a
manner that may result in aggradation, degradation or significant changes in hydrology of

Public hearings may be held for specific applications or group of applications prior to a
Certification decision if deemed in the public's best interest by the Director of the North Carolina
Division of Water Quality.
