APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. White:
You have our approval, in accordance with the attached conditions, to dredge, fill and/or shade 0.1 acre of non-
vegetated wetlands in order to construct an addition to an existing pier, an addition to the permitted channel adjacent to the
boatramp and a pedestrian bridge over coastal wetlands on your property at the Rivers Edge Campground in Pamlico
County, as described in your revised application received by the Division of Water Quality on December 20, 2003. After
reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400,
which can be downloaded from our web site at htto:Hh2o.enr.state.nc.us/ncwetlands . This Certification allows you to use
your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Non-Discharge, Water Supply Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will
expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed;
2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be
performed so that no violations of state water quality standards, statutes, or rules occur;

4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the date that the Division of Land
Resources has released the project;
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
1506 of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

SUBJECT: MINOR MODIFICATION - CAMA MAJOR PERMIT #26-02

Please find enclosed a request from Mr. Frankie White requesting a modification to CAMA
Major Permit #26-02 to allow for the construction of an 8' by 76' addition to the existing pier, a
50' by 20' addition to the permitted channel adjacent to the boatramp and a 6' by 100' pedestrian
bridge over coastal wetlands at the Rivers Edge Family Campground adjacent to the Bay River
off NCSR 1217 in Maribel, near Vandemere in Pamlico County, NC.
This permit was originally issued on March 7, 2002, for the construction of a 15' by 35'
boatramp, a 50' by 40' access channel, a 128' long bulkhead, a 5' by 200' pier with an 8' by 50'
T-head and a 186- site campground. The boatramp, channel, pier, bulkhead and portions of the
campground have already been constricted. Following construction of the boatramp, the
applicant observed that it is difficult to unload boats and navigate out of the channel during low
water events. Because the Bay River tides are wind-driven, it is common to have low water for
several days at a time in the project area. The applicant proposes lengthening the access channel
in an attempt to avoid accidental kicking of the river bottom by boaters using the boatramp. The
applicant has also recently obtained the adjacent parcel of land and proposes to constrict an
elevated pedestrian walkway to provide access across coastal wetlands to the adjacent property.
The applicant proposes to expand the existing platform on his pier by adding an 8' by 76'
extension waterward of the existing stricture. This would maximize the platform size allowable
for his property.
The applicant has submitted the $100 modification fee. After thorough review and a 12
November 2003 on site inspection, I have determined that this proposal is consistent with 15A
NCAC Subchapter 07H.0208(b)(6). And following our 17 November 2003 telephone
conversation, I recommend the Minor Modification be authorized and that all original conditions
of the issued permit remain in effect. I also recommend that the following conditions be added to
the modified permit:

elevated a minimum of 36" above the marsh substrate.

Dear Tracey,
Due to the extremely low water levels all year, I am requesting permission to extend my
access channel another 50 feet. This will allow me to have 3.5 feet of water depth and
eliminate the possibility of boats accidentally kicking the river bottom.
I would also like to request permission to build a 6 foot walk bridge over marsh area to
allow access to adjoining property purchased in year 2003.
I also seek permission to extend my pier tee another 8 x 76 feet. My river frontage totals
268.20 feet. f 3w,

this fill is covered by General Water Quality Certification Number 3274, which can be downloaded from our web site at

Coastal Management. This approval is also valid for the Tar-Pamlico River Buffer Rules (15A NCAC 26 .0259). In addition, you should

Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit

Project Setting
The applicant owns a 12.7 acre parcel of land adjacent to the Bay River near Vandemere in Pamlico
County, North Carolina. The property is located on the north shore of the Bay River adjacent to Tempe Gut, off
of NCSR 1217. The site is undeveloped and has recently been logged. A natural border remains along the eastern
edge of the property and along the existing gravel road to the north. These areas are vegetated with pine trees,
mixed hardwoods, and mixed woody underbrush. The 128 foot long shoreline has not been stabilized and is
eroding, creating a 1-2 ft erosion escarpment along the clay bank. There is a small gut vegetated with coastal
wetland species that enters the property on the eastern edge. Dominant species include Spartina cynosuroides,
Spartina atens, Distichlis isp cats, and Juncus roemerianus. This area transitions up to a freshwater wetland
vegetated with a mix of wax myrtle, red maple, sweet gum, and pines.
The property is bordered on the west by a developed residential lot with a single family residence. The
shoreline is protected with extensive riprap, and there is an existing pier on the property. The lot is vegetated with
a mix of upland grasses, landscaped areas, and naturally occurring woody vegetation. There is a single-lane dirt
road immediately to the north of the property that provides access to the residences upstream of the project site.
The property to the east is an undeveloped wooded lot. The Bay River forms the southern property line. At this
location, the Bay River is shallow with a gently sloping clay bottom. Water depth at the end of the proposed pier
is approximately -5.5' NWL. There is no submerged aquatic vegetation at this site.
The Bay River is classified SC SW NSW by the Environmental Management Commission and is not
open to shell fishing at this location. The property is located in the Neuse River Basin, and is subject to the
Environmental Management Commission's Neuse River Basin Nutrient Sensitive Waters Management Strategy.
Project Description
The applicant proposes develop a family campground adjacent to the Bay River. He proposes to grade
the property to provide level campsites for 186 campers. A gravel road would provide access to the campsites,
and boatramp. Two shelters and one building are proposed to house an office, bathrooms, and picnic tables. A 35'
by 15' boatramp and 50' by 40' access channel would provide boating access to the river. Resulting spoil
material will be disposed of on the adjacent highground where it will be graded and stabilized with vegetation.
Approximately 128' of vertical bulkhead is proposed to protect the shoreline adjacent to highground, and 35' of
rock riprap is proposed waterward of the coastal wetland. A 5' by 200' pier with a 50' by 8't-head is proposed to
the east of the boatramp.
Anticipated Impacts
The project as proposed would impact 557,568 ftz. Most of the 12.4 acre plot will be graded for
construction of the campground. Construction of the boatramp and access channel would require the excavation
of 2,525 ftZ of shallow river bottom. Installation of the bulkhead and riprao would cause the filling of 431 ft2 of
river bottom. Approximately 1,400 ftZ of river bottom would be shaded following the construction of the pier and
platform. Localized short-term turbidity increases would result from construction activities in the water.

Management (DCM) dated November 29, 2001 to construct the proposed bulkhead, pier and boat ramp at the subject property. The
DWQ has determined that the proposed project will require written authorization for impacts to riparian areas protected under the Neuse
Buffer Rules (15A NCAC 2B .0233). In order to issue this authorization the DWQ must ensure that your project meets the No Practical
Alternatives test required under these rules. Insufficient evidence is present in our files to conclude that your project must be built as

and will place this project on hold as incomplete until we receive this additional information. We are requesting (by copy of this letter)
that the U.S. Army Corps of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must be constructed as planned and that you
have no practicable alternative to impacting these protected riparian buffers. Specifically;
I. It is unclear given the information provided in your application as to the need for the shoreline stabilization. Please provide
additional information for the need to bulkhead the existing shoreline. Photos of the existing shoreline would be helpful.
Please provide additional information stating why other alternative means of stabilization that have less impact on the
protected buffers (such as non-structural marsh creation, sills or breakwaters) can not be used in place of the proposed
bulkhead.
2. Please provide additional information as to how you intend to protect the existing vegetation within Zone 1 of the 50-foot
protected buffers.
This letter only addresses the application review and does not authorize any impacts to wetlands. waters or protected buffers.

Dear Mr. Huggett:
Reference the application of Franklin White for a Department of the Army (DA) permit
to develop a family campground, including construction of a boatramp, access channel, pier,
bulkhead, and riprap, on property located off State Road 1217, adjacent to the Bay River, near
Vandemere, in Pamlico County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the application
and your field investigation report.
We recommend that the following conditions be included in the State authorization:
All work authorized by this permit must be performed in strict compliance with the
permit plans, which are a part of this permit.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized,
or if, in the opinion of the Secretary of the Army or his authorized representative, said structure
or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate,
or alter the structural work or obstructions caused thereby, without expense to the United States.
No claim shall be made against the United States on account of any such removal or alteration.
3. All backfill materials will be obtained from a highground source and confined landward
of the permitted bulkhead.

4. All excavated materials will be confined landward of the mean high water (MHW)
elevation contour within adequate dikes or other retaining structures to prevent spillover of solids
into any vegetated w tlands or surrounding waters.
5. No vegetated wetlands will be excavated or filled.
6. Excavation will not exceed -3 feet below the elevation of mean low water (MLW).
7. The temporary placement or double handling of excavated or fill materials within waters
or vegetated wetlands are not authorized.
8. The fill material will be clean and free of any pollutants except in trace quantities. Metal
products, organic materials, or unsightly debris will not be used.
9. No attempt will be made by the permittee to prevent the full and free use by the public of
all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.

On July 24, 2000, we renewed General Permit No. 198000291 (copy enclosed), which
provides Federal authorization for construction activities that receive authorization from
the State of North Carolina.
A review of your application received January 2, 2002, for Department of the Army (DA)
authorization to develop a family campground, including construction of a boatramp, access
channel, pier, bulkhead, and riprap, on property located off State Road 1217, adjacent to the
Bay River, near Vandemere, in Pamlico County, North Carolina, indicates it to be a candidate
for Federal authorization under this general permit. Accordingly, the administrative processing
of your application will be accomplished by the North Carolina Division of Coastal Management.
Comments from Federal review agencies will be furnished to the State.

will be informed regarding its further management. If there are no unresolved differences in
State-Federal positions or policies, the final action taken on your application by the State will
result in your receiving written notice from us that your application is consistent with the general
permit and you may commence your activity. Only after receiving such confirmation should you
begin work.
