You indicated concern over the length of the driveway and suggested shortening the drive to reduce wetland impacts. The site plan has now been revised and the home site shifted 20' towards Marsh Grass Court. This reduces the driveway length from 96' to 76'. The driveway width has also been reduced from 12'-wide to 10'-wide. Together, these changes minimized total driveway area from approximately 1306 ft to 936 ft2. As discussed, road-side ditches are present along both Cottage Creek Road and Marsh Grass Court. Both carry substantial amounts of water, with flow moving from Cottage, Creek Road to Marsh Grass Court. The building contractor indicated that any driveway accessing the lot from Marsh Grass Court would need to be culverted over this ditch. The drive was originally planned at the southern-most edge of the property, in an attempt to locate the culvert as far away from the corner as possible. It was thought that any pipe located too close to the corner, where flows slow, would accumulate sediment and need frequent repair. However, to further minimize wetland impacts, the driveway and the location of this culvert has now been shifted to abut the southern edge of the existing pad. This allows the driveway to partially utilize the existing pad without placing it too close to the corner. This further minimizes the area of wetland impact for the driveway from 936 ft2 to 848 ft2. At C _Oax ,2522 dmai?e?/an, ?Ym& na 28402 6, d. 9.-0-452-0009 r The overall landscape of this area often carries large volumes of water and appears to flow in the direction of Marsh Grass Court. With the road-side ditches directing a good bit of this water around the SW corner of this lot, the applicants would like to keep the house off the road fronts and as near lot #84 as possible. As you know, when Indigo Plantation was subdivided in the early 1980's, a minimal amount of fill was allowed on lots which were mostly or entirely wetland. This was intended to provide a minimal area for parking and access. On most of the lots, it appears the dirt was delivered to the lots but never spread over the intended area. That is case here, and the small fill pad is located in the SW corner with approximately one-third its area in the front building setback. Since this upland area would never be useable for the purpose it was intended, we would like to remove the area of fill now located in the front setback and returned to the adjacent wetland grade. This would be an attempt to offset wetland fill needed for the driveway, by relocate unusable fill so that it is useable for its intended purpose. Removal of the fill pad within the setback could provide 265 f12 of restored wetland area. With this area offsetting the total driveway fill of 848 ft2, a balance of 583 fl of wetland would be filled for driveway construction. A jurisdictional determination was made in 1991, with subdivision development. A Corps site visit in 6/2001 confirmed wetland limits have not changed. At the time of subdivision, sand was placed on SW corner of lot for an intended 0.1-acre upland area for minimal parking needed for a single family residence. However, dirt was never spread across 0.1-acre area and pad is now only 0.02-acre in size. V. Future Project Plans Are any additional permit requests anticipated for this project in the future? Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The lot is virtually 100% jurisdictional wetland, and the proposed house would be constructed on pilings (roughly 9' above the wetland surface) to avoid direct fill. No lattice work or underpinning would be installed, in order to allow sunlight to reach the wetland surface. A minimal amount of wetland fill is requested for a drivewu, parking underneath the house, and a utility room underneath the house. The only upland on the lot is a man-made dirt pad which was Page 7 of 12 placed on the SW comer of the lot after the original 1991 wetland delineation. Although this was intended to provide an upland area suitable for future parking, the dirt was never spread pad across the lot and the12ad is now only 25' x 40' in size. Furthermore the location of this dirt in the SW corner of the lot makes it an impractical location for the driveway. Road-side ditches along both of the roads which abut this corner lot carry considerable amounts of water. Any driveway into the lot will need to be culverted over one of the road-side ditches. Due to the landscape, the ditch along Cottage Creek Road and particularly at the corner of Cottage Creek and Salt Marsh Court, is consistently full. Placing a driveway at this corner would be expected to restrict flow and cause sediment build-up. Therefore the proposed driveway has been located along the very southern end of the existing pad, to place it as far away from the corner as possible and still utilize a portion of the existing fill. An alternative analysis has been done, and the originally preferred siting of the house has been relocated to shorten the drive width. Mitigation to offset the remaining impacts is offered through the removal of the existing fill located within the building setbacks. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/newetlands/strmgide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a Page 8 of 12 description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. In-formal mitigation offered with the removal of the unusable portion of the existing fill pad located within the building setbacks. This is intended to reduce the total balance of wetland fill on the lot. 2.
