As I stated in our conversation my coordination with the consultant on this work has been hindered by my recent work related absence from the NC area. You indicated that we need to respond to your questions within a three week time period. At this time 1 would like to ask for an extension of that deadline. I have been in contact with a private consultant regarding delineation of the wetland area and exact linear footage of each impacted tributary. Once the consultant gives me an estimate of his costs, I will have to get financial approval fi-om the property owner's association before I can move forward. Therefore, it will be imperative that we receive additional time to respond to your letter. If the Property Owner's Association agrees to a consultant, then based on those results, we will make a decision on whether or not to proceed with our application. Lamar Sheppard, The Glen at Laurel Springs Subdivision, Unnamed Tributary to Prathers Creek (?), Alleghany County The applicant is requesting a letter of concurrence from. the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The applicant proposes to dam and flood headwater tributaries to the New River west of New I-lope Road (north) with a 7-acre lake. Mr. Kin Hodges, Fish biologist, and I conducted a site visit on February 23, 2001. The area for the proposed lake did not appear to support fish. However, the area contained more wetlands and streams than indicated in the application. Although snow still covered the ground, wetland seeps appeared to be a significant feature of the landscape, especially in the area proposed for the upper shallow portions of the proposed lake. Maples, ironwood trees, sedges, mosses, and skunk cabbage plants were observed. Other typical wetland indicators appeared to be present in the seep areas. It appears that the wetland seeps on this site are important salamander habitat. These wetlands also provide habitat for deer, foxes, squirrels. There are thirteen state or federally listed species in Alleghany County. The NC Natural Heritage Program and the US Fish and Wildlife Service should be contacted to determine if any listed Endangered, Threatened, or Species of Concern may be present prior to the issuance of any permits. After reviewing the subdivision plans, it appeared that many small (1/2 acre) lots and some larger lots (1 acre) are to be developed upslope of these waters. Some of these lots appear to be too small for traditional on-site sewer treatment and disposal even if they have satisfactory soils. We are concerned that flooding from a large lake will destroy the wetland habitats. The large size of the proposed lake and dam may require additional approvals by the NC Division of Land Resources pursuant to dam safety requirements. We recommend that the applicant consider building a smaller impoundment. Roughly 3 acres could be flooded using the proposed dam location. This would impact mostly perennial streams. The wetland seeps and associated forest could continue providing habitat functions as well as recharge water for the impoundment. A natural setting would remain above the pond where residents could enjoy wildlife viewing and nature studies. Based on our visit, the information provided by the applicant, and our knowledge of trout in the area, we do not believe the impoundment will cause significant effects to waters supporting trout providing the pond has a cold water (bottom) release and there is a minimum release requirement. Should the impoundment be permitted, we urge the inclusion of littoral shelves and shoreline vegetation for safety and edge habitat enhancement. Impoundment banks may be vegetated with silky dogwood, silky willow, tag alder, black willow, maple, ironwood, sycamore or a blend of other native species to provide long term bank stability and shading.
