G^GJP ?ATFR OUP: I F} c Reference is made to your application of July 17, 2000, for a Department of the Army permit to authorize the proposed discharge of 1.68 acres of fill material and relocation of approximately 500 linear feet of stream channel associated with the construction of a building, and parking and loading areas for the Reser's Fine Foods distribution facility, located northwest of the intersection of NC Highway 903 and Aurelian Springs Road (SR 1600), west of Halifax, Halifax County, North Carolina. Reference is also made to the Pre-Construction Notification (PCN) of July 28, 2000, submitted by Green Engineering on behalf of the County of Halifax, requesting Department of the Army (DA) permit authorization to discharge excavated and fill material into wetlands adjacent to Quankey Creek and unnamed tributaries of Quankey Creek to effect the construction of sanitary sewer improvements along the I-95 right of way, north side of NC Highway 903, and SR 1600 to provide sanitary sewer service to Reser's Fine Foods. Based upon your application, you propose to place fill into wetlands and relocate approximately 500 linear feet of an unnamed tributary of Quankey Creek into a ditch at the base of the fill along the side of the property to allow for construction of a building, truck loading and parking facilities. The proposed work will result in adverse impacts to 1.68. acres of jurisdictional waters of the United States, including wetlands, adjacent to Quankey Creek and unnamed tributaries of Quankey Creek. During a preliminary site visit on August 1, 2000, Mr. Todd Tugwell of my staff noted that construction of the facilities on the site had already been initiated, and observed that fill material had been placed within an approximately 0.33-acre area delineated as wetlands on your application and included as wetland impacts in your DA permit application. However, based upon recent coordination with Mr. James Taylor, your consultant, there appears to be some V. confusion as to the accuracy of the wetland delineation included with your application, and accordingly, a question as to whether wetlands have actually been filled. An accurate delineation of the project site must be completed as expeditiously as possible to determine if fill activities have occurred in wetlands, and the permit application modified as appropriate (i.e., either modify the wetland delineation plat or accurately depict the existing wetland fill). You and/or your consultant should coordinate closely with Mr. Todd Tugwell of my staff who will be confirming the delineation. In regards to the referenced PCN for Halifax County's proposed extension of sewer service to your project site, the anticipated jurisdictional impacts to waters of the United States, including wetlands, associated with this work are directly related to your project. Accordingly, your permit application must also be modified to include these impacts. Your DA permit application of July 17, 2000, is incomplete and can not be processed until it has been modified to include all jurisdictional impacts associated with the extension of sewer service to your property and accurate wetland delineation/fill information as discussed above. Please be aware that any placement of fill material into jurisdictional waters of the United States without authorization by a DA permit will be considered a violation of Section 301 of the Clean Water Act (33 U.S.C. 1311). As for construction on high ground, any work that has been accomplished, is underway, or is proposed in reliance of anticipated DA approval of your permit application currently under review has been/will be accomplished entirely at your own risk. On February 6, 1990, the DA and the US Environmental Protection Agency (EPA) signed a Memorandum of Agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your pending application in full compliance with this MOA, we request that you provide the following information in support of your permit application which is currently under review: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives to the placement of fill into 1.68 acres of wetlands for the proposed construction. Specifically, this information should include the use of other properties within the general vicinity of the proposed facility that could be utilized for the same purposes with fewer impacts to waters of the United States. 2 b. It is necessary for you to have taken all appropriate and practical steps to minimize wetland losses. Please indicate all that you have done, especially regarding the modification of plans and proposed construction techniques, to minimize adverse impacts (i.e., to reduce the discharge of fill material into waters of the United States as much as practicable). Your response should address alternate building layouts on the currently proposed site that may result in reduced impacts to aquatic resources. c. The MOA requires that appropriate and practical mitigation will be required for all unavoidable adverse impacts remaining after all appropriate and practical minimization has been employed. Please indicate your plan to mitigate for the projected, unavoidable loss of waters (to wetlands as well as stream channels), or provide information as to the absence of any such appropriate and practical measures. This information is essential to our expeditious processing of your permit application. Also, a copy of this information should be sent to the North Carolina Division of Water Quality to enable them to adequately evaluate your application for a Water Quality Certification pursuant to Section 401 of the Clean Water Act.
