Stevens Division of Water Quality CERTIFIED MAIL RETURN RECEIPT REQUESTED Mr. Donnie Spain 1305 East Tenth Street Greenville, N.C. 27845 Dear Mr. Spain: January 11, 2001 JAN 1 7 2001 Subject: Letter of Recension Tar/Pamlico Buffer Requirements Pitt County On 22 November 2000, this office sent to you a letter which exempted your construction project on East Tenth Street in Greenville, N.C. from the requirements of the Tar - Pamlico Riparian Area Protection Rules. The project which you proposed in November was to remove two (2) flood damaged apartment buildings and construct two (2) new buildings on the same property. According to the sketch plan you submitted, the two (2) new buildings would be constructed in a manner which would have less impacts to the buffer zone than the existing buildings. The rectangular shaped existing buildings are constructed parallel to the bank of Green Mill Run. The proposed buildings, as per the sketch plan submitted, were to be constructed perpendicular to the bank of the creek leaving more open space between the buildings allowing for sheet flow over a non-paved area of stormwater runoff. On 9 January 2001, this office received a copy of a site plan submitted by you to the City of Greenville Planning and Development Department for construction of the two (2) buildings. This plan was submitted with a copy of the letter of exemption I sent to you in November, 2000. The plan submitted to the City of Greenville is not the same plan reviewed by this office. This modified plan has one (1) of the buildings positioned perpendicular to the bank of the creek but the other building is positioned parallel to the bank of the creek. The building positioned parallel to the bank of the creek is proposed to be constructed ten feet closer to the property line which would require removal of area which is presently vegetated. There is also a retaining wall which is proposed to be constructed parallel to the bank of the creek from 2 feet to 15 feet from the channel. The project as proposed to the City of Greenville recently, is not exempted from the requirements of the Tar - Pamlico Riparian Area Protection Rules. The property contained two apartment complex buildings (one story, 4 units each). The apartments where destroyed during Floyd. The owner has since sold the property to another developer (Herbert d. Powell) who wants to rebuild. We told them that if they stay w/n the footprint of the existing apartments and don't add addition impervious surface that they would be considered an existing use and allowed to rebuild. However, the new owner wants to totally rework the site. They are required by the City to raise the grade of the property which will require a retaining wall and fill within Zone 1 of the buffers. The new owner also wants to replace the existing two apartment buildings with two larger buildings (3-stories; 12 units each; instead of the existing 1 story, 4 units each) which will add impervious surface in Zone 1. He is claiming that the larger buildings would be required for economic reasons. The new impervious surface within the Zone 1 and 2 and the grading/fill and retaining wall within Zone 1 will require a Major Variance. We told them that if they handle stormwater and provide mitigation that we would not be opposed to the variance. I told the consultant that I would pass a quick question on as. to whether or not the proposed project can be considered an existing use since the City is requiring that they raise the grade in order to rebuild. I would appreciate any comments and opinions.
