On June 18, 2002, Ms. Debtie Edwards of the DWQ, and I ewcd the channel features on the property.
It was determined that the features labeled D, E and F on attached map were not subject to the Neuse
Buffers. It was also determi ied that the feature labeled A, B and C (below flags CM
72) are subject beginning at the points shown on the attached map- (see Neuse River Buffer Rules below),
Ms. Edwards will be gendinf written confmnation of his findings.
Neuse River Buffer Rules
The Neuse River Buffer rule:, which came into effect on 7/22/97, protect up to 50 feet from the edge of
existing "surface waters" (irn ermittent streams, perennial streams, lakes, ponds and estuaries) found within
the Neuse River Basin. The 50-foot buffer basically consists of two zones- The Gat zone is measured 30
feet landward from the top b utk of streams and intended to contain an undisturbed-forested area. The
second zone is measured 20 feet from the edge of the first zone and is intended to contain a vegetated
buffer. A couple of notable points of the rules include; the allowance of grading with re-vegetating within
Zone 2 (the outer 20 feet) an,i the requirement of mitigation for road crossings greater than 150 feet in
width and utility lines rurminq- parallel and within the buffers. Please call if you would like to discuss these
new changes.

Request that the USACE veri Cy our delineation and (2) Notification to the USACE and DWQ regarding
impacts to wetlands and permitting issues, if required- This additional work can be completed at our hourly
rates or a proposal can be generated. Please advise.

On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A
NCAC 2B.0233)
Dear Mr. Preuninger:
On June 18, 2002, at your request I conducted an on-site determination to review 6 features located on the
subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The features are
labeled as "A, B, C, D, E and F" on the attached maps.
The Division of Water Quality (DWQ) has determined that the surface water labeled as "A, B and
C" on the attached map are subject to the Neuse Buffer Rule, the origin of these features have been
delineated in the field and identified as: Feature A is subject throughout the property, however this
feature stops at flag #1000; Feature B is subject from the property boundary through to the
confluence of feature A; and the origin of feature C is flag #CM72. Features D, E and F are not
subject to the Neuse Buffer Rule. (Please Note: the feature located just beyond the eastern property
boundary has been impounded by beaver, this feature was not evaluated in the field and according to
the Neuse Buffer Rule, the 50' Riparian Buffer is measured from the normal water level of the
impounded beaver pond) These features and their associated buffers should be identified on any future
plans for this property. The owner (or future owners) should notify the DWQ (and other relevant
agencies) of this decision in any future correspondences concerning this property. This on-site
determination shall expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local
Authority that a surface water exists and that it is subject to the buffer rule may request a determination
by the Director. A request for a determination by the Director shall be referred to the Director in writing
c/o John Domey, DWQ Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. Individuals
that dispute a determination by the DWQ or Delegated Local Authority that "exempts" a surface water
from the buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start
until the affected party (including downstream and adjacent landowners) is notified of this decision.
DWQ recommends that the applicant conduct this notification in order to be certain that third party
appeals are made in a timely manner. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail
