Control of sources of water pollution; permits required. • DEMLR has no record of past violations for Smokey Mountain pallet within the past 5 years. • DEMLR has no record that the violations were committed willfully or intentionally. DEMLR observations revealed discharges of stormwater to the surface waters of North Carolina. Waterbodies receiving stormwater from the facility include: 1) Patton Cove Creek, a Class C waterbody in the French Broad River Basin. 2) An unnamed tributary of the Swannanoa River, a Class C waterbody in the French Broad River Basin. April 24, 2019 Notice of Violation (hereby known as NOV) was issued to Smokey Mountain Pallet, Inc. May 6, 2019 DEMLR records indicate that the NOV was delivered (certified mail confirmation) August 2, 2019 The Notice of Recommendation for Enforcement Action (hereby known as NORE) was issued to Smokey Mountain Pallet, Inc.
