This permit, issued on March 14, 2005 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
DockinE Facility
1) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
2) This permit authorizes only the docks, pier, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over public trust
waters without permit modification.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires fiuther Division approval.
All work must cease when the permit expires on
December 31, 2008
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.
4) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking: F
5) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and must be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
6) The roof of the covered platform shall not be designed for second story use.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
9) This permit shall not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
10) This permit authorizes a maximum of 3 boat slips. At no time shall more than 3 vessels be moored or
docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types,
including but not limited to motorboats, sailing vessels and personal watercraft.

11) This permit does not authorize the excavation or filling of any vegetated wetlands or open water areas,
even temporarily.
NOTE: The Division of Marine Fisheries has suggested.the following modifications to the project design
in an effort to protect Submerged Aquatic Vegetation habitat.

approvals or authorizations that may be required, including but not limited to a building permit
for the Town of Morehead City.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No.
041910.

9. NARRATIVE DESCRIPTION:
The Sloan proposal is located off Hwy. 24 at 227 Lands End Road, adjacent to Bogue Sound, in Morehead City,
Carteret County, within the community of Spooner's Creek. Turn left off Hwy. 24 onto Harbor Drive (SR 1268),
and go to the end of Land's End Road. Take a right and go to the last house on the left. The high ground area of
the site is 1.39 acres. The applicant states that the elevation ranges from 0'-20' above MHW. Existing features
on the site include a house with driveway, landscaped yard with trees and shrubs, and a grass yard to an
existing bulkhead. A 202' long pier extends into Bogue Sound from the west end of the bulkhead.
East of the project site is a dock measuring approximately 75' in length; to the west there is a dock
approximately 375'- 400' in length. The stabilized shoreline at the site measures 250' and separates the yard
from the marsh. The marsh in front of the bulkhead consists of a 28'± span of high marsh comprised mostly of
Juncus roemerianus. There is approximately 16' of low marsh between the open water and.the high marsh
consisting mostly of S artina alterniflora. The edge of the low marsh closest to the bulkhead delineates the
NHW line. The water body is Bogue Sound and is adjacent to the AIWW. The federal channel is several
hundred feet waterward of the project site. The substrate in the project area is sandy and has a significant
amount of SAV's. The end of the proposed pier would be located seaward of the SAV's.
The waters at the site are classified by the DWQ as SA. Bogue Sound at this location is closed to shellfishing,
and is not classified by the DMF as a Primary Nursery Area. The Town of Morehead City classifies this site as
Developed, and all AEC'S as Conservation. Bogue Sound is in excess of 2 miles across at the project site.
The applicant proposes to remove the existing pier and docking system and replace it with a longer pier and
docking system, necessitating a CAMA Major Permit. The length of the proposed pier is 452' from the marsh
edge, or 468" from the normal high water contour. Waterward of the proposed 452' walkway, a 19.5'x 18'
platform with a 13.5'x 14' roof is proposed. The total distance offshore from the marsh edge would be 471.5'.
A 15'x 15' boatlift is proposed on either side of the of the platform. A 4'x 12' platform and steps leading to a
third lift are proposed at the mid-point of the dock. This would give the new dock three boat slips as proposed.
The structure would be 19' from the riparian property line to the west and 198' from the riparian property line to
the east. The end of the pier would be beyond the neighboring piers, however there are piers within a quarter of
a mile east and west along the shoreline of similar lengths into the water body. The water depths range from -8"
200' from the marsh (at NLW) to -30" at the end of the proposed dock (at NLW). The proposal represents an
overall project extension of ±285'. There is no high ground development associated with this project.
10. ANTICIPATED IMPACTS:
The area of marsh impacted will be in the form of 264 sf of shading. The open water impacts will include 3505
sf of public trust area that will be usurped and 3111 sf of that area will be shaded. No navigational impacts
would be expected due to the established pier lengths in the area, and the distance of the project terminus from
the AIWW. There are SAWS that may be impacted by either washing or pile driving. The additional project
depth around the docking facility that will be accomplished by the project extension may recognize a positive
impact to SAV's. If barge work is performed at high tide, impacts can be minimized. Some turbidity can be
expected during construction, however they should be short in duration.

INTRODUCTION Morehead City C
The Sloan residence is located on the north shore of Bogue Sound west of the mouth of Spooner's Creek
at 227 Lands End Road in Morehead City, Carteret County, North Carolina. The applicant proposes to
improve an existing pier and extend the pier out to water depths that will permit them to float and dock a
small boat. The site can be reached by going west on N.C. Highway 24, turning left onto Harbor Drive
and then right on Lands End Road at the end of Harbor Drive (see sheet 1 of Drawings). The site is
currently developed with a residence on the upland portion, an existing bulkhead along the shoreline
landward of a healthy stand of coastal wetlands between the bulkhead and the water. The property has
approximately 250.4 linear feet of estuarine shoreline on Bogue Sound measured along the property line
(see sheet 2 of 6). Remnants of a pier, several old timber piles, remain.
PROJECT DESCRIPTION
The project consists of the following elements:
• Removal of the existing platform and floating dock at the end of the existing pier.
• Widen approximately 153 feet of pier currently 5 feet wide to a width of 6 feet.
• Extend the 6 foot wide pier south an additional 294 feet.
• Construct a tee head 19.5 feet long and 18 feet wide that includes a platform at elevation 5.0, a
smaller platform seaward of the main deck, 6 feet wide and 18 feet long, at elevation 3.5 NGVD.
• Construction ofLoat lifto accommodate a boat up to 30 feet long on the east side of the main
platform at the end of the pier.
• Construction of an articulated stairway and lift at the location of the existing pier, at the
approximate halfway point on the new pier.
EXISTING CONDITIONS
The site is currently developed with a residence on the upland portion, an existing bulkhead along the
shoreline landward of a healthy stand of coastal wetlands between the bulkhead and the water. The
property has 250.4 linear feet of estuarine shoreline on Bogue Sound measured along the property line
(see sheet 2 of 6). There is evidence that a pier existed at one time of a length similar to that proposed in
this application. Remnants of a pier, several old timber piles, remain near the proposed location of the
new platform.
Submerged aquatic vegetation (SAV's) inhabit a significant portion of the shallow bottom areas offshore
of the coastal wetlands and seaward to an elevation of approximately -2.5. The improvements proposed
will minimize impact to the SAVs. The tee head platform proposed will be located seaward of the extent
of SAV's.

STORMWATER MANAGEMENT
No upland improvements, pavements or walkways are included in the project. No stormwater
management or additional stormwater measures will be required for this project. A letter will be sent to
the Division of Water Quality in Wilmington informing the Division of the scope of the project.
METHODS OF CONSTRUCTION
Pier and platform components will be of timber frame construction meeting the requirements of the North
Carolina Building code. Pier installation will be by conventional marine construction methods floating
barge. and crane. Working at higher tide conditions will be necessary to minimize damage to SAV's
during construction.
PROJECT SCHEDULE
After the required CAMA Major permit is obtained, construction of the project will require three months. It
is anticipated that work will be completed before April 30, 2005.
COMPLIANCE WITH COUNTY OF CARTERET ZONING AND CAMA LAND USE PLAN
The property is within the planning jurisdiction of the Town of Morehead City. Zoning is R20 residential.
The improvements are consistent with the current zoning. The site is classified "Developed" by the Town
of Morehead City CAMA Land Use Plan.
COMPLIANCE WITH THE N. C. ENVIRONMENTAL POLICY ACT
There is no work proposed on the site that will require review under the N. C. Environmental Policy Act.

On behalf of Hamilton Sloan, we respectfully submit the attached application documents for a Major
CAMA Permit for the referenced project. Included with this submittal are application documents,
drawings, project Narrative and a check for $250.00.
The work in this modification includes the following:
• Removal of the existing platform and floating dock at the end of the existing pier.
• Widen approximately 153 feet of pier currently 5 feet wide to a width of 6 feet.
• Extend the 6 foot wide pier south an additional 294 feet.
• Construct a tee head 19.5 feet long and 18 feet wide that includes a platform at elevation 5.0, a
smaller platform, seaward of the main deck, 6 feet wide and 18 feet long, at elevation 3.5 NGVD.
• Construction of.%boat lift-to accommodate a boat up to 30 feet long on the east side of the main
platform at the end of the pier.
• Construction of an articulated stairway and lift at the location of the existing pier, at the
approximate halfway point on the new pier.
