On April 14, 2014, the Division of Energy, Mineral and Land Resources received your request to rescind
your coverage under Certificate of Coverage Number NCG 140306. In accordance with your request,
Certificate of Coverage Number NCG 140306 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters
of the State without valid coverage under an NPDES permit is against federal and state laws and could result
in fines. If something changes and your facility would again require stormwater or wastewater discharge
permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the
proper permit coverage. If the facility is in the process of being sold, you will be perfonning a public service
if you would inform the new or prospective owners of their potential need for NPDES permit coverage.

Hi Johnny,
With some fancy database help frorn my supervisor, we've reinstated your permit. it appears that Ceinex did not pay
the bill for 2009 (before it was withdrawn) and that appears to be overdue. If you have some proof or reasoning why
you should not be paying for that, we will obviously take that into consideration. Let me know about that. We obviously
will not bill you for 2010 — and I will speak to the billing woman about that to ensure that doesn't happen.
Sorry again this happened. I believe it was a misunderstanding on our part. As we spoke about on the phone, if you
believe your site is truly like a "parking lot" with no sediment disturbance or discharges of industrial wastewater or
stormwater— I think it would definitely behoove you all to speak to the Regional Office about that to make sure you all
are on the same page. We would also appreciate some notification of when you are stopping and starting industrial
activities again. Although this is not currently a permit requirement, I believe it would be beneficial for both of us to
have on record.
Again, our apologies for this mistake on our part. Let us know if you have any further questions.

While trying to renew all our permits based on the new permit effective July 1, 2011, it came to my attention that Permit
NCG 140306 has been withdrawn. Based on the attached memo it seems it was your decision to do it.
We CEMEX did not intend for this permit to be rescinded, nor we knew it was being rescinded.
Is there any way to reinstate the permit?
Let me know as soon as you can, since Jennifer Jones in Raleigh is working towards renewing all our permits.

Well that permit was withdrawn in 2009 and there is not a current permit for it. In the file there is an email from Ron Boone that
states that your plant has been shut down — that's why our admin withdrew it. I have attached a pdf. If not, please contact Ron and
verify with him — I have cc'd him here. Once verified, I can find someone here to help me "unwithdraw" it or somehow fix it, if that
is the case.

Hey Johnny —
Thank you for sending these. I just wanted to check that you had sent the originals in the mail? I had received another company's
but not yours yet so I was just checking.
Also - I spoke to Linda Wiggs today about the "inactive" facilities and spoke to her about what we had talked about — I've cc'd her
here. Just to reiterate what we spoke about on the phone, essentially the site would have to be like a parking lot and have no
industrial discharge what so ever for this to be considered possible. The RO would need to come out and verify this. Additionally, in
thinking about it, I am not sure that the facility would essentially be able to be covered, as it would not have a stormwater discharge
associated with that industrial activity at that point — which is what the general permit covers. Finally, if you changed a wastewater
treatment plant (an earthen one for instance) you would need another ATC approval if you were to modify it in any way if you
wished to start discharges from it again as your treatment plant would be modified.

tests were conducted in the second year of the project at commercial and residential sites. Six sites
were initially selected. Three used the polypropylene style insert (two in commercial areas) with double thickness
liners, two used the OARS -containing insert (one in a commercial area), and one used a simple wire
mesh basket (-] cm openings, in a residential area) with no sorbent or filter media. The inserts were observed to
bypass flow at the greatest runoff condition and gradually bypassed more flow as they became
clogged. After about 2 months of active rainfall, the bypassing became more frequent and the polypropylene
sorbents were replaced with medium screens (see test 14 in Table 7). Testing ended for the OARS
type sorbents. When stormwater bypassed the insert, there was no change in street runoff rate or
increase accumulation on the street surface; the clogged insert had no impact on stormwater removal rate from the
street. Sampling was performed as before, except that effluent samples were also collected.
