4) The temporary placement or double handling of excavate materials within waters or vegetated wetlands
is not authorized.
5) No excavated material shall be placed at any time in any y getated wetlands or surrounding waters.

6) All excavated materials shall be confined above the no al high water line and landward of regularly or
irregularly flooded marsh behind adequate dikes or, of er retaining structures to. prevent spillover of
solids into any marsh or surrounding waters.
7) No spoil material is to be placed within 30 feet of the no al high water line.
General
8) All work authorized by this permit must be performed in strict compliance with the attached work plan
drawings, which are a part of this permit.
9) This permit does not authorize the interference with any xisting or proposed Federal project, and the
permittee will not be entitled to compensation for dama' e to the authorized structure or work, or injury
which may be caused from existing or future operations' dertaken by the United States in the public
interest.
10) No attempt shall be made by the permittee to prevent th full and free use by the public of all navigable
waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the
public's rights to free navigation on all navigable water; of the United States.
11) No excavated material shall be placed in any location o in any manner so as to impair surface water
flow into or out of any wetland area.

Ch West Indian manatee (Trichechus mariatus), which is listed as a federally endangered species, has
)e reported in the waters near Beaufort waterfront. In order to protect the West Indian Manatee, if
)osisible, all work should be done during the period from November 1 to May 31. If work must be done
i ng the period from June through October the enclosed guidelines, entitled "Precautions for General
_o struetion in Areas Vhich May Be Us;d by the West Indian Manatee in North Carolina" must be
roll wed.
This permit does not eliminate the 4eed to obtain any additional state, federal or local permits,
approvals or authorizations that maybe required.
Future development of the permitteee's property may require a modification of this permit.

IThe a plicant owns a little hover a third of an acre adjacent to Peletier Creek within the Town
" of Mo ehead City, Carteret County. The street address is 119 Riverside Drive, which is
locate just east of Coral Bay Marina off Highway 70. This property is located within a new
subdi ision in the Mansfield area of Morehead City. The property varies from 5' to 8' above
;mean ea level in elevation, and is vegetated with typical lawn grasses. A wooden walkway
leads rem the waterward side of the house to the dock.
Cuirre t development on the lot includes a single-family residence, shore perpendicular dock
with oatlift and wet slip, and a vertical bulkhead. The existing pier is the result of two
previ us CAMA General Permits, one issued, in August 2000 and the last in July of 2003.
The shorelines of the neighboring properties are likewise stabilized. with vertical bulkheads.
The a jacent waterbody is'Peletier Creek, a tributary to Bogue Sound, which runs north to
sottthl The waterbody is not designated a primary nursery area by the DMF, and is classified
SO b the DWQ.' The creek and adjacent wafters of Bogue Sound are closed to shellfish
harve ting Water depths. in the area of the existing dock average -4' at mean low water and
reach, a depth of -6' mean jow water approximately 38' offshore. Peletier Creek is
appro imately 209' across at the project site.; The Morehead City Land Use Plan classifies
this a ea as Developed, with all AEC's classified Conservation. There are no shellfish or
SAV esources evident at the project location.

The plicant is seeking to' conduct new excavation under the existing wet slip located off the
east sl de of his dock. They area of excavation measures approximately 20' wide and 39' long.
Soun' ings in the area presently indicate -4' ?t nlw, with connecting water depths of -6' nlw.
The roposal is to deepen the project area by 2' for a final depth of -6' nlw. This will require
the disturbance of approximately 780 sf of shallow bottom area, with the ultimate removal of
appr ximately 60 cubic yards of sandy/silty bottom material.
j The xcavation is proposed to be accomplished by bucket to barge, and offloaded to high
grou d. The spoils are ultimately to be disposed of on Malcolm Ray Willis' property
(auth; rization on file) which has served as a spoil disposal site previously.
10. Anticipated Impacts:
The roject will involve the loss of 780 sf (60 cubic yards) of shallow bottom habitat within
the e tuarine waters of Pe?etier Creek. Usage by a larger vessel should pose no additional
j impa ts, as larger vessels are numerous in this creek at private docks and marinas. Turbidity
impa,' is from the dredging operation can be expected, and should be short term.
