Upland Development 1) The loading road at the oyster shell recycling and storage area shall be located a minimum of 30 feet landward of the normal high water line. Piers 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using either of the two piers. Any sewage discharge at either of the two piers shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Coastal Federation Permit #23-05 Page 2 of ADDITIONAL CONDITIONS 3) The authorized structures and associated activities shall not cause an unacceptable interference with navigation. P, 4) This pen-nit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of the permitted project without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 5) Any portion of the permitted public access pier built over coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 6) The permittee shall maintain the authorized piers in good condition and in conformance with the terms and conditions- of this permit. The permittee shall not be relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the pennittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. Riprap Sill 9) The alignment of the riprap sill shall be staked by the permittee and approved onsite by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re-approved by DCM within a maximum of 30 days prior to the new expected start of construction. 10) The riprap sill shall be marked at 50-foot intervals with reflectors extending at least three feet above the normal high water level. i 11) The authorized marsh planting shall be accomplished in such a manner so as to not entail any backfilling or grading of the area behind the sill. Nk N.C. Coastal Federation ADDITIONAL CONDITIONS Permit #28-05 Page 3 of 12) Offshore sill sections shall be setback 15 feet from the adjoining riparian access dividing line. The line of division of riparian access shall be established by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 13) The pennittee shall maintain the sill in good condition and in conformance with the terms and conditions of this permit, or the remaining portions of the sill shall be removed by the permittee within 90 days of notification from the Division of Coastal Management. 14) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the site by wave or current action. 15) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite or broken concrete. 16) In order to ensure successful implementation of the coastal wetland planting plan, post-construction monitoring shall be done on the marsh planting area. Monitoring shall take place immediately following completion of the planting effort, and on an annual basis thereafter. Each monitoring event shall include photographic documentation, as well as estimates of plant density, species composition and aerial coverage. Individual monitoring reports shall be submitted to the Division of Coastal Management within 60 days of the completion of each distinct monitoring event. Monitoring shall proceed until the permittee receives written concurrence from the Division of Coastal Management that the site is functioning as expected, and that no additional monitoring events are necessary. Storinwater Rianwjement 17) The Division of Coastal Management, on behalf of the Division of Water Quality, approved this project under the stonnwater management rules of the Environmental Management Commission by way of Stornwater Permit No. SW8040506, which was issued on 1/4/05. Any violation of this permit by the DWQ shall be considered a violation of this CAMA permit. Sedimentation and Erosion Control 18) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties (e.g. silt fence, diversion swales or berms, etc.). 19) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. r N.C. Coastal Federation ADDITIONAL CONDITIONS Permit #28-05 Page 4 of 5 20) The permitted activity shall be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant. General 21) Prior to the initiation of any construction activities authorized by this permit, the permittee shall obtain any and all required approvals from the N.C. Department of Transportation. 22) This permit does not authorize the excavation or filling of any wetland area. 23) This permit does not authorize the excavation of any open water area. 24) No fill material shall be placed at any time in.any waters outside of the alignment of the area indicated on the attached workplan drawing(s). 25) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 26) The federally endangered West Indian manatee (Trichechus manatus), has been reported in North Carolina waters. In order to protect the manatee, all work should be done between November 1 and May 31. If work must be done outside of this time frame, the permittee shall adhere to enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina". 27) No portion of any structure shall be located within 80 feet of the near bottom edge of the federally maintained AIWW channel. As as-built survey shall be performed on the sill and docking facilities, and copies of the survey provided to the U.S. Army Corps of Engineers and Division of Coastal Management, within 60 days of completion of construction of these portions of the project. 28) The Federal Government does not assume any liability for: A. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or natural causes. B. Damages to the permitted project or uses thereof as a result of current or future Federal activities initiated on the public's behalf. C. Damages to other permitted or unpermitted activities or structures caused by the authorized activity. D. Design and construction deficiencies associated with the permitted work. E. Damage claims associated with any future modification, suspension, or revocation of this permit. I N N.C. Coastal Federation Permit #28-05 Page of 5 ADDITIONAL CONDITIONS 29) It is possible that the authorized structure may be damaged by wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The permittee shall not hold the United States liable for any such damage NOTE: This permit does not eliminate the need to obtain any additional. state, federal or local permits, approvals or authorizations that may be required. NOTE: The pennittee and/or his contractor is urged to meet with a representative of the Division prior to project initiation. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the nonnal high water level. S. Fish and Wildlife Service (Service) on the subject Public Notice (PN), dated November 11, 2004. The applicant, the North Carolina Coastal Federation (NCCF), has applied for a Department of the Army (DA) permit to develop an oyster shell storage area and loading pier along with a public pier and low rock, sill along the shoreline of Stump Sound. The proposed work is being considered under Regional General Permit #198000291, a permit/processing agreement for work that has been approved pursuant to the North Carolina Coastal Area Management Act (CAMA). These comments are submitted in accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Comments related to the FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) in relation to the protection of fish and wildlife resources. Additional comments are provided regarding the District Engineer's determination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). Proposed Action and Anticipated Impacts The project area, proposed work, and anticipated impacts are described the Field Investigation Report (FIR), dated November 2, 2004, of the North Carolina Division of Coastal Management (NCDCM). The applicant proposes to develop an oyster shell storage area and loading pier to be used in conjunction with the North Carolina Division of Marine Fisheries (NCDMF). The proposed work also includes construction of a public pier to be used for estuarine access, fishing and environmental education. A rock sill and associated coastal restoration area would be constructed. The project area is a 2.08-acre tract at the eastern terminus of Morris Landing Road. The tract is wooded, undeveloped, and adjacent to Stump Sound and the Atlantic Intracoastal Waterway (AIWW). 2 The proposed loading pier (130 feet long by 12 feet wide) would extend into Stump Sound. A public, fishing/crabbing pier (135 feet by 4 feet) would be constructed into Stump Sound approximately 110 feet south of the loading pier. The pier would be accessed by an elevated walkway from Morris Landing Road. According to project drawings in the FIR, both the public fishing pier (Sheet 10 of 10) and the loading pier (Sheet 9 of 10) would be elevated between five and ten feet above the substrate. The FIR states that the project would shade 756 square feet (ft) of vegetated wetlands. However, the proposed elevations would minimize the adverse impact of shading on marsh vegetation. A low rock sill would be constructed parallel to the shoreline south of the public pier. The sill would be 550 feet long and 18 inches high. The structure would be approximately 30 feet waterward of the mean high water (MHW) line. The sill would have a top width of 18 inches and a base width of six feet (Sheet 8 of 10). The sill would cover approximately 3,300 ft2 (550 x 6) of shallow estuarine bottom. There would be two drop-down, approximately five feet wide, along the structure to promote water circulation. However, project drawings indicate that both ends of the sill would be open within the intertidal zone. These opening would facilitate the passage of aquatic organisms between the marsh and the sound. The area landward of the sill would be planted with coastal vegetation. The species include smooth cordgrass (Spartina alterniflora) and salt meadow cordgrass (S. patens). This effort has the potential to create 16,500 ft2 (550 x 30) of valuable marsh habitat. Federally Protected Species The Service has reviewed available information on federally-threatened or endangered species known to occur in Onslow County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on the special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data from USGS quads provide the most project- specific information on species which should be considered in permitting this project. The project area is in the Holly Ridge quad. The occurrence data of special status species within this quad can be obtained on the internet at < http://ww?v.ncnhp.oriz/Pages/heritauedata.html >. The Service carefully considers potential impacts for all in-water construction on the West Indian manatee (Trichechus manatus), a federally-endangered mammal. The species has been reported from Onslow County but there are no current records within the Holly Ridge quad. Manatees move along the Atlantic Coast during summer months and are seasonal transients in North Carolina, primarily from June through October. Manatees may occupy waters one to two meters (3.3 -6.6 feet) deep. The species moves extensively when in North Carolina waters and past occurrence records cannot be used to precisely determine the likelihood that it will be presence at a particular construction site. 3 Based on information in the PN, water depths at the sill construction site appear too shallow to provide suitable habitat for manatees. However, the waterward ends of both the loading pier and the fishing pier are shown to be in water 3.4 feet deep at mean low water (MLW). During much of the tidal cycle manatees could use this area of Stump Sound. Piling placement for pier construction should be done with recognition that manatees may be present during the warmer months of the year. To protect manatees in North Carolina, the Service developed guidelines entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina." These guidelines address all types of in-water construction, except blasting, and should produce little, if any, additional expense. The guidelines are intended mainly to ensure that construction personnel are informed that manatees may occur in the work area, that work should cease if a manatee approaches the work area, work should not resume until the manatee leaves the work area, and procedures for reporting the death or injury of a manatee. These guidelines are available on our web site at < http://nc- cs.fws.gov/mammal/manatee guidelines.pdf>. The risk to manatees could be reduced to an acceptable level by the implementation of the Service's guidelines. The risk would be further reduced by performing the work during the period of November through May. With the inclusion of our manatee conditions, the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. However, the requirement of section 7 would need to be reconsidered if (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. Service Concerns and Recommendations The Service supports the use of low sills as an alternative to bulkheads for shoreline stabilization. However, sills should be designed to allow adequate exchange of water and organisms. Rogers and Skrabel (2001, p. 21) note that it is necessary to allow trapped water to return to open water without causing excessive localized currents around the structure. Estuarine marshes depend on regular flooding for nutrients and to carry away sediment and pollutants. To facilitate this exchange sills are designed to be porous with water flowing between the stones or through gaps in the structure. The Service recommends that at least ten percent of the overall sill length consist of gaps. Project diagram indicate that only two, 10-foot-wide drop-downs would placed along the 550- foot structure, representing only 1.8% of the length. The open ends of the sill would provide additional water exchange. However, we understand that sills in areas subject to high wave energy may necessitate a smaller percentage of openings. The project area, near the AIWW, may be subject to frequent boat wakes. If the amount of openings is considered the best balance 4 between water/organism interchange and shoreline stability, the Service would accept the plans of the NCCF. The Service would be concerned if the sill was placed on or near areas of submerged aquatic vegetation (SAV). The project description in the FIR does not address the presence or absence of SAV within the footprint of the sill. However, the application form (DCM-MP-2, Section 4b) states that fill material would not be placed in marsh, SAV, or other wetlands. We assume "fill material" in this context includes the granite rocks of the sill. Overall, the Service does not oppose the issuance of a DA permit for the proposed action. If water/organism interchange has been optimized, SAV would not be impacted, and precautions are undertaken to protect manatees, we do not believe that the proposed activity will have significant adverse and/or irreversible effects on general fish and wildlife resources under our jurisdiction. PROJECT SUMMARY: The applicant proposes to develop an oyster shell storage area and loading pier to be used in conjunction with NC Division of Marine Fisheries' shell recycling and oyster reefs restoration programs; construction of a public pier to be used for estuarine access, fishing and environmental education; and constriction of a rock sill and associated coastal wetlands restoration area. PROJECT DESCRIPTION: The project is located at the end of Morris Landing Road (SR 1538), off US Hwy. 17, near Holly Ridge, in Onslow County. The 52.4-acre property is located on the west side of the Atlantic Intracoastal Waterway (AIWW). The tract is wooded and undeveloped. Morris Landing Road dead-ends into the AIWW and historically has been used as an unimproved boat landing and estuarine access site by the public and area/local residents. The proposed project area is located at the end of the road and consists of a 2.08-acre highground area on the north side of the road, as well as, the shoreline along the AIWW, both north and south of the landing. The vegetation on the highground area includes; Live Oak (Ouercus virginiana), Sweet Bay (Magnolia virginiana), Sweet Gum (Liquidambar stryciflua), Loblolly Pine (Pinus taeda), and Red Cedar- (Juniperus virginiana) with a dense under-story of Yaupon (Ilex vomitoria), Wax Myrtle (M ica 'cerifera); Tapanese Honeysuckle (Lonicera iaponica) and other plants. The shoreline south of the landing exists as a wetland spit or berm, between Morris Landing Road and a small island of highground approximately 600 feet to the south. The width of the shoreline berm that is above normal high water (NHW) varies from 10 feet to over 100 feet wide, and there are two (2) turnouts where people driving along the shoreline appear to park and/or turn vehicles around. The entire shoreline berm area is wetlands. The slightly higher elevations exhibit shrub vegetation including; Yaupon (Ilex vomitoria), Silverling (Baccharis angustifolia), Grounsel-bush (Baccharus halimifolia), Marsh-elder (Iva frutescens), and Sea Oxeye (Borrichia frutescens). Extensive coastal marsh, both irregularly and regularly flooded, border the back side (west) of the shoreline berm. High marsh species include; Black Needle Rush (Juncus roemarianus), Sea Lavender (Limonium, spp.), Glasswort (Salicornia spp), Spike Grass (Distichlis spicata), Giant Cordgrass S artina cynosuroides), and Salt Meadow Grass (Spartina patens); transitioning to the regularly flooded Smooth Cordgrass marsh (Spartina altemiflora). Adjacent to the AIWW side of the shoreline, there is a narrow border of Smooth Cordgrass marsh (Spartina alterniflora), approximately 15 -20 feet wide, on the north side of the landing; and another isolated patch in the southeast corner of the project area. The remainder of the shoreline south of the landing is unvegetated, sandy estuarine beach. In the project area, the NC Division of Water Quality classifies the waters of the AIWW/Stump Sound, as SA-ORW. The NC Division of Marine Fisheries has designated this area of Stump Sound as Primary Nursery Area (PNA), and the waters adjacent to the proposed project are OPEN to shellfishing. The North Carolina Coastal Federation (NCCF) proposes to develop an oyster shell storage area and loading pier to be used in conjunction with the NC Division of Marine Fisheries' (NCDMF) shell recycling and oyster reefs restoration programs. The applicants also propose the construction of a public pier to maintain and promote the historical estuarine access and fishing activities, as well as, facilitate NCCF environmental education activities. The construction of a rock sill and associated coastal wetlands restoration area would complete the proposed project. The applicant proposes to clear approximately.5 acre of the highground on the north side of the end of Morris Landing Road and construct an oyster shell storage area (140' X 100') and a paved U-shaped access road (250' X 30'). A loading pier (130' long X 12' wide) would extend into Stump Sound to facilitate the loading of the oyster shells onto NCDMF barges. There would be four (4) mooring pilings installed adjacent to the end of the pier, two (2) on each side, approximately 25 feet off the pier and 25 feet on center. A gravel loading road (50' X 20') would connect the pier to the oyster shell storage area. A gated security fence would prevent unauthorized vehicles on the pier. Other structures proposed for this area include an oyster recycling box for local residents to deposit shell from private oyster roasts and a sign kiosk for site and educational materials. The proposed fishing/crabbing pier would be located approximately 110 feet south of the landing. The pier would be accessed from the road by an North Carolina Coastal Federation/Morris Landing Page Three elevated walkway (110' long X 6' wide) that would include a handicap ramp from the pavement and terminate with a elevated platform (16' X 10'). The platform would be oriented along a tidal ditch so that no more than 6 feet of any dimension would be located over coastal wetlands. In addition to accessing the pier, the platform would function to facilitate NCCF educational activities and field trips. From the platform, the pier would be 135 feet long and 4 feet wide and would include steps on both sides of the pier, at its intersection with the shoreline, to allow pedestrian access to the estuarine shoreline. South of the pier, the applicants propose to construct a rock sill. The sill is designed to function as an offshore breakwater to lower incoming wave energy and improve the survivorship of the marsh planting proposed for the landward side of the sill. The sill would be constructed of Class II granite and located approximately 30 feet below normal high water (NHW). It would be 550 feet long and 18 inches in height, with a base width of 6 feet and a top width of 18 inches. The sill would be constructed on a geotextile mat and include two (2) drop-downs within its alignment to promote water circulation. The area behind the sill would be planted with marsh species. . ANTICIPATED IMPACTS The development of the proposed oyster shell storage area and access driveway would disturb approximately 21,900 square feet (.5 acres) of highground and create an equal amount of impervious surface. The construction of the proposed barge pier, fishing pier and rock sill would result in the incorporation of 5,240 square feet of Estuarine Waters and Public Trust Area. The proposed pier walkway and platform would result in the shading of 756 square feet of coastal wetlands. Short-term increases in turbidity can be expected during piling placement for pier construction. The project would facilitate the cooperative efforts of the NCCF and the NCDMF in their oyster shell recycling and oyster reefs restoration programs. The project allows the continued traditional use of the boat landing and promotes estuarine shoreline use and access by the addition of a public pier. The project does eliminate vehicle traffic along the existing shoreline. Submitted by: E. F. Brooks Date: November 2, 2004 Office: Wilmington Recommendations for State Permit - NC Coastal Federation/Morris Landing The lack of a T-head or L-head at the end of the proposed fishing pier will limit its use for fishing. The 4' width will accommodate a single fisherman. Given the original proposal for "jersey barriers" and the lack of space at the end of the proposed fishing pier, one might construe this structure to be more of a vehicle block than a place to fish. This office recommends that any permit issued to authorize the proposed project should include the following conditions: 1. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third-party. 2. This permit authorizes only the dock, pier, rock sill and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without a permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without a permit modification. 3. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 4. The permitee must install and maintain, at his expense, any signal lights and signals prescribed by the US Coast Guard through regulations or otherwise, on authorized activities. Future development on the permittee's property may require a modification of this permit. Contact a representative of this Division at (910) 395-3900 prior to commencement of any such activity for this determination. 6. The construction of the proposed project shall be in compliance with all local, State and Federal regulations and associated permit conditions. 7. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8. The authorized structure and associated activity must not cause an unacceptable interference with navigation. 9. The riprap material must be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. 10. The alignment of the authorized riprap sill must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 11. No backfill of the breakwater or any other filling of wetlands, estuarine waters, public trust areas or high ground is authorized by this permit. 12.
