Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the
Coastal Counties as defined by the Coastal Area Management Act with Additional Conditions
Dear Mr. & Mrs. Ginas:
You have our approval, in accordance with the conditions listed below, to impact approximately 2,250
square feet (ft) of Zone 2 (only) of the protected riparian buffers for the purpose of constructing a
residential dwelling on the subject property as described within your application dated November 9, 2004
and including revisions as described within your letter dated December 8, 2004. This letter shall act as
your approval for the use of the "General" Major Variance; From the Neuse and Tar-Pamlico Riparian
Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties
as defined by the Coastal Area Management Act with ADDITIONAL CONDITIONS as approved by the
Water Quality Committee (WQC) of the Environmental Management Commission (EMC) on May 10,
2001. In addition, you should get any other required federal, state or local permits before you proceed
with your project including (but not limited to) Sediment and Erosion Control and CAMA permits. This
approval shall expire when the variance expires on April 11, 2006 unless the variance is renewed before
that time by the EMC. This approval shall replace the one issued on November 30, 2004.
This approval is for the purpose and design that you described in your variance request. If you change
your project, you must notify us and you may be required to send us a new request for approval. If the
property is sold, the new owner must be given a copy of this approval and is thereby responsible for
complying with all conditions. This approval requires you to follow the conditions listed below.
The Additional Conditions of the Certification are:
1. No Impacts to Zone 1 - No impacts shall occur to Zone 1 of the protected riparian buffers (except
for uses and activities designated as "exempt" within 15A NCAC 02B .0259), unless otherwise
approved by the DWQ. Zone 1 is measured 30 feet from the edge of the coastal wetland / marsh
line or along the normal high water level of the creek (in locations where no coastal wetland exists)
as identified by the Division of Coastal Management. If you believe that the house must be located
within Zone 1, then you shall submit a modification to your variance request including a surveyed
plot plan depicting the property boundaries, coastal wetlands, creek, both Zone land 2 of the

protected buffer, footprint of your proposed house (including any decks, porches, walkways,
driveways, sheds, etc.) and the location of the septic system.
2. Protective Fencing - The construction corridor within approved under this authorization shall be
clearly marked with orange warning fencing (or similar high visibility material) for the areas that
have been approved to infringe within the buffer prior to any land disturbing activities to ensure
compliance with 15A NCAC 2B .0259. A properly installed silt fence along the Zone 1 / Zone 2
boundary will satisfy this condition. The silt fence shall be removed and all disturbed areas shall be
returned to the pre-existing grade, vegetated and stabilized, and diffuse flow maintained
immediately after the completion of the construction.
3. Certificate of Completion - Upon completion of all work approved within the 401 Water Quality
Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required
to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of
Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
4. Diffuse Flow - All new stormwater drainage shall be directed to vegetated areas as diffuse flow at
non-erosive velocities prior to entering the protected riparian buffers as identified within 15A
NCAC 2B .0233(5). No new ditching or piping of stormwater through the protected buffers is
allowed.
If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Tar-Pamlico River Riparian
Buffer Protection Rules (15A NCAC 213 .0259 (9)(b)). Please call Mr. Bob Zarzecki at 919-733-9726 or

Schrams Beach Road, Belhaven, NC 27810
Thank you for the approval of the General Major Variance which would allow impact of
approximately 900 square feet of Zone 2.
After review of the covenants of Windtide Subdivision, we are embarrassed to realize that
the minimum square feet allowed by the covenants must be 1,000 square feet of heated
space. To allow for a house that satisfies the covenants and for added porch or decking,
we are requesting an amended variance. The property is under contract to David G.
Schaeffer and we are requesting jointly this variance be amended in case closing should
occur before your response.
Measuring from the CAMA markers, we have determined that there is a trapezoidal area
of Zone 2 land whose dimensions exceed 38'x50', not overlapping Zone 1, that would
serve as a desirable house site. (See sketch below). The 50' side boundaries of this area
are 30' or more from the marshes on the east and west sides of the property. The 38'
north boundary (closest to the creek) is more than 30' from the marsh and 50' from the
creek. We, therefore, request permission to locate a house within this area with up to
1100 sq R of heated space and 500 sq ft of deck/porch.
Thank you for your time and consideration of our requested amendment. We apologize
that through inadequate planning on our part, the variance we origimlly requested is
mismatched with the situation of the lot.

THIS DEED, Made and entered into this day of
1994, by and between Weyerhaeuser Real Estate
Company, a corporation of the State of Washington, and duly
authorized to do business in the State of North Carolina, party of
the first part, and Alec Ginas and wife, Maureen P. Ginas, whose
address is 350 Sailors Lane, Cutchogue, New York, 11935, parties
of the second part;
W I T N E S S E T H:
That the said party of the first part, for and in
PREPARED BY:
T. R. THOMPSON, JR.
ATTORNEY AT LAW
AURORA, NORTH CAROLINA
consideration of the sum of TEN AND N01100 ($10.00) DOLLARS, and
other good and valuable considerations to it in hand paid, by the
parties of the second part, the receipt of which is hereby
acknowledged, has bargained and sold and by these presents does
bargain, sell and convey unto the said parties of the second part,
their heirs and assigns, subject to the mineral reservation and
encumbrances as hereinafter set out, that certain tract or parcel
of land lying and being in Bath Township, Beaufort County, State
of North Carolina, and being more particularly described as
Ifollows:
ALL of Lot No. Four (4) as the same is shown on
that map prepared by Dennis A. Fornes, Registered
Land Surveyor, dated November 15, 1991, and
identified by the following legend: "Final Plan
of: Windtide Subdivision". This map is duly of
record in the Office of the Register of Deeds of
Beaufort County in Plat Cabinet E, Slide 99-4,
and reference is hereby made to said map for a
more complete and accurate description of this

property.
This conveyance is made subject to the following mineral
reservation and encumbrances:
(1) This conveyance is made subject to the reservation of
mineral rights which are retained by Weyerhaeuser Company
and said reservation is stated in substance as follows:
"The Grantor hereby expressly saves, reserves and
excepts out of the grant hereby made, unto
itself, its successors and assigns, forever, all
ores and minerals including but not limited to
oil, gas, coal, distillates, and condensates, in
and under said land. Top soil, sand, fill dirt,
ground water, and other commonly occurring
substances are expressly excluded.
Notwithstanding the foregoing and notwithstanding
any other legal or equitable right or remedy now
existing or hereafter enacted or created, Grantor
hereby agrees, for itself, its successors and
assigns, that the rights hereby reserved and
excepted shall not be exercised in a manner
adversely affecting use of the surface at any
time unless and until the Grantor or its
successors or assigns, as the case may be, shall
first make satisfactory written arrangements with
the then owner of the property affected, and faith
the mortgagee or mortgagees of such property, as
their respective interests may appear, to
compensate said owner and mortgagee or mortgagees
for damages incurred to the surface and any
improvements thereon in exercising such rights."
(2) The aforesaid property is conveyed subject to those
easements of record and utility rights-of-way.
(3) The property heretofore described is conveyed subject to
those Restrictive Covenants of record in Book 977, Page
850, Beaufort County Registry.
