proposed impacts to stream ST-TB. Based on the SAM form provided by Jay Keller, who was previously
involved in this project, this stream appears to be hydrologically unimportant. Additionally, in previous
conversations you had suggested that we make this request with our PCN submittal.

Thank you for your PCN and attached information, dated 10/4/2019 (received 10/9/2019), for the above
referenced project. I have reviewed the information and need clarification before proceeding with
verifying the use of a Nationwide Permit. Please submit the requested information below (via e-mail is
fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the
Nationwide Permit or consider your application withdrawn and close the file:
1) Please provide electronic copies of your PCN and plans dated 10/4/2019, as well as your response to
this request for additional information;
Copies of the attached documents are attached, as requested.
2) To enable processing of a Preliminary JD concurrent with the evaluation of this project for use of a
NWP, please fill out, sign, and return the attached PJD form;
The PJD form is attached.
3) The following sections of the PCN are missing information or require additional information for our
evaluation:
a. A.1b: Please specify which under which Nationwide Permit you are seeking verification. Typically
residential projects are evaluated for the use of NWP 29. However, please note that proposed wetland
impacts at Wetland Area B cannot be authorized using NWP 29; in such cases the use of NWP 18 is
typically requested;
NWP and GP numbers have been added.
b. D.1: please provide additional avoidance and minimization for each crossing. Also, it appears that
slight changes to the site plan could avoid wetland impacts for Stormwater facilities at Impact Area B.
Please re -design accordingly, or explain in detail why such measures are not practicable. Note also that
SEI did not perform the delineation and assessment for potential waters of the US on this site;
Limits of disturbance and tree protection fences have been adjusted to stay clear of the wetlands. All
grades tie out before reaching the wetlands.
C. D.2: Based on the proposed plans, stream impacts resulting in a loss of streams (Impact Areas C, H,
and K) would exceed 150 I.f., and therefore compensatory mitigation for streams is required. Further,
the statement that "Mitigation has been paid in excess by the previous applicant" does not appear to be
accurate, as no permits and therefore no mitigation requirements have been issued by the corps to this
point. Please provide documentation of any previous compensatory mitigation payments made for
impacts incurred on this property, or update this section of the PCN accordingly. Also, provide an
acceptance letter from a mitigation sponsor with credits available in this service area;
New mitigation acceptance letters have been procured for this project and are attached with the other
exhibits.
d. F.7b: this information was not filled out;
The response can now be found in the attached PCN.
4) Impact Area C:
a. "Combined Wetland Stream Impact" does not enable proper itemization of impacts between these
two distinct resource types. Please delineate the stream channel (OHWM to OHWM) out from the
wetland area, revise the plans, and re -calculate impacts accordingly. Stream impacts should be
calculated based on the center line of the channel in this Impact Area;
The stream channel has been delineated to distinguish the two resource types and impacts have been
recalculated to reflect the changes.
b. All stream and wetland areas within the proposed road fill and culvert will be considered
permanent losses of those resources. Please revise the plans and re -calculate impacts accordingly;

permanent losses of those resources.
C. The profile drawing indicates one large box culvert at this crossing. To comply with NWP Regional
Condition 3.6.5, the culvert should include baffles, benches and/or sills to maintain the width of the
stream channel;
The culvert now includes baffles. See Impact Area C and E-17 for Culvert Details.
d. The profile drawing does not indicate that the culvert would be buried per NWP Regional
Condition 3.6.1. Culvert burial is ideal in this location given the flat slope of the stream;
The profile drawing does indeed specify "9' x 8' BOX CULVERT 1' EMBEDMENT'.
5) Impact Area H:
a. The profile drawing states that the culvert would be imbedded 1 ft. However, based on the steep
slope of the stream (>4%) in this location, culvert burial is not recommended due to the risk of
headcutting. Please confer with NCDWR to ensure that they are in agreement;
Culvert #2 on Impact Area H now has no embedment.
b. Further, the profile drawing indicates that the culvert outlet would be perched above the existing
stream bed. Please re -design this culvert to ensure that headcutting does not occur up or downstream
of the proposed crossing. We also recommend adding alternating baffles within the culvert to slow
water velocity within the culvert, thereby allowing aquatic passage;
The culvert is now shown to be flush with the existing stream bed to ensure that headcutting does not
occur. Additionally, a plunge pool has been designed to slow water velocity within the culvert. Details
shown on Sheet E-18 Plunge Pool Details. Additionally, a curtain walls are referenced (to be designed by
the structural engineer to provide additional protection of headcutting.
6) Impact Area K:
Road G:
i. The profile drawing states that the culvert would be imbedded 1 ft. However, based on the steep
slope of the stream (>3%) in this location, culvert burial is not recommended due to the risk of
headcutting. Please confer with NCDWR to ensure that they are in agreement;

Road C:
i. Based on the delineation of potential waters of the US on this property as well as my verification
site visit on 2/1/2019, Stream TZ extends up to the uppermost wetland shown within proposed Lot
279/280. This stream was also shown on the plans provided with the original PCN submitted 1/25/2019.
Please add this stream to the plans and re -calculate impacts accordingly. Note that as proposed, this
impact would cause total stream impacts to exceed 150 I.f. (see item 3c above). Site visit notes indicate
that this feature appears to have medium -high aquatic function;
Please provide a profile view of this road crossing;
We have redesigned the crossing on Road C to have a culvert and eliminate impacts on Stream TZ. A
profile view of New Culvert 4 has been provided.
7) Please note that responses to the questions above may prompt additional information requests to
allow full evaluation of the proposed project.

F. JURISDICTIONAL DETERMINATION (JD) TYPE (Select One)

A Preliminary Jurisdictional Determination (PJD) provides an indication that there may
be "waters of the United States" or "navigable waters of the United States"on a property.
PJDs are sufficient as the basis for permit decisions. For the purposes of permitting, all
waters and wetlands on the property will be treated as if they are jurisdictional "waters of
the United States". PJDs cannot be appealed (33 C.F.R. 331.2); however, a PJD is
"preliminary" in the sense that an approved JD can be requested at any time. PJDs do
not expire.

An Approved Jurisdictional Determination (AJD) is a determination that
jurisdictional "waters of the United States" or "navigable waters of the United
States" are either present or absent on a site. An approved JD identifies the limits of
waters on a site determined to be jurisdictional under the Clean Water Act and/or
Rivers and Harbors Act. Approved JDs are sufficient as the basis for permit
decisions. AJDs are appealable (33 C.F.R. 331.2). The results of the AJD will be
posted on the Corps website. A landowner, permit applicant, or other "affected
party" (33 C.F.R. 331.2) who receives an AJD may rely upon the AJD for five years
(subject to certain limited exceptions explained in Regulatory Guidance Letter 05-
02).

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in
the review area, and the requestor of this PJD is hereby advised of his or her option
to request and obtain an approved JD (AJD) for that review area based on an
informed decision after having discussed the various types of JDs and their
characteristics and circumstances when they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a
Nationwide General Permit (NWP) or other general permit verification requiring "pre -
construction notification" (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an AJD for the
activity, the permit applicant is hereby made aware that: (1) the permit applicant has
elected to seek a permit authorization based on a PJD, which does not make an
official determination of jurisdictional aquatic resources; (2) the applicant has the
option to request an AJD before accepting the terms and conditions of the permit
authorization, and that basing a permit authorization on an AJD could possibly result
in less compensatory mitigation being required or different special conditions; (3) the
applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can
accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has
determined to be necessary; (5) undertaking any activity in reliance upon the subject
permit authorization without requesting an AJD constitutes the applicant's acceptance
of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps permit
authorization based on a PJD constitutes agreement that all aquatic resources in the
review area affected in any way by that activity will be treated as jurisdictional, and
waives any challenge to such jurisdiction in any administrative or judicial compliance
or enforcement action, or in any administrative appeal or in any Federal court; and (7)
whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms
and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic
jurisdiction exists over aquatic resources in the review area, or to provide an official
delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds
that there "may be" waters of the U.S. and/or that there "may be" navigable waters of
the U.S. on the subject review area, and identifies all aquatic features in the review
area that could be affected by the proposed activity, based on the following

as shown above, however, this letter is not a guarantee of availability as credits will be sold on a first
come, first serve basis. An invoice for this transaction will be sent upon your request and we will
formally reserve both the credits and price quoted for a period of 30 days from the invoice.
Final transfer of the credits will be made upon receipt of a copy of the 401 Water Quality Certification

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/407 Certification within this time frame, this acceptance will
expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
impact amounts shown below.

Upon receipt of payment, DMS will take responsibility for providing the compensatory mitigation. The

party (including downstream and/or adjacent owners) is notified of this letter. A request for a determination by the
Director shall be referred to the Director in writing c/o Karen Higgins, Karen Higgins, DWR — 401 & Buffer
Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617.
This determination is final and binding unless, as detailed above, you ask for a hearing or appeal within sixty (60)
days.
The owner/future owners should notify the Division of Water Resources (including any other Local, State, and
Federal Agencies) of this decision concerning any future correspondences regarding the subject property (stated
above). This project may require a Section 404/401 Permit for the proposed activity. Any inquiries should be

WETLANDS CLASSIFICATION SYSTEM
National Wetland Inventory Maps are produced by the U.S. Fish and Wildlife Service, a sub -department
of the U.S. Department of the Interior. In 1974, the U.S. Fish and Wildlife Service developed a criteria for
wetland classification with four long range objectives:
to describe ecological units that have certain homogeneous natural attributes,
to arrange these units in a system that will aid decisions about resource management,
to furnish units for inventory and mapping, and
to provide uniformity in concepts and terminology throughout the U.S.
High altitude infrared photographs, soil maps, topographic maps and site visits are the methods
used to gather data for the productions of these maps. In the infrared photos, wetlands appear as
different colors and these wetlands are then classified by type. Using a hierarchical classification,
the maps identify wetland and deepwater habitats according to:

The classification system consists of five systems:
1. marine
2. estuarine
3. riverine
4. lacustrine
5. palustrine
The marine system consists of deep water tidal habitats and adjacent tidal wetlands. The riverine
system consists of all wetlands contained within a channel. The lacustrine systems includes all
nontidal wetlands related to swamps, bogs & marshes. The estuarine system consists of
deepwater tidal habitats and where ocean water is diluted by fresh water. The palustrine system
includes nontidal wetlands dominated by trees and shrubs and where salinity is below .5% in tidal
areas. All of these systems are divided in subsystems and then further divided into class.
National Wetland Inventory Maps are produced by transferring gathered data on a standard 7.5
minute U.S.G.S. topographic map. Approximately 52 square miles are covered on a National
Wetland Inventory map at a scale of 1:24,000. Electronic data is compiled by digitizing these
National Wetland Inventory Maps.
