Moore North Carolina Department of Environmental Quality Asheville Regional Office, Division of Water Resources 2090 U.S. Highway 70 Swannanoa, North Carolina 28778 Email address: Andrew.W.Moore@ncdenr.gov RE: Notice of Violation and Recommendation for Enforcement Rockdale Road NOV-2019-CV-0008 (PIN 0855-00-82-0890) Mr. Moore In reference to the above, I am writing to respond to a letter received that is dated November 13, 2019, from Zan Price, P.E., Assistant Regional Supervisor and to reiterate my previous conversation with you regarding the same. As I previously stated during our phone conversation, being from out of state I was sincerely unaware that a permit was needed to support the bank and/or creek edge. Had I been aware of the need to apply for a 401 WQC and attain a 404 Permit, you can be assured such would have been completed. Since acquiring this knowledge, an application and permit will be secured. Upon initial viewing of the Rockdale property in late August 2019, it was noted that there were several trees along the creek edge where the bank was being undercut and the existing trees were about to fall over and forever be lost. After closing on September 13, 2019, we began immediately adding rocks to the creeks edge. There were many loads of boulders hauled onto the Rockdale property with the full intention of merely supporting the bank and/or trees. Because of the many loads hauled in, there was nor is there any reason for "boulders being harvested from Little Rock Creek." As stated during our telephone conversation, the only boulder wall constructed was to strictly support not alter. There was never and it is still not my intention to alter, change, or obstruct the waterway, or "discharge into jurisdictional waters." I do greatly appreciate your understanding and support in this matter, and do look forward to being a part of this beautiful county and state in the future.
