Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The site is located on Raleigh Rd, in Four Oaks, NC in Johnston County in the Southeastern Plains ecoregion of NC. Current land use is appropmately 90 % cultivated agricultural fields (tobacco, corn) and 10 % undeveloped forestland. There is a private residence, and typical agricultural outbuildings on site. Water service is provided by Johnston County Public Utilities. There is no public wastewater service. There are 2 wetland areas on the property. Wetland A is located along the western portion of the site, and includes Streams 01 and 02 within the delineated boundaries. Both streams are subject to NC Neuse River Riparian Buffer rules. There are no planned development activities in this area. Wetland B is situated in the approbmate center of the property and extends from the northern property line to the southern property line. This wetland will require crossing to access appropmately 40 acres of developable uplands. The property is located in a predominately rural area of Johnston County. Adjacent properties consists of agricultural use and forestlands. 4b. Sandcastle Lane will extend from the entrance on Raleigh Road to the eastern extent of the project. Sandcastle Lane will require a single crossing of Wetland B (no stream impact) in order to provide access for 42 of the 55 lots. The wetland extends from the northern property line to the southern property line, providing no practical alternative. There are no other planned impacts associated with the project. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Prior to site design, streams, wetlands, and riparian buffers were delineated to identify potential resource areas to avoid where practicable. Impacts have been avoided where possible, while allowing access to upland areas. Due to the location of Wetland B, which extends throughout the property, there is no practical alternative to crossing the wetland in order to access the uplands on the eastern portion of the property. The single road crossing required for the project provides access to 42 of the proposed 55 lots, with no other impacts necessary. The width of the proposed road has been minimized to only the standard design necessary to meet project need and allow for required ingress and egress. The proposed road crosses the wetland at a relatively narrow area, and at an appropmate 90-degree angle, minimizing the overall impact area. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Construction will be conducted under an approved erosion and sediment control plan. A project review letter was requested of the NC Natural Heritage Program (NCNHP) to identify any potential occurrences of endangered species on or near the proposed project. The review letter did not identify and recent occurrences of federally listed threatened or endangered species or critical habitat on the subject property, or within 1.0 miles of the project. A copy of the NHP review letter is attached with this submittal. In addition, a review was made of the USFWS list of Endangered and Threatened Species for Johnston County, NC, updated 6/27/2018. Field reviews did not identify potential habitat for federally protected species known to occur in Johnston County, including the Bald eagle, the Red -cockaded woodpecker, and MIChau)es sumac. There are no proposed stream impacts associated with the project; therefore, there will be no impacts to potential habitats for Neuse River waterdog, Atlantic pigtoe, Dwarf wedgemussel, Tar River spinymussel, or Yellow lance. Based on this information, the proposed project will have No Effect on federally protected species. Also, the forested area on the property is a natural growth mixture of hardwoods (Red Maple and Water Oak) with little no pines (Loblolly Pine). There is a very dense undergrowth of holly, privet, and greenbrier in all areas, with the exception of Wetland B. This very dense undergrowth, combined with the dominant presence of hardwood trees, and lack of pine trees, provides no habitat for the Red -cockaded woodpecker. The wooded area of Wetland B is comprised of primarily of oaks and tulip poplar, with some loblolly pines present. However, there are very few pine trees in the Wetland B area, and the undergrowth is primarily maple saplings and arundinaria (with lack of forage grasses), and provides no habitat for the Red -cockaded woodpecker. There are several historic properties shown near the project site, listed as SL (Study Listing); however, the listings are for individual houses located on the west side of Raleigh Rd. There has been no formal designation of eligibility for these listings. The SL structures are not on the subject property, and the project will have no effect on these structures. The SHPO review did reveal a Study List area centered across Raleigh Road from the project. The SL area as depicted encroaches onto the western portion of the subject property; however, there are no shown SL sites on the subject property. 7c. Bald and Golden Eagle Protection Act (BGPA)_ In the July 9, 2007 Federal Register( 72:37346-37372), the bald eagle was declared recovered, and removed (de- listed) from the Federal List of Threatened and Endangered wildlife. This delisting took effect August 8,2007. After delisting, the Bald and Golden Eagle Protection Act (Eagle Act) (16 U.S.C. 668-668d) becomes the primary law protecting bald eagles. The Eagle Act prohibits take of bald and golden eagles and provides a statutory definition of "take" that includes "disturb". The USFWS has developed National Bald Eagle Management Guidelines to provide guidance to land managers, landowners, and others as to how to avoid disturbing bald eagles. For mor information, visithhttp://www.fws.gov/migratorybirds/baldeagle.htm Threatened due to similarity of appearance(T(S/A))_ In the November 4, 1997 Federal Register (55822-55825), the northern population of the bog turtle (from New York south to Maryland) was listed as T (threatened), and the southern population (from Virginia south to Georgia) was listed as T(S/A) (threatened due to similarity of appearance). The T(S/A) designation bans the collection and interstate and international commercial trade of bog turtles from the southern population. The T(S/A) designation has no effect on land management activities by private landowners in North Carolina, part of the southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife Service considers the southern population of the bog turtle as a Federal species of concern due to habitat loss. Definitions of Record Status: Current - the species has been observed in the county within the last 50 years. Historic - the species was last observed in the county more than 50 years ago. Obscure - the date and/or location of observation is uncertain. Incidental/migrant - the species was observed outside of its normal range or habitat.
