Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facilities 1) All proposed development and associated construction must be done in accordance with the attached work plat drawings. 2) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires fiu-ther Division approval. All work must cease when the permit expires on December 31, 2008 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Jerry Gower ADDITIONAL CONDITIONS Permit # 01-05 Page 2 of 3 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and condition of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permit authorizes two (2) new boat slips, resulting in a total of 4 slips at the docking facility. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury, which may be caused from existing or future operations undertaken by the United States in the public interest. 10) The authorized structure and activity shall not cause an unacceptable interference with navigation. 11) It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. 12) The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice form the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United states. No claim shall be made against the United States on account of any such removal or alteration. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or from natural causes. b. Damages to the permitted project or uses thereof as a result of current or future Federal activities initiated on behalf of the general public. c. Damages to other permitted or unpermitted activites or structures caused by the authorized activity. d. Design and construction deficiencies associated with the permitted work. e. Damage claims associated with any future modification, suspension, or revocation of this permit. General 14) No portion of any structure shall be located within 80 feet of the near bottom edge of a Federally maintained channel. An as built survey will be performed on the authorized structures within 60 days of project completion and copies of the survey sent to the Wilmington Regulatory Office and the Division of Coastal Management. 15) The West Indian manatee (Trichechus manatus), which is listed as a federally endangered species, has been reported in the waters near Beaufort waterfront. In order to protect the West Indian Manatee, if possible, all work should be done during the period from November 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina" must be followed. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 041642. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 197800080 (COE Action Id. No. 200500034), which was issued on 11/02/04. Field Investigation Report: Jerry Gower Page 02 9. Narrative Description: The location of this project is off Hwy 24 in Cedar Point, Carteret County. Project is loc ated at 210 Jones Street, SR 1214, at the end of the street on the right, where the road ends at the Atlantic Intracoastal Waterway (AIWW), in Bogue Sound. There is an access easement on the east side of the property. John Comer's Mobile home Park is on the west side of the property. High ground area is 2.85 acres of which approximately 55,000sf is coastal marsh and approximately 8,000sf is 404 wetlands. The elevation of the high ground is 5.0' above MSL. The majority of the marsh plants are comprised of Spartina alterniflora and S artina patens. There is an existing house on the property with a driveway on the north side. The septic system is a holding tank with a pump to transport sewage to a field off site. There is an existing dock on the property that is 100' x 5' to a 10' x 32' "L" platform. There are 2 existing boatlifts to the east and west sides of the dock. There is a previous permit for a pier, "L" platform, and mooring pilings at this site, #45-01. The length of the shoreline on this site is 275ft. The applicant proposes a dock extension including a 3' x 18' walkway to an 8' x 35' "L" platform. This would give the applicant an 18' x 32' boat slip between the existing platform and the new platform. The applicant proposes a new boatlift (17' x 18') in this newly created slip. Also proposed is a 3' x 35' walkway to the west from the shore side of the existing platform, with a 5' x 12' finger pier off the walkway on the west side of the existing boatlift. This would create room for a new 10' x 10' boatlift on the west side of the finger pier. Water depths at the end of the new platform would be 3.2' at NLW. Depths along the proposed 3' x 35' walkway would be 2.5' at NLW. There is an 80' setback from the AIWW channel. The east side of the proposed platform would be 30.5' from the edge of the setback; the west side of the platform would be 32.2' from the edge of the setback. The waters of this section of Bogue Sound are classified SA - ORW. The area is open to shellfishing. During the site visit no shellfish or SAV areas w ere observed. The waters are not classified as a PNA. 10. ANTICIPATED IMPACTS: The proposed project would create two new boat slips, which would total four slips for the entire dock, and 499sf of new dock area would shade the bottom. This would add up to 8 19sf of platform area for the entire dock. The total public trust area consumed by this project is 1175sf. The dock addition will be out of the AIWW setback and should not present a hazard to navigation. Construction techniques used on this project would include pile driving equipment and carpentry work. Some increase in turbidity could be expected during the time of the pile driving, but the impacts should be minimal.
