Impacts not indicated in the application is a violation of the Buffer Rule. Site specific work should be provided in the application. [15A NCAC 02H .0506 and 15A NCAC 02B .0243(8)] . Trees are not allowed to be removed from Zone 1 of the Buffer (within 30 ft-of the full pond elevation), unless approved. Exception, those trees that are severely undermined along the immediate shoreline can be removed. Minimal shaping and sloping along the immediate shoreline is allowed. [15A NCAC 02B .0243(6)] Benching, grading in the buffer is not allowed. Excessive disturbance of ground cover. [15A NCAC 02B .0243 (6)] Beaches, impervious patios, impervious walkways, etc. are not allowed in the buffer unless specifically approved by the Division. There are limitation on size for decks. [15A NCAC 02B .0243(4) and (6)] Work to be conducted from land must indicate an access and indicate any trees that are to be removed. The work corridor should be described. The approved access corridor shall be restored. Staging, spoil, construction material must be outside the buffer. [15A NCAC 02H .0502 and 15A NCAC 02B .0243 (4), (6), (8)] Stormwater cannot be piped or channeled for direct, discharge to the lake. All constructed stormwater -discharges must be at the natural elevation and discharged prior to entering the buffer directed as diffuse or sheet flow at non -erosive velocities to the lake. I represent a buyer who is under contract to purchase the Colbert property located at 110 49th Ave PI NW, Hickory NC 28601. In researching this property, it appears that the strip of land to the right of this house that runs from the corner intersection down to the lake is designated on the plat as a utility easement and lake access for the Lake Shore Subdivision. Per the Covenants, Conditions and Restrictions of the Lake Shore Subdivision, this is the only designated common area within the Lake Shore neighborhood. There is some concern regarding liability with this strip of land being privately owned. The original Developer of the Lake Shore subdivision deeded ownership of this easement to the Colberts through a non -warranty deed. This .23 acre parcel of land, has no taxable value, owes no taxes to the City of Hickory or Catawba County, and due to the non -warranty deed status, does not have the ability to carry title insurance. However, the owner of this easement parcel alone, is required to maintain home owner's insurance on the easement should someone become injured and is solely responsible for the maintenance and upkeep of this property, which the sidewalk and the existing pier are both in need of immediate repair. Over the next week, I plan to visit you personally to ask your thoughts regarding this easement. My clients are proposing to keep this strip of land as a designated, privately owned utility easement only, removing the neighborhood lake access verbiage for liability reasons. The other option would be for the Lake Shore Subdivision to formally form a Home Owner's Association and take over the liability and maintenance of this easement with annual _dues to cover the costs of such maintenance, upkeep and insurances. Please be thinking about this and your position as a home owner within the Lake Shore Subdivision, as my client will be asking for your willingness to sign off on the lake access portion of this easement moving forward.
