On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules
(15A NCAC 2B.0233)-EXPRESS REVIEW PROGRAM
Dear Sir or Madam:
On October 4, 2004, at your request I conducted an on-site determination to review one feature
located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B
.0233). The feature is labeled as "A" on the attached maps initialed by me on October 4, 2004.
The Division of Water Quality (DWQ) has determined that the feature labeled as "A" on
the attached maps is subject to the Neuse Buffer Rule, the origin of the feature has been
delineated and flagged in the field. The origin starts off property and remains subject to
flag #LM11, this feature then is not subject from flag #LM1 I to #100, at flag #100 the
feature picks up stream like features again and is subject from flag #100 through to the
confluence of feature B. All other features on this site were not contested and therefore not
evaluated in the field so they remain subject to the Neuse Buffer Rule. These features and
their associated buffers should be identified on any future plans for this property. The owner (or
future owners) should notify the DWQ (and other relevant agencies) of this decision in any
future correspondences concerning this property. This on-site determination shall expire five (5)
years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ or Delegated
Local Authority that a surface water exists and that it is subject to the buffer rule may request a
determination by the Director. A request for a determination by the Director shall be referred to
the Director in writing c/o John Dorney, DWQ Wetlands/401 Unit, 2321 Crabtree Blvd.,
Raleigh, NC 27604-2260. Individuals that dispute a determination by the DWQ or Delegated
Local Authority that "exempts" a surface water from the buffer rule may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. Applicants are
hereby notified that the 60-day statutory appeal time does not start until the affected party
(including downstream and adjacent landowners) is notified of this decision. DWQ recommends

within the buffers. Nor does this letter approve any activity within Waters of the United States

Dear Mr. Methven:
On September 22, 2004, the Division of Water Quality (DWQ) received your additional information for
the application dated July 12, 2004 to impact 0.224 acres of wetlands and 250 feet of streams to construct
the proposed Harrington Point subdivision near I-540 and Leesville Rd. The DWQ has determined that
your application was incomplete and/or provided inaccurate information as discussed below. The DWQ
will require additional information in order to process your application to impact protected wetlands
and/or streams on the subject property. Therefore, unless we receive the additional information requested
below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and
will place this project on hold as incomplete until we receive this additional information. Please provide
the following information so that we may continue to review your project.
Additional Information Requested:
1. Impact Justification (Avoidance and Minimization)
Under Section VII of your application you did not provide a "justification" for the impacts as
requested within this section. We do not believe that you need to impact the same channel twice.
Please redesign your project to have one crossing on the main tributary and (if needed) a second
crossing on the separate tributary at the rear of lots 185 through 190.
2. Stormwater Management
In your recent letter, you requested that the stream crossings be approved "... with the condition that
construction will not begin on future phases until the final stormwater plans have been reviewed and
approved...". As you may be aware, our typical process is to require approval of the final
stormwater plans before impacts occur to wetlands, streams or buffers so we can be certain that the
devices will be installed correctly. In this case, you have not described any compelling reason.,for
changing this process. Indeed, much of the construction and access to the site can occur from
existing roads. Therefore, we believe that approval of the final stormwater plans should be done
before the streams are impacted.

3. Stream and buffer determination
As stated in our earlier letter and reiterated in your response, we will await the written confirmation
of the stream location from DWQ (Ms. Debbie Edwards) before we can issue the approval. Please
refer to this project number when copying us with the written determination.
Please respond within three weeks of the date of this letter by sending this information to me in writing
and Mike Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks,
we will assume that you no longer want to pursue this project and we will consider the project as
withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Mr. John Dorney at 919-733-1786 if you have any

On September 21, 2004, the Wetlands/401 Unit of the Divis`i<on of Water Quality received a Fax/email
request from Soil and Environmental Consultants, PA regarding a stream origin call for a project known
as "Harrington Point" for acceptance into the Express Review Program. This letter advises you that your
project will be accepted into the Express Review Program once the following items are received: 1) a fee
of $200.00 made payable to the North Carolina Division of Water Quality, 2) four complete and collated
copies of the most recent versions of the NRCS Soil Survey map and the 1:24,000 USGS Topographic
map for the site, both with the property boundaries located, and 3) a vicinity map clearly marking the
location of the site. Thank you for your attention to this matter.
Please keep in mind that the clock for this project will not start until receipt of the completed application
package and required fee are received.

(Parkview Building, 2321 Crabtree Blvd., Raleigh, NC 27604) within the first three (3) working days of the
month for the first three months of the Express Review Program (until January 1, 2004). Application
procedures after that time will be provided at a later date. Applicants who are selected to participate in the
Express Review Program will be notified via email or fax with one additional working day. Successful
applicants will then be instructed regarding detailed procedures for full application. Unsuccessful applicants
will be queried to determine if they want to be in the following month's selection process or whether they
want to follow the normal application process.
