Reference your application for a Department of the Army permit to place riprap material
and construct a bulkhead and a pier, on property located off State Road 1776, on the west side of
the Pungo River, at Snake Island, near the Town of Belhaven, Beaufort County, North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of general permit No. 198000291. Therefore, you may commence construction
activity in strict accordance with applicable State authorization and the approved plan. Failure to
comply with the State authorization or conditions of the general permit could result in civil
and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified.

Project Setting
The .4 acre undeveloped residential lot is located off SR 1776 at Snake Island on
the west side of the Pungo River ±.25 mile south of Wrights Creek near Belhaven in
eastern Beaufort County, North Carolina. The undeveloped lot is part of the original
subdivision locally referred to as Snake Island. Although the site consist mostly of
uplands, it is relatively low in elevation only t3' in elevation above the normal water
level (NWL). The site is vegetated mainly with loblolly pine and scattered upland
grasses. The shrubs and vines that once made up the understory have been cleared.
There exist a bulkhead on the shoreline that has experienced catastrophic damage in the
center for a linear distance of ±80'. The highground in this area has eroded landward an
average distance of 18'. The applicant reports that the damage occurred during Hurricane
Floyd. There are intact sections of bulkhead that extend to the property lines on either
side of the damaged area, 44' long to the south and 10' long to the north. The intact
sections still contain the original backfill material. An opportunistic area of Coastal
Wetlands, ±64 ft2, has established itself on the south side of the eroded area. The Coastal
Wetland is vegetated with SSpartina alterniflora. The adjoining property on the south side
has a hardened shoreline stabilized with granite riprap. The adjoining property on the
north side has a hardened shoreline stabilized with a combination of a bulkhead and
riprap. Vehicular access to the project site is through a deeded right-a-way across the
maintained grassed lawn adjacent the shoreline on the neighboring property to the south.
The Pungo River at this location is designated as SA NSW by the Environmental
Commission and Coastal Waters by the Marine Fisheries Commission.
Project Description
The applicant proposes to reconstruct the 80' long failed section of bulkhead in
the original alignment and place riprap on the waterward side along the entire shoreline
for a total distance of 144'. The new section of bulkhead will have an average aligmnent
of 18' waterward of the NWL. The proposed riprap will be placed with a 2:1 slope with
the waterward toe averaging 10' from the proposed and existing bulkhead. The bulkhead
will be backfilled to the original elevation consistent with the elevation of the lot. The
applicant anticipates filing and grading the entire lot. The applicant proposes to fill and
graded a 12' wide gravel road from the property line on the south side to a proposed 20' x
30' concrete pad to serve as a parking area for a 30' long travel/camper trailer.
Wastewater from the camper will be self contained and hauled offsite. The applicant also
proposes to construct a 6' x 100' long pier with a 16' x 16' T-head platform and a 12' x
12' boat lift.
Project Impacts
The project as proposed will result in the filling of ±2,880 ft2 of shallow water
habitat in the Pungo River. The proposed platform in the Pungo River will shade 256ft2 of
river bottom. There will be some short-term localized turbidity associated with the
construction activities below the NWL.

Please find enclosed an application with required attachments for a Major Development Permit.
This permit is for property known as Lot 14A, Snake Island Road (SR 1776) on the Pungo River
in Belhaven, Beaufort County, North Carolina.
The existing bulkhead structure was damaged as a result of Hurricane Floyd. Since that time,
storms have continued to remove additional sections of the bulkhead and erode the property.
This application is to request approval to construct a new wooden bulkhead, install filter cloth and
place granite rock water ward. The eroded area landward of the bulkhead will be backfilled. The
entire property will be graded and seeded with grass to prevent further erosion. This application
also requests the approval for the construction of a 100' pier with T-section and boat lift. A gravel
driveway will also be constructed from the existing private access road to the property.
This property will be used as a family recreational campsite. A concrete slab will be poured and
used as the base for a self-contained camper. Until such time a septic tank permit can be
obtained, sewage will be collected and removed from the property via camper holding tanks.

The Purpose of this request is as follows:
• Repair the existing bulkhead structure,
• Install a structurally tight bulkhead structure where the bulkhead was
destroyed,
• Install granite rock on the water side of the entire bulkhead,
• Backfill behind the bulkhead with dirt,
• Graded and seeded the entire lot with grass,
• Install a rock drive-way from the private access road,
• Install a 100 ft. pier with boat lift.
The following three photos show an example of the construction methods to be
used. The forth photo shows the property prior to the storm damage.
The property will be used as a vacation site consisting of a 30 foot self-contained
camper.

8. PROJECT SUMMARY: The applicant proposes to reconstruct 80' of a damaged bulkhead in the previously existing
alignment averaging 18' waterward of the NWL. Applicant proposes to place riprap on a 2': 1' slope averaging 10'
waterward of the proposed and existing bulkhead for a total length of 144'. Applicant also proposes to construct a 6'
x 100' pier, a gravel driveway and a 20' x 30' concrete pad for a 30' long camper trailer.

Project Setting
The .4 acre undeveloped residential lot is located off SR 1776 at Snake Island on
the west side of the Pungo River ±.25 mile south of Wrights Creek near Belhaven in
eastern Beaufort County, North Carolina. The undeveloped lot is part of the original
subdivision locally referred to as Snake Island. Although the site consist mostly of
uplands, it is relatively low in elevation only f3' in elevation above the normal water
level (NWL). The site is vegetated mainly with loblolly pine and scattered upland
grasses. The shrubs and vines that once made up the understory have been cleared.
There exist a bulkhead on the shoreline that has experienced catastrophic damage in the
center for a linear distance of ±80'. The highground in this area has eroded landward an
average distance of 18'. The applicant reports that the damage occurred during Hurricane
Floyd. There are intact sections of bulkhead that extend to the property lines on either
side of the damaged area, 44' long to the south and 10' long to the north. The intact
sections still contain the original backfill material. An opportunistic area of Coastal
Wetlands, ±64 W, has established itself on the south side of the eroded area. The Coastal
Wetland is vegetated with SSpartina alterniflora. The adjoining property on the south side
has a hardened shoreline stabilized with granite riprap. The adjoining property. on the
north side has a hardened shoreline stabilized with a combination of a bulkhead and
riprap. Vehicular access to the project site is through a deeded right-a-way across the
maintained grassed lawn adjacent the shoreline on the neighboring property to the south.
The Pungo River at this location is designated as SA NSW by the Environmental
Commission and Coastal Waters by the Marine Fisheries Commission.
Project Description
The applicant proposes to reconstruct the 80' long failed section of bulkhead in
the original alignment and place riprap on the waterward side along the entire shoreline
for a total distance of 144'. The new section of bulkhead will have an average aligmnent
of 18' waterward of the NWL. The proposed riprap will be placed with a 2:1 slope with
the waterward toe averaging 10' from the proposed and existing bulkhead. The bulkhead
will be backfilled to the original elevation consistent with the elevation of the lot. The
applicant anticipates filing and grading the entire lot. The applicant proposes to fill and
graded a 12' wide gravel road from the property line on the south side to a proposed 20' x
30' concrete pad to serve as a parking area for a 30' long travel/camper trailer.
Wastewater from the camper will be self contained and hauled offsite. The applicant also
proposes to construct a 6' x 100' long pier with a 16' x 16' T-head platform and a 12' x
12' boat lift.
Project Impacts
The project as proposed will result in the filling of ±2,880 ft2 of shallow water
habitat in the Pungo River. The proposed platform in the Pungo River will shade 256ft2 of
river bottom. There will be some short-term localized turbidity associated with the
construction activities below the NWL.

Please find enclosed an application with required attachments for a Major Development Permit.
This permit is for property known as Lot 14A, Snake Island Road (SR 1776) on the Pungo River
in Belhaven, Beaufort County, North Carolina.
The existing bulkhead structure was damaged as a result of Hurricane Floyd. Since that time,
storms have continued to remove additional sections of the bulkhead and erode the property.
This application is to request approval to construct a new wooden bulkhead, install filter cloth and
place granite rock water ward. The eroded area landward of the bulkhead will be backfilled. The
entire property will be graded and seeded with grass to prevent further erosion. This application
also requests the approval for the construction of a 100' pier with T-section and boat lift. A gravel
driveway will also be constructed from the existing private access road to the property.
This property will be used as a family recreational campsite. A concrete slab will be poured and
used as the base for a self-contained camper. Until such time a septic tank permit can be
obtained, sewage will be collected and removed from the property via camper holding tanks.

D. Description of purpose:
The Purpose of this request is as follows:
• Repair the existing bulkhead structure,
• Install a structurally tight bulkhead structure where the bulkhead was
destroyed,
• Install granite rock on the water side of the entire bulkhead,
• Backfill behind the bulkhead with dirt,
• Graded and seeded the entire lot with grass,
• Install a rock drive-way from the private access road,
• Install a 100 ft. pier with boat lift.
The following three photos show an example of the construction methods to be
used. The forth photo shows the property prior to the storm damage.
The property will be used as a vacation site consisting of a 30 foot self-contained
camper.

This permit, issued on January 21, 2005 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Shoreline Stabilization
1) The alignment of the permitted bulkhead and riprap shall be staked by a representative of the Division
of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to
initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall
require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected
start of construction.
2) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
3) The bulkhead shall be constructed prior to any backfilling activities.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2008
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of fill materials in waters or vegetated wetlands shall not
be authorized.
5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation shall be permitted except for that
which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This
permit does not authorize. any excavation waterward of the approved alignment.
6) The fill material shall be clean and free of any pollutants except in trace quantities.
7) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
8) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead.
9) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to
prevent its movement from the site by wave or current action.
10) The riprap material shall consist of clean rock, marl, or masonry materials such as but not limited to
granite or broken concrete.
The toe of the authorized riprap shall not extend waterward more than 10' from the approved bulkhead
alignment.
DockinLy Facilities
12) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
13) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, may become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.
14) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.

15) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
17) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation.
18) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit, The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
19) This permit shall not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
20) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
General
21) No fill material shall be placed at any time in any vegetated wetlands, marsh, or surrounding waters
outside of the alignment of the fill area indicated on the workplan drawings.
22) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the. structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.

NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water

Approval of 401 Water Quality Certification (GC3351), Authorization Certificate per the Tar-
Pamlico River Buffer Protection Rules (15A NCAC 2B.0259) and Approval to use the Coastal
General Variance with Additional Conditions
Dear Mr. Harrison:
You have our approval, in accordance with the attached conditions, to place fill material within or
otherwise impact 0.001 acres of wetlands, 0.071 acres of waters and 17,208 square feet of buffers as
described in your application received by the Division of Watei Quality (DWQ) Wetlands/401 Unit on
September 21, 2004. After reviewing your application, we have\\determined that the Division of Water
Quality (DWQ) General Water Quality Certification Number 335\1 covers these water impacts. This
Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of
Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to
the protected riparian buffers per 15A NCAC 2B .0259. In addition, you should get or otherwise comply
with any other federal, state and local requirements before you go ahead with your project including (but
not limited to) erosion and sediment control regulations and LAMA. Also, this approval to proceed
with your proposed impacts or to conduct impacts to waters as depicted in your application shall
expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

Coastal General Variance - This letter shall act as your approval for the use of the "General" Major
Variance; From the Neuse and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential
Structures on Existing Lots within the Coastal Counties as defined by the Coastal Area Management
Act with ADDITIONAL CONDITIONS as approved by the Water Quality Committee (WQC) of the
Environmental Management Commission (EMC) on May 10, 2001. This approval is required for the
installation of the gravel driveway.
3. Certificate of Completion - Upon completion of all work approved within the 401 Water Quality
Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required
to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of
Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
4. Water Quality Certification - The proposed project must comply with all of the conditions of General
Water Quality Certification (GC) 3351.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act\within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved
buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is
subject to review as provided in Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act and the Tar-Pamlico riparian buffer protection rule as described within 15A NCAC 2B .0259. If you

8. PROJECT SUMMARY: The applicant proposes to reconstruct 80' of a damaged bulkhead in the previously existing
alignment averaging 18' waterward of the NWL. Applicant proposes to place riprap on a 2': F slope averaging 10'
waterward of the proposed and existing bulkhead for a total length of 144'. Applicant also proposes to construct a 6'
x 100' pier, a gravel driveway and a 20' x 30' concrete pad for a 30' long camper trailer.

Project Setting
The .4 acre undeveloped residential lot is located off SR 1776 at Snake Island on
the west side of the Pungo River ±.25 mile south of Wrights Creek near Belhaven in
eastern Beaufort County, North Carolina. The undeveloped lot is part of the original
subdivision locally referred to as Snake Island. Although the site consist mostly of
uplands, it is relatively low in elevation only t3' in elevation above the normal water
level (NWL). The site is vegetated mainly with loblolly pine and scattered upland
grasses. The shrubs and vines that once made up the understory have been cleared.
There exist a bulkhead on the shoreline that has experienced catastrophic damage in the
center for a linear distance of ±80'. The highground in this area has eroded landward an
average distance of 18'. The applicant reports that the damage occurred during Hurricane
Floyd. There are intact sections of bulkhead that extend to the property lines on either
side of the damaged area, 44' long to the south and 10' long to the north. The intact
sections still contain the original backfrll material. An opportunistic area of Coastal
Wetlands, ±64 W, has established itself on the south side of the eroded area. The Coastal
Wetland is vegetated with SSpartina alterniflora. The adjoining property on the south side
has a hardened shoreline stabilized with granite riprap. The adjoining property on the
north side has a hardened shoreline stabilized with a combination of a bulkhead and
riprap. Vehicular access to the project site is through a deeded right-a-way across the
maintained grassed lawn adjacent the shoreline on the neighboring property to the south.
The Pungo River at this location is designated as SA NSW by the Environmental
Commission and Coastal Waters by the Marine Fisheries Commission.
Project Description
The applicant proposes to reconstruct the 80' long failed section of bulkhead in
the original aligmnent and place riprap on the waterward side along the entire shoreline
for a total distance of 144'. The new section of bulkhead will have an average aligmnent
of 18' waterward of the NWL. The proposed riprap will be placed with a 2:1 slope with
the waterward toe averaging 10' from the proposed and existing bulkhead. The bulkhead
will be backfilled to the original elevation consistent with the elevation of the lot. The
applicant anticipates filing and grading the entire lot. The applicant proposes to fill and
graded a 12' wide gravel road from the property line on the south side to a proposed 20' x
30' concrete pad to serve as a parking area for a 30' long travel/camper trailer.
Wastewater from the camper will be self contained and hauled offsite. The applicant also
proposes to construct a 6' x 100' long pier with a 16' x 16' T-head platform and a 12' x
12' boat lift.
Project Impacts
The project as proposed will result in the filling of ±2,880 ftZ of shallow water
habitat in the Pungo River. The proposed platform in the Pungo River will shade 256ft2 of
river bottom. There will be some short-term localized turbidity associated with the
construction activities below the NWL.

Please find enclosed an application with required attachments for a Major Development Permit.
This permit is for property known as Lot 14A, Snake Island Road (SR 1776) on the Pungo River
in Belhaven, Beaufort County, North Carolina.
The existing bulkhead structure was damaged as a result of Hurricane Floyd. Since that time,
storms have continued to remove additional sections of the bulkhead and erode the property.
This application is to request approval to construct a new wooden bulkhead, install filter cloth and
place granite rock water ward. The eroded area landward of the bulkhead will be backfilled. The
entire property will be graded and seeded with grass to prevent further erosion. This application
also requests the approval for the construction of a 100' pier with T-section and boat lift. A gravel
driveway will also be constructed from the existing private access road to the property.
This property will be used as a family recreational campsite. A concrete slab will be poured and
used as the base for a self-contained camper. Until such time a septic tank permit can be
obtained, sewage will be collected and removed from the property via camper holding tanks.

The Purpose of this request is as follows:
• Repair the existing bulkhead structure,
• Install a structurally tight bulkhead structure where the bulkhead was
destroyed,
• Install granite rock on the water side of the entire bulkhead,
• Backfill behind the bulkhead with dirt,
• Graded and seeded the entire lot with grass,
• Install a rock drive-way from the private access road,
• Install a 100 ft. pier with boat lift.
The following three photos show an example of the construction methods to be
used. The forth photo shows the property prior to the storm damage.
The property will be used as a vacation site consisting of a 30 foot self-contained
camper.
