PROJECT SUMMARY: The applicant proposes to develop a 14-lot subdivision including roads and utilities. Jerry Reeves Page Two 9. PROJECT DESCRIPTION Applied Resource Management, P.C., on behalf of Jerry Reeves, has requested that the attached application be processed under the Express Permit Review Pilot Program. The applicant's project is located off of Dogwood Lane, at the intersection of Dogwood Lane and Washington Acres Road, adjacent to the Atlantic Intracoastal Waterway (AIWW) and Topsail Sound, in Hampstead, Pender County. To find the property, take Highway 17 North from Wilmington and turn right on Washington Acres Road. Head east on Washington Acres Road and turn right onto Dogwood Lane. The property is located immediately to the left at the intersection of Dogwood Lane and Washington Acres Road. The Hammock Watch tract is a 10.33 acre parcel that is dominated by both coastal wetlands and "404" type wetlands. The high ground portion of the tract is mostly cleared of vegetation and ranges in elevation, between 3' to 31` above Normal Low Water (NLW). The upland section of the property is dominated by Oaks (Quercus spp.) and Red Maples (Acer Rubrum). Southern Wax Myrtles (Merica cerifera), Yaupons (Ilex vomitoria) and Red Cedars (Juniperus virginiana) are located in the lower sections of the high ground on the water ward side of the site, bordering Topsail Sound. There is an existing dirt road that enters the property from Dogwood Lane and continues east across the high ground section approximately 600 feet towards Topsail Sound. The tract has approximately 700 linear feet of shoreline along Topsail Sound. The high ground vegetation is bordered by transitional species including Sea Oxeye (Borrichia frutescens) and Grounsel-bush (Baccharus halimifolia). High coastal marsh vegetation, including, Black Needle Rush (Juncus roemarianus), Spike Grass (Distichlis spicata), Sea Lavender (Limonium, spp.), and Glasswort (Salicornia). Salt Meadow Grass (Spartina patens) complete the transition to the waters edge where Smooth Cordgrass Marsh (Spartina alterniflora) is the predominant species. The shoreline in this area is not bulk-headed. The proposed development averages approximately 200 feet landward of normal high water (NHW), along the eastern edge of the property. The waters of Topsail Sound, adjacent to the project site, are classified as SA-ORW by the North Carolina Division of Water Quality. The area is designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. According to maps provided by the Department of Environmental Health, Shellfish Sanitation Section, the area located immediately north of the project site is CLOSED to the harvesting of shellfish, however, the waters bordering the subject property to the south are OPEN. PROPOSED PROJECT The applicant proposes to develop a 14 lot subdivision. Development would include grading and filling approximately 2.36 acres of the property for road construction and lot preparation. Individual lots sizes would average 20,000 square feet - a density of 1.64 units/acre. Access to the lots will be provided by the construction of a single road (Hammock Watch Way). The road would provide the subdivision with one entrance and exit from Washington Acres Road. The asphalt road would terminate in a turn around cul-de-sac at the eastern end of the property. Hammock Watch Way would consist of a 50 foot right-of-way and a 22 foot paved asphalt surface with an ABC stone sub-base. The road would be constructed with curb and gutter, utilizing curb breaks and vegetated swales to control stormwater. The applicant has received a Low Density Stormwater Permit issued by the North Carolina Division of Water Quality. The Express Stormwater permit application was received on 6/9/2004 and was permitted under DWQ State Stormwater Permit No. SW8040520. According to the site drawings, the total built upon area for each lot would be limited to 6,000 square feet. Jerry Reeves Page Three In addition, the applicant has an approved Sedimentation and Erosion Control Plan (No.Pende-2004-321), which was validated on 6/16/2004 by the Division of Land Quality. Water would be provided to the subdivision by private individual water supply wells. As proposed, no portion of the subdivision, including but not limited to the dwellings, eaves, access roads, driveways, streets and/or sidewalks will impact any portion of coastal wetlands or "404" type wetlands. The applicant has indicated that individual lot development would be handled under the CAMA minor permit program. 10. ANTICIPATED IMPACTS: The initial grading of the property would result in the disturbance of approximately 2.36 acres of high ground. The proposed street and utilities would result in the creation of approximately 25,711 square feet of impervious surface. Total impervious surface coverage, for road construction and utilities installation, within the 575' Estuarine Shoreline AEC would be 3.6%. Future individual lot owners would be required to obtain CAMA Minor Development Permits from the Town of North Topsail Beach for each lot. Submitted by: Jason Dail Date: September 13, 2004 Office: Wilmington Recommendations for State Permit - Jerry Reeves It is recommended that a permit be issued subject to the following conditions: • In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. • In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. • Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). • A ground cover sufficient to restrain erosion shall be provided within the minimum of 15 working or 30 calendar days of completion of any phase of grading on cut or filled slopes. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level.
