Director Division of Water Quality December 16, 2004 DWQ Project # 04-1522 Wake County Lot 138, Northampton Subdivision, Wake Forest, NC Henry M. & Mary Kathryn Keleher, Owners On December 16, 2004, the Division of Water Quality (DWQ) received your request to exempt Lot 138 from the Neuse River Buffer Rules, 15A NCAC 02B .0233. Please note that the DWQ does not have the authority to exempt any property from the Neuse River Buffer Rule. The exemption that you referred to in your letter under Section 7(a) of the buffer rule, pertains to the to "uses" classified as "exempt" within the "Table of Uses (Section 6) and does not grant any authority to the DWQ to exempt properties from the buffer rule. One option that you do have is to request a Major Variance as provided for in Section 9 of the buffer rule. However, this property is most likely not eligible for a Major Variance in that a Minor Variance has already been approved for the property to allow a home to be built on it. As such, it has already been demonstrated that the owner can make reasonable use of the property without impacting Zone 1 and thereby minimize the overall impacts to the buffers. For this reason, the DWQ would most likely not recommend the approval of any Major Variance for this property that would exempt the stream totally from the protections of the Neuse Buffer Rule. If you choose to pursue a Major Variance, then you will need to submit three draft copies of the attached Variance Request form to the DWQ for review. The DWQ will perform a finding of fact as per Section 9 of the rule and will work with you in providing a complete variance request package. This complete package, including the preliminary findings of the DWQ, will be presented at the next available Water Quality Committee (WQC) meeting of the N.C. Environmental Management Commission. The next available WQC meeting is scheduled for March 9, 2005. To be eligible for this meeting your final variance request package will need to be completed within approximately 3 weeks prior to the meeting. Please note that the DWQ has already approved an after-the-fact Minor Variance for an existing home on this property and the DWQ 401 Oversight / Express Review Unit has provided a recommendation to the DWQ Raleigh Regional Office that they not pursue enforcement of any violation that has previously occurred on this property as it pertains to the construction of the home. Director Division of Water Quality September 16, 2004 Subject Property: Lot 138, Phase IV, Northampton S/D, Wake Forest, NC UT to Sanford Creek [03-04-02, 27-23-5, C NSW (nutrient sensitive)] DWQ # 04-1522 Wake County Page 1 of 2 APPROVAL of Neuse River Riparian Buffer Protection Rules MINOR VARIANCE [15A NCAC 2B.0233(9)(b)] Dear Mr. & Mrs. Keleher: You have our approval, in accordance with the conditions listed below, to impact approximately 289 square feet (ft2 ) of Zone 2 of the protected buffers to construct home at the subject property as described within your variance request dated August 10, 2004 and received by the Division of Water Quality (DWQ) on September 2, 2004. This letter shall act as your Minor Variance approval as described within 15A NCAC 2B .0233(9)(b). In addition to this approval, you should obtain or otherwise comply with any other required federal, state or local permits\before you go ahead with your project including (but not limited to) Erosion and Sediment Control regulations. ?. This approval is only valid for the purpose and design that you described ip your application. If you change your project, you must notify us and you may be required to send us a new application. ',If the property is sold, the new owner(s) must be given a copy of this variance approval and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow any conditions listed below. Conditions: After-the-Fact Approval - It is the understanding of the DWQ that the house on Lot 138 has already been constructed. Mr. John Phelps (surveyor) stated within his letter that he had failed to show the Neuse River Buffers on Lots 137, 138 and 139 due to an isolated stream reach that was difficult to read on the approved buffer determination sketch map. The lots have since been accepted by the local municipality and are in various stages of development. He also stated that no house currently exists on Lot 137 and the house built on Lot 139 is "well clear of the buffers" and that the only variance that will be needed is for Lot 138. Due in part to the fact that Mr. Phelps has brought this matter to our attention immediately after discovering the mistake, the DWQ has agreed to approve the after-the-fact variance request. Please note that this approval does not prevent the ability of the DWQ Raleigh Regional Office (RRO) from pursuing enforcement of any water quality regulations including the Neuse Buffer Rule. However due to the honest mistake made by the Mr. Phelps and the fact than he had brought it to the Division's attention prior to us discovering it on our own, this office does not recommend that the RRO pursue any additional enforcement as it relates to this property. 2. Buffers on Surveys -The owners of Lot 138 and the future owners of Lots 137 and 139 shall be given surveys of their lots that clearly depict the location of the stream and associated riparian buffers protected under the Neuse Buffer Rule, 15A NCAC 02B.0233. 3. No Zone 1 Impacts - No impacts (except for "exempt" uses as identified within 15A NCAC 26 .0233) shall occur to Zone 1 of the protected riparian buffers unless otherwise approved by the DWQ. Buffer Mitigation (EEP) - You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to compensate for impacts to the protected riparian buffers is 433.5 square feet (289 x 1.5) as required under this variance approval and 15A NCAC 2B .0242. We understand that you wish to make a payment into the Riparian Buffer Restoration Fund administered by the NC Ecosystem Enhancement Program (EEP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. In accordance with 15A NCAC 2B .0242, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0233(9)(C). Until the EEP receives and clears your check (made payable to: DENR - Ecosystem Enhancement Program Office), no impacts specified in this variance approval shall occur. The EEP should be contacted at (919) 733-5208 if you have any questions concerning payment into the Riparian Buffer Restoration Fund. For accounting purposes, this variance approval authorizes payment into the Riparian Buffer Restoration Fund to compensate for 433.5 ft2 of required riparian buffer mitigation for impacts to 289 ft2 of protected riparian buffers; 03-04-02 river and subbasin, 27-23-5 stream index number." The DWQ will also accept an alternative method of mitigation (including but not limited to Buffer Restoration or Enhancement) pursuant to the Buffer Mitigation Rule (15A NCAC 02B .0242) to satisfy this mitigation requirement. If you choose to pursue this option, then you are required to submit in writing a mitigation plan to the DWQ Wetlands/401 Unit for review and approval. No impacts shall occur to the protected buffers until the mitigation plan is approved by the DWQ. 5. Diffuse Flow -An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B.0233(5). Requests for appeals of this decision shall be made to the Office of Administrative Hearings. If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its conditions are final and binding unless you ask for a hearing. This Minor Variance Approval shall expire five (5) years from the date of this letter. This letter shall act as your Minor Variance approval as described within 15A NCAC 2B .0233(9)(b). In addition to this approval, you should obtain or otherwise comply with any other required federal, state or local permits',before you go ahead with your project including (but not limited to) Erosion and Sediment Control regulations. This approval is only valid for the purpose and design that you described In your application. If you change your project, you must notify us and you may be required to send us a new application. If the property Is sold, the new owner(s) must be given a copy of this variance approval and Is thereby responsible for complying with all conditions. For this approval to be valid, you must follow any conditions listed below. Conditions: 1. After-the-Fact Approval - It is the understanding of the DWQ that the house on Lot 138 has already been constructed. Mr. John Phelps (surveyor) stated within his letter that he had failed to show the Neuse River Buffers on Lots 137, 138 and 139 due to an isolated stream reach that was difficult to read on the approved buffer determination sketch map. The lots have since been accepted by the local municipality and are in various stages of development. He also stated that no house currently exists on Lot 137 and the house built on Lot 139 is "well clear of the buffers" and that the only variance that will be needed is for Lot 138. Due in part to the fact that Mr. Phelps has brought this matter to our attention immediately after discovering the mistake, the DWQ has agreed to approve the after-the-fact variance request. Please note that this approval does not prevent the ability of the DWQ Raleigh Regional Office (RRO) from pursuing enforcement of any water quality regulations including the Neuse Buffer Rule. However due to the honest mistake made by the Mr. Phelps and the fact that he had brought it to the Division's attention prior to us discovering it on our own, this office does not recommend that the RRO pursue any additional enforcement as it relates to this property. 2. Buffers on Surveys - The owners of Lot 138 and the future owners of Lots 137 and 139 shall be given surveys of their lots that clearly depict the location of the stream and associated riparian buffers protected under the Neuse Buffer Rule, 15A NCAC 02B .0233. 3. No Zone 1 Impacts - No impacts (except for "exempt" uses as identified within 15A NCAC 2B .0233) shall occur to Zone 1 of the protected riparian buffers unless otherwise approved by the DWQ. The required area of mitigation to compensate for impacts to the protected riparian buffers is 433.5 square feet (289 x 1.5) as required under this variance approval and 15A NCAC 2B .0242. We understand that you wish to make a payment into the Riparian Buffer Restoration Fund administered by the NC Ecosystem Enhancement Program (EEP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. In accordance with 15A NCAC 2B .0242, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0233(9)(C). Until the EEP receives and clears your check (made payable to: DENR - Ecosystem Enhancement Program Office), no impacts specified in this variance approval shall occur. The EEP should be contacted at (919) 733-5208 if you have any questions concerning payment into the Riparian Buffer Restoration Fund. The DWQ will also accept an alternative method of mitigation (including but not limited to Buffer Restoration or Enhancement) pursuant to the Buffer Mitigation Rule (15A NCAC 02B .0242) to satisfy this mitigation requirement. If you choose to pursue this option, then you are required to submit in writing a mitigation plan to the DWQ Wetlands/401 Unit for review and approval. No impacts shall occur to the protected buffers until the mitigation plan is approved by the DWQ. 5. Diffuse Flow -An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B.0233(5). Requests for appeals of this decision shall be made to the Office of Adm'inistrative' Hearings. If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing: You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 1506 of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714.
