Box 549 Wanchese, NC 27981 Dear Sirs: This letter is in regard to your application request under the Coastal Area Management Act (CAMA) to construct the Broad Creek Marina adjacent to N.C. Seafood Industrial Park property in Wanchese, Dare County. Processing of the application, which was received as complete by the Division of Coastal Management's Elizabeth City office on September 7, 2004, is now complete. Based on the state's review, the Division of Coastal Management has made the following findings: 1) The proposed project would be constructed within the Wanchese Harbor Basin, a heavily utilized man-made basin adjoining Mill Creek, off the Roanoke Sound. The width of the harbor basin in . the vicinity of the proposed marina facility is approximately 500 feet at its narrowest point. 2) The proposed marina facility will extend approximately 250 feet into, or 50 percent across, the Harbor basin. 3) During the course of the joint State and Federal agency review process, the N.C. Division of Marine Fisheries (DMF) expressed concern about the proposed project's potential impact to navigation into and out of the Harbor. 4) During the course of the public review process, letters of objection were received from two individuals, each of whom own a business in the vicinity of the proposed ma rina. These objections were due to anticipated negative impacts to navigation within the Harbor. 5) Based upon the findings outlined above, the proposed project has been determined to be inconsistent with the following Rules of the Coastal Resources Commission: 15A NCAC 07H.0207(d), which states"..., any use which significantly interferes with the public right of navigation or other public trust rights which the public may be found to have in these areas shall not be allowed.", 15A NCAC 07H.0208(a)(2)(H), which states "Development shall not impede navigation or create undue interference with access to, or use of, public trust areas or estuarine waters. Seafood Industrial Park January 20, 2005 Page 2 15A NCAC 07H.0208(b)(5)(H), which states "Marinas shall be designed to minimize adverse effects on navigation and public use of public trust areas while allowing the applicant adequate access to deep waters. " and 15A NCAC 07H.0208(b)(6)(J)(iii), which states "Pier length shall be limited by not extending more than one-fourth the width of a natural water body, or human-made canal or basin. ". Given the preceding findings, it is necessary that your request for issuance of a CAMA Major Permit be denied.: This denial is made pursuant to N.C.G.S. 113A-120 (a)(8), which requires denial for projects inconsistent with the state guidelines for Areas of Environmental Concern or local land use plans. If you wish to appeal this denial, you are entitled to a hearing. The hearing will involve appearing before an Administrative Law Judge who listens to evidence and arguments of both parties and then makes a recommendation to the Coastal Resources Commission. Your request for a hearing must be in the form of a written petition, complying with the requirements of §15013 of the General Statutes of North Carolina, and must be filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714, (919) 733-2698, within twenty (20) days from the date of this letter. A copy of this petition should be filed with the Division of Coastal Management's Raleigh office. Also, you should be advised that as long as this state permit renewal denial stands, your project must be deemed inconsistent with the N.C. Coastal Management Program, thereby precluding the issuance of federal permits for this project. The Federal Coastal Zone Management Act (CZMA) gives you the right to appeal this finding to the U.S. Secretary of Commerce within thirty (30) days of receipt of this letter. Your appeal must be on the grounds that the proposed activity is (1) consistent with the objectives or purposes of the CZMA, or (2) is necessary in the interest of national security, and thus, may be federally approved. 2808. After reviewing your application, we have determined that theI)ivision of Water Quality (DWQ) General Water Quality Certification Number 3351 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). FIELD INVESTIGATION REPORT: NC Seafood Industrial Park Authority Page 2 PROJECT SETTING The NC Seafood Industrial Park is located on 54 acres adjacent to a manmade basin adjoining Mill (Landing) Creek off the Roanoke Sound and at 898 Harbor Road (SR-1140) in Wanchese, Dare County. The Park is proposing further development of Lots 22 and 23, which has a combined area of 97,500 square feet and a basin shoreline of 390 feet. Existing development on the site consists of a shoreline bulkhead with a 25-feet wide concrete pad that parallels the entire shoreline, 22 boat slips with a 6-feet wide wooden dock parallel to the shoreline, a travel lift dock, a dry storage building, repair shops, public toilet, and a marina office. Little or no vegetation exists on the lot, which is covered in most areas with marl. Lot elevation is approximately 8 feet above Normal Water Level (NWL). The waters of Mill Creek are classified as SC by the Division of Environmental Management and are closed to shellfish taking. The water depth in the basin immediately adjacent to this property is approximately -12 feet. Archeological site #110 is located in close proximity to this property. DEVELOPMENT PROPOSAL The applicant proposes to construct a 32-slip floating dock within the Wanchese Harbor Basin. The proposed dock system will be 8 feet wide with three legs. The first leg will be 220 feet long, perpendicular to the shoreline and located toward the north in the basin. A second leg, 260 feet long, will be connected to the waterward end of the first leg and will be parallel to the shoreline. This leg will have 12 finger piers, 10 feet long and 4-1/2 feet wide, and 44 mooring pilings to create 26 slips. Thirteen slips will be 20 feet wide and 40 feet long and be located on the inboard side of the dock, and the remaining 13 slips will be 20 feet wide and 30 feet long and be located on the outboard side. The third leg is proposed to be constructed on the south side of the basin and be 220 feet long. This leg will have six slips created by 8 mooring pilings. The proposed structure will create a small harbor area that is enclosed by the floating docks within the basin. A 40-feet wide entrance located on the southwest corner will provide access to the interior slips. ANTICIPATED IMPACTS The development proposal will result in the covering of 5,870 square feet of Public Trust Area and Estuarine Waters, Areas of Environmental Concern (AEC) within the manmade basin that is Wanchese Harbor. The proposed slips, including finger piers, will occupy 21,500 square feet of the harbor area, and the floating dock enclosure will capture approximately 66,000 square feet of the harbor area. Mill Landing Creek was approximately 60 feet wide prior to the excavation of the harbor basin by the State of North Carolina. The project, as proposed, will be within the footprint of the manmade basin. Although a fairway, approximately 200 feet wide, will remain available for navigation, traditional navigational use will be diminished. There will be an increase in boat traffic as a result of the project. Temporary water turbidity will occur during construction.
