Director Division of Water Quality February 25, 2005 Lincoln County o' - 1 01 d *??', On October 22, 2004, you were issued approval for a shoreline stabilization project on Lake Norman a e subject site. Prior to the issuance of the approval, Mr Alan Johnson of this office met with your representatives at the site and discussed the Catawba Riparian Buffer Rules. Since issuance of the approval this office has received numerous complaints regarding impacts to the buffer and the lake. Consequently, Mr. Johnson visited the site on January 10, 2005 and verified the impacts to the buffer. Approximately 75 ft. of shoreline has been cleared and numerous trees (12-inch or greater in diameter) have been removed from the buffer. Also, it appears dredge material has been placed in Zone 1 of the buffer. On February 24, 2005, Mr. Johnson again visited the site to follow up on the matter. Because of the dredge material, it was difficult to determine the exact location of the 760 elevation. Therefore, it is requested that within 30 days of receipt of this letter, the 760 elevation needs to be identified and marked. Once this has been completed, please notify this office in writing so that a proper assessment of the buffer can be conducted. Be advised that because the original land tract has been subdivided into three separate lots, a 50-foot buffer now applies to each of the lots. Zone 1 is the first 30 feet landward from the 760 elevation and Zone 2 is the remaining 20 feet. Zone 1 must remain natural and untouched. Zone 2 may be cleared and graded, however, it must be returned to a vegetative cover. Brent Dr. Huntersivlle, NC 28078 Subject Property: Cindy Lane and Belford Lane APPROVAL of 401 Water Quality Certification and Authorization Certificate per the Catawba River Buffer Protection Rules (15A NCAC 2B .0243) with Additional Conditions Dear Mr. Anderson: You have our approval, in accordance with the attached conditions and those listed below, to place fill in or to otherwise impact approximately 0.02 acre of waters and 0.02 acre of protected riparian buffers for the purpose of installing riprap along approximately 365 linear feet of shoreline on Lake Norman, as described in your application received on September 8, 2004. After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3373, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands. The General Certification allows you to use Regional Permit No. 198200030 once it is issued to you by the U.S. Army Corps of Engineers (USACOE). This letter also serves as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0243. Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. The above noted Certification will expire when the associated USACOE's 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby responsible for complying with all conditions. If the total wetland fill for this project (now or in the future) exceeds one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). In addition to the requirements of the certification, the following conditions also apply to this approval: 1. All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers so as not to re-concentrate before discharging into the stream (as identified in 15A NCAC 213.0243 (5)). 2. No trees are to be removed (unless approved) from the buffer, and impacts to the ground cover shall be kept to a minimum during the construction of the seawall. 3. Upon completion of the project, the applicant/responsible party shall complete and return the enclosed "Certificate of Completion" form to the Division of Water Quality's 401/Wetlands Unit.
