ADDITIONAL INFORMATION In addition to the completed application form, the following items must be submitted: • A copy of the deed (with state application only) or other instrument under which the applicant claims title to- the affected properties. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims tide, plus written permission from the owner to carry out the project. • An accurate, dated work plat (including plan view and cross-sectional drawings) drawn to scale in black ink on an 8 1/2" by 11" white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the Revised 03/95 Form DCM-MP-1 site. Include highway or secondary road (SR) numbers, landmarks, and the like. • A Stormwater Certification, if one is necessary. • A list of the names and complete addresses of the adjacent waterfront (riparian) landowners and signed return receipts as proof that such owners have received a copy of the application and plats by certified mail. Such landowners must be advised that they have 30 days in which to submit comments on the proposed project to the Division of Coastal Management. PROJECT DESCRIPTION: The project site is located at 8520 Bald Eagle Lane, adjacent to the Atlantic Intracoastal Waterway and Middle Sound, in New Hanover County. To locate the property from Market Street (NC Highwayl7), turn onto Porter's Neck Road and travel east approximately 2 miles. At the stop sign, turn left onto Bald Eagle Lane and travel north approximately 0.3 miles. The property of interest would be located on the right at 8520 Bald Eagle Lane. The lot is approximately 1.2 acres with 100' of shoreline frontage and averages 20 feet above mean sea level. The applicant's property consists of an abandoned single-family residence, which is currently being relocated off the property to another site. Upland vegetation, consists of hardwood species which include Oak, Dogwood, Pecan, Pine and Cedar. Other present upland vegetation consists of Pampas grass and lawn grasses in an area of approximately 50 feet wide, which transitions into the high marsh of mixed coastal wetland and "404 type" vegetation including Marsh Elder (Iva frutescens), Grounsel-bush (Baccharus halimifolia), Cattail (Typha spp.), Wax Myrtle (Myrica cerifera L.), Sea Ox-eye (Borrichia frutescens), Marsh Pennywort (Hydrocotyle umbellata L.) and Salt Meadow Grass (Spartina patens). Low marsh consists primarily of Smooth Cordgrass (Spartina alterniflora), which covers an area approximately 112 feet wide to the AIWW and Middle Sound. The New Hanover County Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the AIWW and Middle Sound are classified SA-ORW by the Division of Water Quality. They are NOT designated as a Primary. Nursery Area by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a private pier system at a distance 216 feet towards the AIWW. The pier would extend approximately 120 feet waterward of the outer edge of coastal wetlands and would terminate in a gazebo (14' x 14') over open water with (1) (6' x 33') floating dock and ramp placed on the southern side of the pier perpendicular to the AIWW. In between the northern side of the floating dock and the southern side of the gazebo would be placed (1) (14'x 15) boat lift. An additional boat lift (6'x 8') would be placed landward of the ramp leading to the floating dock, which would be attached to the southern side of the pier. The structure would provide docking space for up to three (3) vessels. 10. ANTICIPATED IMPACTS The proposed pier system construction would incorporate 399 sq. ft. of Estuarine Waters and Pubic Trust Area. Minor increases in turbidity should be expected during construction. The proposed pier would extend approximately 120 feet into a waterbody which measures approximately 600 feet across. This distance would conform with the 1 /4 width rule and the established pier lengths. As proposed, the applicant's proposal would not encroach into the 80 foot setback from the AIWW.
