Donaldson and Kirk Page 2 9. PROJECT DESCRIPTION: The project site is located at 1913 and 1917 Atlantic Dr., adjacent to the Atlantic Intracoastal Waterway and Middle Sound. The site is located in the City of Wilmington in New Hanover County. To locate the property from Market Street (NC Highwayl7), turn onto Middle Sound Loop Road and travel east past Ogden Elementary School approximately 2 miles. Turn left on Mason Landing Road and travel approximately 0.2 miles just until the road turns to the left and continue going forward into the entrance to theWinston Broadfoot, UNCW Nature Preserve. Bare to the right once into the entrance and the properties of interest will be the second and third properties located to the left. The lots are approximately 0.75 acres with 100' of shoreline frontage each. The lots average 10-20 feet above mean sea level and the shorelines are stabilized by vegetation and a retaining wall located on property 1913 Atlantic Drive. The applicants maintain a two story single-family residence on each property. Highground vegetation consists of lawn grasses and ornamental landscaping. An area of approximately 50 feet wide consists of upland vegetation including Oak, Holly, and Cedar trees. Waterward of the upland vegetation is an area of high marsh consisting mixed coastal wetlands and "404 type" vegetation consisting of Marsh Elder (Iva frutescens), Grounsel-bush (Baccharus halimifolia), Cattail (Typha spp.), Wax Myrtle (Myrica cerifera L.), Bulrush (Scirpus spp.), Black Needlerush (Juncus roemerianus) and Salt Meadow Grass (Spartina patens). The properties transition from high marsh to low marsh of an area approximately 225 feet wide to the AIWW, consisting primarily of Smooth Cordgrass (Spartina alterniflora). The New Hanover County Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the AIWW and Middle Sound are classified SA-ORW by the Division of Water Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicants propose to construct a private pier system at a distance of (4'x 430') between their two properties towards the AIWW. The pier would extend approximately 370 feet beyond Normal High Water (NHW) and 130 feet beyond the marsh. The pier would terminate in a platform (8'x IT) over open water with (2) (12'x IT) gazebos on the north and south side of the platform. (2) (6'x 16) floating docks with ramps would be attached perpendicular to AIWW, one with each (12' x 12') gazebo. (2) (12'x IT) boatlifts would be installed with each floating dock, one on the northern side of northern floating dock and the other on the southern side of the southern floating dock. Additional dockage is also proposed on the inside of the floating docks. The structure would provide docking space for up to (4) vessels. As proposed, the applicant's proposal would not encroach into the 80 foot setback from the AIWW Submitted by: R.Mairs Date: 8/31/2004 Office: Wilmington Recommendations for State Permit -Donaldson and Kirk 8/31/2004 The total area of "T heads", platforms, and finger piers was calculated as follows: Shoreline length = 200 ft. x 4 sq. ft = 800 sq. ft. allowable. Platform = 96 sq. ft. Gazebos = 288 sq. ft Finger piers = 192 sq. ft. Total = 576 sq. ft. The construction would provide docking space for the total up to four (4) vessels. I have no objections to the proposed project. Any permit issued should include the following conditions: 1. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non-water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pierhead line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third-parry. 8. This permit authorizes a maximum of (4) boat slips. At no time shall more than (4) vessels be moored or docked at the facility. (Refer to Coastal Resources Commission Rule 71.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) Each drawing must have a simple title block, which should include the applicants name, drawing number (i.e. Page 1 of 4) and the date the application was prepared. Undated drawings can not'be accepted. The workplans must be accurately drawn to scale (1" = 200' or less) (example: 1" = 30', V = 50', 1" = 100', etc.). The scale must be indicated on each drawing. All blueprints should be folded to legal size or smaller. Location Map Your application must include a map showing the location of the proposed work or development. This map must provide adequate information to allow someone unfamiliar with the project area to locate the project site. This narrative should discuss the character and purpose of the proposed development, construction methodologies and any other special or relevant considerations. Deed Your permit application package must include a copy of a deed, purchase agreement or other legal instrument under which the applicant claims the right to develop the property m question. Consultant or Authorized Agent If an authorized agent has been retained to obtain your CAMA permit, you must provide a letter granting your agent the right to apply on your behalf. Wetland Delineation Approval If applicable, documentation of U.S. Army Corps of Engineers wetland delineation approval should be provided. Adjacent Property Owner Notification Certified letters (Return Receipt Requested) with the copies of the permit application package (permit application forms and appropriate workplan drawings) must be sent to all adjacent propert owners. The signed return receipt(s) must be provided with the permit application. This notification must also include instructions to the adjacent property owner that any objections or concerns they have about your proposed development should be provided in writing to the Division of Coastal Management. Stormwater Management Plan Certification If your proposal will lead to an increase in built-upon area on your property, you may be required to submit a stormwater management plan to the N.C. Division of Water Quality for review and approval. You are advised that the Division of Coastal Management can not issue a CAMA permit until this approval has been obtained. Ocean and Inlet Hazard Notices For projects within oceanfront and inlet areas, an Area of Environmental Concern (AEC) Hazard Notice Form must be signed. This form is available from your local CAMA permit representative. Other Information At the discretion of the Division of Coastal Management, additional information may be requested.
