APPROVAL of Neuse River Buffer Rule (15A NCAC 02B .0233) Authorization Certificate
Dear Mr. Mr. Ciao:
You have our approval, in accordance with 15A NCAC 02B .0233 and any conditions listed below, to
impact approximately 1,215 ft2 of Zone 1 and 4,123 ft2 of Zone2 of the protected riparian buffers for the
purpose of constructing the sewer system at the subject property ,'s described within your application
dated October 7, 2004. In addition, you should obtain or otherwise comply with any other required
federal, state or local permits before you go ahead with your project including (but not limited to) Erosion
and Sediment Control, Non-discharge regulations.
This approval is for the purpose and design that you described in your application. If you change your
.project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this authorization and approval letter and is thereby responsible
for complying with all conditions. This approval requires you to follow the conditions listed below.
The Additional Conditions of the Certification are:
1. Impacts Approved - The following impacts are hereby approved as long as all of the other specific
and general conditions of this Authorization Certificate are met. No other impacts are approved
including incidental impacts:

2. Buffer Mitigation (EEP) - You are required to mitigate for impacts to the protected riparian buffers.
The required area of mitigation to compensate for impacts to the protected riparian buffers is 3,645
square feet as required under this Authorization Certificate and 15A NCAC 2B .0242(buffer mitigation
rule). We understand that you wish to make a payment into the Riparian Buffer Restoration Fund
administered by the NC Ecosystem Enhancement Program (EEP) to meet this mitigation requirement.
This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. In
accordance with 15A NCAC 2B .0242(7)(buffer mitigation rule), this contribution will satisfy our

compensatory mitigation requirements under 15A NCAC 213 .0233(10)(buffer protection rule). Until
the EEP receives and clears your check (made payable to: DENR - Ecosystem Enhancement Program
Office), no impacts specified in this Authorization Certificate shall occur. The EEP should be contacted
at (919) 733-5208 if you have any questions concerning payment into the Riparian Buffer Restoration
Fund. You have one month from the date of this approval to make this payment. For accounting
purposes, this Authorization Certificate authorizes payment into the Riparian Buffer Restoration
Fund to compensate for 3,645 ft2 of required riparian buffer mitigation for impacts to 1,215 ftz of
Zone 1 of protected riparian buffers; 03-04-02 river and subbasin, 27-33-4-1 stream index #.
3. Diffuse Flow - An additional condition is that all stormwater shall be directed as diffuse flow at non-
erosive velocities through the protected stream buffers and will not re-concentrate before discharging
into the stream as identified within 15A NCAC 213 .0233(5).
4. Certificate of Completion - Upon completion of all work approved within this authorization, and any
subsequent modifications, the applicant is required to return the attached certificate of completion to
the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center,
Raleigh, NC, 27699-1650.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved
buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is
subject to review as provided in Articles 3 and 4 of G.S. 150B.. This Authorization Certificate shall
expire five (5) years from the date of this letter.
This letter completes the review of the "No Practical Alternatives" determination under 15A NCAC 213
.0233. If you have any questions or would like a copy of the buffer rules, please call (919) 733-1786.
This letter does not authorize any impacts to either Waters of the United States or Waters of the State.
Please contact the US Army Corps of Engineers (USACE) or NC Division of Water Quality (DWQ) if
any impacts are proposed to either of these waters.

Re: Reply to the DWQ's September 8, 2004 letter requesting further information for the
proposed Alexander Place Sewer Outfall, Wake County, North Carolina
Dear Mr. Zarzecki:
This letter is in response to your letter dated September 8, 2004 (copy attached), which
requested additional information for the proposed road crossing. The following restates
your questions and follows each with our response:
I Application
a. Please provide seven copies of the dated and signed signature page of the
application.
Please find attached seven copies of the revised PCN form including the signed signature
page. A complete PCN form is provided due to the deletion of the buffer impacts on the
portion of the easement east of Highway 70.
2. Plan Details
a. Please indicate all buffer impacts on the site plan clearly depict Zone I and
Zone 2 on the site plans. Also, please show stream on the Eastern side of US 70,
with appropriate Buffer Zones.
A version of the impact map is attached which more clearly shows the streams and
associated riparian buffers.
b. Please explain MH9. What does that tie into? Where does that go?
Manhole 9 (MH9) ties to the proposed commercial site east of Highway 70 (see attached
map).

c. Please clearly label the top of the stream or the edge of the surface water that
you have measured the buffers from east of US 70. What does the "x" area depict
(wetlands, flood plain, etc.)?
The attached map depicts the stream edge and the associated buffers on the portion of the
property east of Highway 70. The sewer easement has been located to entirely avoid the
buffers in this area (the revised PCN Form accounts for this change). The "x" area
depicted on the originally submitted map indicated the 100-year floodplain.

On August 31, 2004, the Division of Water Quality (DWQ) received your application to impact 5414
square feet of buffers to install utility liens. The DWQ has det4rmined that your application was
incomplete and/or provided inaccurate information as discussed\below. The DWQ will require additional
information in order to process your application to impact protected wetlands and/or streams on the
subject property. Therefore, unless we receive the additional information requested below, we will have
to move toward denial of your application as required by 15A NCAC 2H.0506 and will place this project
on hold as incomplete until we receive this additional information. Please provide the following
information so that we may continue to review your project.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are

at the time of this application: The easement is currently undeveloped and lightly wooded
due to the adjacent floodplain.

10. Describe the overall project in detail, including the type of equipment to be used: The
proposed project is a sanitary sewer line extension which will in turn be turned over to the
City of Raleigh. The impact of the proposed sewer will be to the riparian buffer of Little
Brier Creek and will not result in any wetland or stream impacts. Typical excavating and
rg adinggquipment will be used during construction activities.
11. Explain the purpose of the proposed work: The purpose of the proposed work is to install
needed utilities to serve the surrounding area and specifically to provide service to the
Alexander Place property.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules.
The wetland delineation was approved in September. 1999 (Action ID # 199921331) and NC-
DWQ confirmed the channel features subject to the Neuse River Buffers in August 1999
(NBRRO 99 196).
V. Future Project Plans
Are any future permit requests anticipated for this project? If so, describe the anticipated work,
and provide justification for the exclusion of this work from the current application.
No future project plans requiring 401/404/Buffer Compliance are proposed at this time or known
to be needed in the future.
VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. The applicant must also
provide justification for these impacts in Section VII below. All proposed impacts, permanent
and temporary, must be listed herein, and must be clearly identifiable on an accompanying site
plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a
delineation map, whether or not impacts are proposed to these systems. Wetland and stream
evaluation and delineation forms should be included as appropriate. Photographs may be

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Impacts are unavoidable due to unstable soils in the surrounding area. Drilling under the
adjacent property (see "existing, building" on attached map) was proposed but was abandoned
due to concerns with the structural integrity.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.

If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Impacts are unavoidable due to unstable soils in the surrounding area. Drilling under the
adjacent property (see "existing building" on attached map) was proposed but was abandoned
due to concerns with the structural integrity.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
