Charlotte Mecklenburg Utilities -Mallard Creek WWTP

Dear Ms. Cousar:
As you pointed out in your earlier contact with me, the subject facility appears on the EPA's ECHO
database as being in violation of the reporting requirements of its NPDES permit during the months of
July—September 2006. I have examined the Division of Water Quality's hard copy and computer
records for data submitted by the facility during that time period in order to ascertain the veracity of the
EPA's designation.
The Division's records for July—September 2006 show all required information was submitted by the
facility in a timely fashion. The Division has no record of the facility being in violation of permit
reporting requirements. Right now, I do not know why the EPA database shows the Mallard Creek
WWTP to be in violation during the noted months, but I suspect it is the result of some sort of data
transmission error between the state and federal computer systems. I will continue to look into this
situation. Hopefully we can find the source of the problem, correct it and have the correct facility status
appear on ECHO. Thank you for your patience in this matter.
