After a quick look, seems like the time and money required to do the hyrdogeological evaluation may not be worth it for just the possible benefit of 1' of relief. That requirement is from the North Carolina Stormwater Design Manual (https://deg.nc.gov/sw-bmp-manual). The manual does provide options for allowing less than 2 feet of separation. See page 4 of Section A-2 from the manual (https://files.nc.gov/ncdeg/Energy%20Mineral%20and%20Land%20Resources/Stormwater/BMP%20Manual/A- 2%20%20Soils.pdf), which requires a hydrogeological evaluation. Please review the hydrogeolocial evaluation requirements. A less than 2-foot separation may be approvable if the requirements of the evaluation can be demonstrated.
