After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3351 covers these water impacts. This Ce fication allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers,(USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations, Coastal Stormwater and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. The Additional Conditions of the Certification are: 1. Water Quality Certification The proposed project must comply with all of the conditions of General Water Quality Certification (GC) 3351. 4. Mill Creek Heavy equipment shall not be operated within the existing 30-foot buffer area adjacent to Mill Creek. The proposed pier over Mill Creek shall be placed at a minimum of three feet above the substrate. The six foot wide access to the pier through the buffer is allowed. A silt curtain at the mouth of the canal and other sediment and erosion control devices shall be installed construction and widening of the canal is begun. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorised by this Certification, shall expire upon expiration of the 404 or CAMA Permit. If you do not accept any of the conditions of this Certification (associated with the approved water impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. Smith Hyde County Project Setting The project site is a 15-acre tract located on the south side of HWY 264 adjacent Rutman Creek off the Alligator/Pungo River cut of the Intercoastal Waterway in western Hyde County near the community of Ponzer, North Carolina. Access to the site is off HWY 264 through a gated dirt path. The site consists of an upland ridge that has been thinned and is currently vegetated with various upland grasses and hardwood trees. A mix of Coastal Wetlands and 404 wooded wetlands surrounds the ridge. There is an 8' wide x 200' long ditch/canal off Rutman Creek through wetlands that connects to an existing 50' x 70' basin in the upland ridge. Water depths in the existing canal and basin are generally less than 2'. The south side of the ditch/canal is a Coastal Wetland vegetated with Saw Grass {Cladium iamaicense). There is an area of highgound +20' wide adjacent the canal on the north side, probably. as a result of the original canal excavation, connecting the creek shoreline to the upland ridge. The channel in Rutman Creek tends to follow the western side of the Creek in the vicinity of the project site. Water depths reach 4' deep 25' offshore of the existing ditch/canal. Observations made from the shoreline did not detect the presence of any submerged aquatic vegetation. Rutman Creek is classified as SC NSW by the Environmental Management Commission and as Inland Waters by the Wildlife Resource Commission and is closed to shellfishing. Project Description The applicant proposes to widen the existing canal to a finished width of 18' and widen the existing basin to a final dimension of 70' x 70'. All excavation to widen the existing canal and basin will occur in highground with the exception of an area of 404 wetlands approximately 10' x 10' adjacent Rutman Creek and the existing canal. The applicant proposes a final depth of minus 4, digging to the 4' contour in Rutman Creek. The spoil material generated from the excavation activities is to be trucked to an area of highground on the ridge and graded out in area 200' x 200'to be later used as a residential building site. A 20' wide x 30' long boat ramp is planned in the basin. The applicant also proposes to construct a 6'wide x 25'long pier in Rutman Creek. Anticipated Impacts The project will result in the excavation of ±500 ft2 of creek bottom and 5,180 ft2 of existing canal and basin bottom. Widening of the existing canal and basin will result in the excavation of 3,500 ft2 of highground. There will be some short term turbidity associated with the excavation activities. Construction of the boat ramp will fill 600 ft' of basin bottom. A 200' x 200' area of highground will be filled and graded with the resultant spoil. The pier will shade ±150 ft2 of creek bottom. The project will increase boat traffic and their associated impacts in the immediate area.
