After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3373, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetiands. The General Certification allows you to use Regional Permit No. 198200030 once it is issued to you by the U.S. Army Corps of Engineers (USACOE). This letter also serves as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 213 .0243. Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. The above noted Certification will expire when the associated USACOE's 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby responsible for complying with all conditions. If the total wetland fill for this project (now or in the future) exceeds one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached Certification, as well as the additional conditions listed below. 1. All stormwater shall be directed as diffuse flow at non-erosive velocities through the buffer so as not to re-concentrate before discharging into the lake. 2. Shoreline stabilization requested for a boat slip. The shoreline is uneven with both verticle banks (24" above lake bed) and gentle slope landward. For construction of the dock/pier the shoreline needs to be "squared up". The dock/pier is to extend annrox ly 20 ft along the shoreline. The applicant is Shavender Development Group, LLC. The project in question is in the Shavender's Bluff Subdivision off The Beaten Path on Lake Norman in Iredell County. The project, to construct a 10-slip facility to serve private owner-residents in Shavender's Bluff, was originally approved when construction began on the subdivision in the late 1990s. All approval was obtained, but Duke Power's permit to construct expired, which makes the re-submittal necessary. In conjunction with building the boat slips, we would like to stabilize the shoreline with a riprap wall. The shoreline at the proposed location is on a steep incline and has signs of erosion. Our plan is to keep the area as natural as possible. We have built a walking trail to access the proposed site and the construction equipment needed for the work will use that trail to get to the work site. The walking trail will be the only access to the proposed facility. Slip owners will have to park in a lot up on the hill and walk down to the water. We have planned this in orderto keep the area natural and to enable us to remove as few trees and plants as possible. Shavender Development Group, LLC., the developer of Shavender's Bluff, owns all the property surrounding the proposed site, as the enclosed map indicates.
