Johnson, and Hamstead, Enclosed is a request for Nationwide Permit # 29 for the approximate 123 acre site known as the Bellavista site located northwest of the intersection of North Little Egypt Road and Hwy 73 and Southbridge Drive in Denver, NC. The site is a proposed residential development and consists of eight streams and five wetlands. A preliminary jurisdictional determination (PJD) request was submitted on 9/23/19 and was verified by USACE (Catherine Janiczak) on 10/30/19. Please refer to the Jurisdictional Determination section and attached Notice of Jurisdictional Determination (SAW-2019-01824) for updated information on onsite surface waters. As shown on the attached exhibits, the proposed project will include impacts to one stream (Stream B) and two wetlands (Wetlands F/FF & C) for two residential access road crossings. Two crossings for this development have been specifically required by the Lincoln County Fire Marshall based safety/access reasons. The crossings have been designed to meet DOT specifications which do not allow for bottomless culverts in this case. Within these restrictions, the crossings have been designed to be as narrow as possible to minimize impacts to surface 2 waters. Overall impacts to site surface waters associated with the proposed development were limited through site selection location, design, location/orientation of the proposed lots and access routes. The total permanent stream impacts proposed include 255 linear feet of stream impacts (Perennial Stream B). Of these, 20 linear feet will be due to stabilizing rip rap installed at existing stream bed elevations and will not contribute to a loss-to-waters of the U.S. The total permanent wetland impacts include 0.097 ac (Wetland F/FF) for a culvert & fill associated with crossing # 2 as well as 0.0007 ac (Wetland C) for the construction of a headwall and outlet structure associated with crossing #1. Minor additional temporary impacts are required for construction access will be restored to pre-existing conditions as described on the attached exhibits. Efforts of impact minimization were implemented during the design to preserve the existing hydrology and limit adverse effects to existing, onsite natural habitat. Headwalls and 2:1 slopes where possible will be used in accordance with DOT standards to minimize impacts at the required road crossings. Large retaining walls are utilized across the site where needed to avoid wetland impacts. Utilities have been located strategically and will be bored where necessary to avoid additional impacts. The applicant has demonstrated substantial avoidance and minimization efforts in which 95% of the 5,432 linear feet of stream channel and 98% of the 4.23 of acres onsite will be avoided. To compensate for the anticipated permanent impacts, the applicant is proposing payment into the NCDMS In-Lieu Fee program at a 2:1 ratio for 235 linear feet of perennial warm water stream. A copy of the conditional acceptance letter from the NCDMS is attached. Also enclosed is a copy of our Threatened/Endangered Species Evaluation for the site. No listed species were identified within the project area and we believe that there will be no effect on listed species or their critical habitat as designated under Section 7 of the Endangered Species Act. General land use in the vicinity is a mixture undeveloped land and residential/ commercial developments. 4.23 The project consists of two road crossings, grading, fill & sewer installation for a residential development. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will expire. Once DMS receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. Gaffney December 19, 2019 Taylor Morrison – Bella Vista Threatened / Endangered / Protected Species Evaluation 222 GENERAL LANDSCAPE DESCRIPTION: The Taylor Morrison – Bella Vista site is located just west of N. Little Egypt Road, Just north of Hwy 73, and just east of Killian Creek in Lincoln County, North Carolina. The +/- 114 acre site can be found on the Lowesville USGS Topographic Quadrangle Map; latitude is 35.4610 °N, longitude is -81.0320 °W. The topography consists of gently sloping upland grading into moderate slopes and drainages with the elevation ranging from 690 to 810 ft. The site is characterized by disturbed, mixed pine/hardwood forest in varying degrees of succession from farming and timber operations, and low lying floodplain woods along Killian Creek. (Figure 1). Figure 1: Taylor Morrison – Bella Vista Threatened / Endangered / Protected Species Evaluation 3333 METHODOLOGY: The US Fish and Wildlife Service website https://www.fws.gov/raleigh/species/cntylist/lincoln.html was referenced to determine the occurrence of Threatened, Endangered and Protected species for Lincoln County North Carolina, the results of which are listed below (Table 1). Maps and aerial photographs were assembled, and the site was investigated during the weeks of October 28 and November 4, 2019. Taylor Morrison – Bella Vista Threatened / Endangered / Protected Species Evaluation 444 Georgia aster (Symphyotrichum georgianum), listed as Candidate, requires open habitat with little shade, such as roadsides, power-line rights-of-way (PLROW) and woodlands and field edges. Michaux’s sumac (Rhus michauxii), listed as Federally Endangered, requires habitat of sandy forests and woodland edges. This species requires periodic fire as a part of its ecology. One animal species with federal protection is listed as potentially occurring in Lincoln County: Northern long-eared bat (Myotis septentrionalis), listed as Federally Threatened. During summer, northern long-eared bats roost singly or in colonies underneath bark, in cavities, or in crevices of both live and dead trees. Males and non-reproductive females may also roost in cooler places, like caves and mines. It has also been found, rarely, roosting in structures like barns and sheds. Northern long-eared bats spend winter hibernating in caves and mines, called hibernacula. RESULTS: The site is characterized by disturbed, mixed pine/hardwood forest in varying degrees of succession from farming and timber operations, and low lying floodplain woods along Killian Creek. (Figure 1). The disturbed, mixed pine and hardwood forest on the site has an average diameter at breast height (DBH) for the canopy trees of 8 inches, with some larger trees present. Pines are more dominant on the upper slopes, mixing with hardwoods on lower slopes and drainages. Canopy species present are Loblolly Pine (Pinus taeda), Shortleaf Pine (P. echinata), Virginia Pine (P. virginiana), White Oak (Quercus alba), Red Oak (Q. rubra), Black Oak (Q. velutina), White Ash (Fraxinus americana), Mockernut Hickory (C. tomentosa), Bitternut Hickory (C. cordiformis), Sweetgum (Liquidambar styraciflua), and Yellow Poplar (Liriodendron tulipifera). Low lying areas also have Sycamore (Platanus occidentalis), Cottonwood (Populus deltoides), and Green Ash (Fraxinus pennsylvanica). Subcanopy species include Ironwood (Carpinus caroliniana), Red Maple (Acer rubrum), Eastern Red Cedar (Juniperus virginiana), Flowering Dogwood (Cornus florida), American Holly (Ilex opaca), Hackberry (Celtis laevigata), Black Gum (Nyssa sylvatica), Winged Elm (Ulmus alata), Redbud (Cercis canadensis), and Black Cherry (Prunus serotina). The shrubs include Blueberry (Vaccinium sp.), Russian Olive (Elaeagnus umbellata), and Chinese Privet (Ligustrum sinense). Silky Dogwood and Elderberry are in the more mesic areas. The herb layer is sparse on upper slopes, increasing in cover on lower slopes, with wetter areas dominated by invasive Japanese Stiltgrass (Microstegium vimineum). Herb species include Christmas Fern (Polystichum Taylor Morrison – Bella Vista Threatened / Endangered / Protected Species Evaluation 5555 acrostichoides), Spotted Wintergreen (Chimaphila maculata), Ebony Spleenwort (Asplenium platyneuron), River Oats (Chasmanthium latifolium), Panic Grass (Panicum sp.), Crane-fly Orchid (Tipularia discolor), and Grapefern (Botrychium sp.), Vines present are Japanese Honeysuckle (Lonicera japonica), Catbriar (Smilax sp.),Trumpet Creeper (Campsis radicans), Crossvine (Anisostichus capreolata), , Muscadine (Vitis rotundifolia), and Poison Ivy (Toxicodendron radicans). The assemblage of plants growing along the N. Little Egypt Road right of way includes Broomsedge (Andropogon virginicus), Plume Grass (Erianthus contortus), Johnson Grass (Sorghum halepense), Indian Grass (Sorghastrum nutans), Sericea Lespedeza (Lespedeza cuneata), Ragweed (Ambrosia artemisiifolia), Goldenrod (Solidago sp.), and Poke Weed (Phytolacca americana). Threatened / Endangered / Protected Species Results There was no suitable habitat for Dwarf Dwarf-flowered Heartleaf found on the site. The potential habitat for Michaux’s Sumac, and Georgia Aster on the roadside along N. Little Egypt Road was surveyed and these species were not present. Comparing this site location to the USFWS Asheville office’s website (http://www.fws.gov/asheville/htmls/project_review/NLEB_in_WNC.html) it appears that the site meets the “exempt” criteria which requires no further action under section 7 of the Endangered Species Act for the Northern long-eared bat. RECOMMENDATIONS: Based on the site investigation and the review of available data, WEPG did not identify any protected species occurring on the subject property.
