Dear Mr. Hutton:
This correspondence is in reference to the Grantham Branch Mitigation Site, part of the Falling
Creek Umbrella Mitigation Bank. The 94-acre site is adjacent to Falling Creek in the Upper Neuse
Cataloging Unit (03020201) and located south of the intersection of Grantham School Road and
U.S. Highway 13 South, in Wayne County, North Carolina. The purpose of this letter is to confirm
the second release of credits (As -Built Implementation) for this mitigation site.
Pursuant to the Umbrella Mitigation Banking Instrument (UMBI) entitled, Agreement to
Establish the Falling Creek Umbrella Mitigation Bank in Neuse River Basin Within the State of
North Carolina, approved February 28, 2017; the site -specific Grantham Branch Final Mitigation
Plan, dated December 2017; and the Baseline Monitoring Document and As -Built Baseline
Document for the Grantham Branch Mitigation Site, dated June 2018, fifteen percent (15%) of the
mitigation site's total stream and wetland restoration and enhancement credits shall be available
for sale immediately upon completion of all of the following:
a. Successful completion of all stream restoration and enhancement activities (As -Built
Construction) as described in the Plan, dated December 2017;
b. Successful completion of all planting activities as described in the Plan, dated
December 2017; and
c. Successful completion of easement fencing suitable for livestock exclusion as outlined
in the Plan, dated December 2017.
Please note that you must submit the financial assurance for monitoring in the form of a bond,
letter of credit, or casualty insurance by August 2, 2018. Failure to comply may lead to a
suspension in credit sales.
By copy of this correspondence, we confirm that you have satisfied the above requirements for
the second release of credits (As -Built Implementation) for all parcels within the bank. As such,
412.35 stream mitigation units (SMUs) and 0.59 wetland mitigation units (WMUs), constituting
15% of the mitigation bank site's total stream and wetland credits are now available for sale. To
date, 30 percent (824.7 SMUs and 1.18 WMUs) of the total stream and wetland restoration and
enhancement credits (2749 SMUs, 3.905 WMUs), and 100% of the total stream and wetland
preservation credits (498 SMUs and 6.13 WMUs) have been released. Our records indicate that
zero (0) stream and wetland credits associated with this mitigation site have been debited as of
July 3, 2018. Therefore, the current total amount of credits available for sale is 1322.7 SMUs and
7.31 WMUs.
